Gentlemen:
This is in reply to your letters to the above captioned
dated January 17th and 24th respectively.
The premises are occupied by Frances Wingate, on the
first floor,and Judith Rideout on ffie second floor. The terms
of occupancy are that the tenants supply the heat and clear
out the rubbish and maintain their part of the premises in a
neat and clean condition. My client has sent his employees
down to the area and repeatedly instructed the tenants to
clear out the debris that accumulated and cease and desist
their further littering of the area. ,
The landlord has not had any cooperation from the tenants.
The landlord has requested Clark Fuel Company to check into the
furnace complaint, and was informed that the heating was in
good working o der. ,, The landlord is unable to bring his property
up to a condition of r pair as he desires with the present tenants
in occupancy. I have, therefore, this day served notice of
eviction on these ten nts, and hopefully in the near future, the
landlord will have to en possession of the premises and cause
them to be repaired.

Dear Sir,
In response to your letter of December 14, 1973 , I am
requesting a hearing before the Board. of Health . The prop—
erty concerned is located at 4 Pearl Street , Salem.
My reason for requesting this hearing is my belief that
the notice of violations contains a number of serious errors.
Within the time allowed (7 days) I shall correct the
violation noted in item 15 in the list of alleged violations.
Since I believe the other items to be in serious error, I
shall await the outcome of the hearing before taking further
action.

and as a result of an inspection or an incident observed by an
inspector of the Salem Fire Department, you are hereby notified
to remedy the conditions named below, within the time specified

1 . Structure appears to be open to vandalism and in deteriorating
condition. 2 . Excessive buildup of Combustible Materials within
and outside of building.

GENERAL LAWS CHAPTER 148
Section 30. Violation of any lawful rule, order or regulation of the department or of
any lawful rule or order of the marshal or of the head of a fire department, punishment
whereof is not otherwise provided for, shall be punished by a fine of not more than
ten dollars for each day during which such violation continues after notice to the
offender. Such notice may be given by personal service or by posting the same in a
conspicuous place on the premises thereby. The superior court shall have jurisdiction
in equity to enforce any lawful rule, order or regulation of the department, or any
lawful rule or order of the marshal or of the head of a fire department, upon applica-
tion respectively of the commissioner, the marshal or the head of the fire department.
