Dear Mr . Hickson :
In regards to 12 Peabody Street , a follow-up insepction on February
7 , 1989 of the unit occupied by Jenny Carrion , I found that the devices
in question on January 20, 1989 was replaced by single pole switches .
According to City records to date , the Electrical Department has not re-
ceived any permit from a licensed electrician , who should have installed
the single pole switches . A licensed electrician is the only qualified
person to do this work . You are jeopardizing your tenants safety rights
and your insurance policy. If this activity persists court action will
follow.
Please be advised , you are in violation of Massachusetts General
Laws , Chapter 141 and the National and Massachusetts Electrical Code ,
Article 300 wiring methods .

In regard the collapsed retaining wall behind, 12 Peabody Street and
11 Ward Street, pleased be informed that we 'have ,not been able to
identify ownership of the wall and responsibility, if any, for re-
placing it. We have r*inedreounsel to prep-ate a formal legal opinion
regarding the wall. This should be available at the end of February.
If you are considering taking any action id regard to the wall, may
I suggest waiting until counsel has prepared an opinion, which we
shall share with you. A proper lega[lsopinion will provide us with a
perspective clarifying the responsibilities involved. Please con-

Dear Mr. MacIntosh:
Enclosed is a copy of the legal opinion prepared by the firm of Frawley
and Jennings in regard to the ownership o£ ethe retaining wall between
12 Peabody Street and 11 Ward Street. The opinion is based upon an
examination of the wall by a construction consultant, a research of
deeds, a review of surveys, and a review of pertinent legal issues.
Based upon the prepared opinion, we are acting as if the wall were a
party wall; we have filed a claim with our insurance company; and
when a settlement is determined, we shall proceed with replacing the
wall.
It should be apparent that we are taking action to correct the situation.
However, it is clear to us that we are the injured party and such action
is intended to protect our property. It is obvious that the wall col-
lapsed onto our property following the pumping of water from the roof
of 11 Ward Street. If the, property„ owners of 11 Ward Street or 8 Ward
Street believe that their"properties are in any danger, they should
take action to secure their-property. However, at this time, we seem
to be the only party doing anything other than complaining that some-
one else should be doing somethng.We shall continue in our effort to
replace the wall. If anyone has any questions, please refer them to me
or to our attorney, Dennis Jackson.

Dear Mr. Joyce :
On or about December 16 , 1983, you as Executive Director of the
Salem Harbor Community Development Corporation engaged our law
firm for the purpose of rendering a legal opinion regarding the
status of a collapsed wall behind your property at 12 Peabody St. ,
Salem, Mass. At that time you informed us that the wall had collapsed
in October . after the Salem Fire Department had pumped a large amount
of water off of the roof of an adjoining building at 11 Ward St, owned
by Anna Larsen. It appears that due to the construction of the wall
it collapsed because of the pressure exerted on it from the water
pumped from Anna LarsenIs roof.
Prior to rendering this opinion, our office. conducted on site 'inspec-
tion of the properties involved, reviewed surveys , conducted a title °xN
search, and examined relevant Massachusetts law pertinent to the
issues involved.
Our office met with you on two separate occassions at the 12 Peabody
St. site. At the first meeting, Attorney John Jennings and myself
viewed the collapsed wall, and at the second meeting Mr. Joe W.
Clarke, a construction consultant and myself viewed the property.
At one of our meetings, you supplied our office with copies of the
survey plans done by William L. Clarke a registered land surveyor.
An examination of that survey, a copy of which is hereto attached. .
indicates that the collapsed wall is partially on the property of
both the Salem Harbor Community Development Corporation and that of
Anna Larsen.
a In so much as the survey indicates this,my opinion is that the
collapsed wall served as a "party wall" , either expressed or
implied.
After viewing the property and examining the surveys supplied
to us, a title search was conducted on February 23, 1983 by
Margaret Ross , a title examiner. Both Joe Clarke and yourself
were present. Although the title search did not show when the
wall was built or who built the wall , it did indicate that the
lot owned by the Salem Harbor Community Development Corporation
and the lot owned by Anna Larsen were at one time one single
lot and were later sub-divided.
After conducting the title search and viewing both the sites at
12 Peabody St. and 11 hard St. , as well as considering the general
topography of the Ward Hill area it is my opinion that the lot at
-12 Peabody St. was developed prior in time than the lot at 11 Ward
St. was developed. If this matter has to go into litigation to be
resolved, I belive we could prove by circumstantial evidence and
reasonable inferences that there was originally a small wall behind
your property at 12 Peabody St. which according to the survey was
erected partially on your land and partially on Anna Larsenys land.
As such this wall is a "party wall" . This wall is not so defined
in any of the information contained in the title search and was
not created by an express grant. As such, my opinion is that the
court could imply what the intention of the parties was and classify
it as a "party wall" .
The nextissue that arises is who extended the wall to its present
height and who is responsible for any damage caused by the extension.
My opinion is, and again, if the matter goes into litigation I
believe we could show again by circumstantial evidence and reasonable
inferences that your land was developed first and the land at 11
Ward St. sometime later. In order for the building to be erected
on the land at 11 Ward Street, a higher wall had to be erected and
the land at 11 Ward St. filled in to level it off so that develop-
ment could take place. Therefore the logical inference to be drawn
is that the original existing party wall was extended at some
time by the owners of the property of 11 Ward St. This does not
necessarily mean Anna Larsen, but most likely by a predecessor
in title of that property now owned by Anna Larsen. Further, it
is my opinion that the extension of the wall was a permissable
extension by whoever owned the property at 11 Ward St. at the time
of the extension. See Fleming vs Cohen, 186 Mass 323 (.1904) ,
Everett vs Edwards 149 Mass 588 (1889) .
If we can show that the owner of 11 ward St. at sometime extended
}
this wall , the next question is what would Anna Larsen' s liability
be for any damage caused by this extension. In the case of Everett
vs. Edwards, supra, the court dealt with a case somewhat similiar
to the facts in this case. The court held that the original party
wall could be extended by either party to support a newly erected
building or an addition to an already existing building. In the
Everett case, the court did not have to decide who would be re-
sponsible for any damage caused by this extension,but did mention
that any extension of an existing party wall, "will be done without
impairing the integrity erstability of the existing wall" . Everett
SUPRA at 591.If we take that language and apply it to the first
gituation concerning the wall hehind 12 Peabody St. , a reasonable
argument could be made that Anna Larsen is liable for the damage
caused by the extension of the wall, especially if we could show
that it was poorly constructed.
However, due tq the numerous legal questions involved, the potential
legal costs in determining those issues, and the obvious necessity
in restoring the wall , as soon as possible it would be my opinion
that Salem Harbor Community Development Corporation accept the wall
as a party wall and submit a claim to its insurer with a copy of
this opinion. Both Anna Larsen' s insurer and your insurer should
share in the costs of erecting a new wall .

FIRE DEPARTMENT CERTIFICATE OF APPROVAL FOR BUILDING PERMIT
In compliance with the provision of Section 113.5 of the Massachusetts
State Building Code, and under guidelines agreed upon by the Salem Bldg. �-
Inspector and the Salem Fire Chief, the applicant for a building permit
shall obtain the Certificate of Approval (see reverse side) and stamped
plan approval from the Salem Fire Prevention Bureau.
Said application and approval is required before a building permit may be _J W
issued. The Massachusetts State Building Code requires compliance z w I

approval of the Salem Fire Department, with reference to provisions of LL m w
Articles 4 and 12 of the Building Code, the Salem Fire Code, Massachusetts n: F_
General Laws, and 527 Code of Massachusetts Regulations. O cn 0

The applicant shall submit this application with three (3) sets of plans, UJ
drawn in sufficient clarity, to obtain stamped approval of the Salem Fire tN F-
Department. This applies for all new construction, substantial o w W o
alterations, change of use and/or occupancy, and any other approvals
required by the Massachusetts General Laws, and the Salem Fire Code. ¢ Z
Exception: Plans will not be required for structural work when the
proposed work to be performed under the building permit will
not, in the opinion of the Building Inspector, require a
plan to show the nature and character of the work to be
performed.
Notice: Plans are normally required for fire suppression systems,
fire alarm systems, tank installations, and Fire Code
requirements.
Under the provisions of Article 22 of the Massachusetts State Building
Code, certain proposed projects may not require submission of plans or
complete compliance with new construction requirements. In these
cases, provisions of Article 22, Appendix T, and Tables applicable
shall apply. This section shall not, however, supersede the
provisions outlined in the Salem Fire Prevention Regulations, Chapter
148, MGL, or 527 Code of Massachusetts Regulations. All permits for
fire code use and/or occupancy shall apply for the entire structure;
fire alarm and/or smoke detector installation shall apply to the
entire structure based upon current requirements as per Laws and/or
Codes, but the existing structure may comply with regulations
applicable for existing structures.
Notice: Sub-contractors may also be required to file individual
applications for a Fire Department Certificate of Approval
for the area of their work. Such sub-contractors shall file
an Application to Install with the Fire prevention Bureau
prior to commencing any work for those areas applicable.
