Dear Mayor Driscoll,
I purchased the house at 4 Parker Court,Salem.A title search on the property showed that the
house encroached into the public street.The house was built in the late 1800s and apparently no
one noticed this encroachment prior to now.There are only three houses on the street so my
guess is the street was a private way when the house was built,in which case the landowner
owns to the middle of the street,therefore the encroachment began when the street became a
public way.My attorney has advised the only way to resolve the issue is for the city to grant an
easement of approximately 154 square feet. I would very much appreciate it if you could put
forth a request to the city council seeking the granting of this easement.
I have attached a plan of land and a draft easement grant for the property.

I am writing to complain about the front
steps being constructed by my neighbors Randy
and Kris Amos , 4 Parker Court, Salem, MA.
Originally they had 2 or 3 steps leading
to the front door, these steps were the width
of the doorway. Now they have redesigned the
steps with a landing which comes out 412 feet
on city land. The new landing and steps are
about 7 feet long.
The size of these steps is very important
to me because they are directly across from my
driveway. The width and length of these new
steps is making it virtually impossible for me
to turn into my driveway.

I began to re-construct the front steps on my house in
mid-March . I then received a letter from the city asking me to
"cease and desist" construction , because the city had reason to
believe our house rests on city property. This is absolutely true ,
( please see print enclosed) but note that our house is almost
175 years old , much older than current building codes .
I contacted the city building inspector who told me this is
a fairly common problem in Salem. He mentioned the fact that we
may be able to lease this property for 99 years for $1 .00 , and
suggested we contact you for further assistance.

Dear Mr, Amos, ,
Despite repeated attempts by this office to resolve Building and Zoning code
violations at your property, located at(4 Parker_- Court; you have failed to take
the appropriate action.
1. You have failed to obtain a Building permit to—alter the front steps at this
location.
2. You have further encroached on City owned land by expanding the front-. ingress
to this property.
With the Winter season approaching and my concern for the accessability of
Emergency vehicles to this area, you are ordered, within seven (7) days of your
receipt of this notice, to meet with the Director of Public Services,
Mr. Paul S. Niman, to resolve the matter of encroachment, and following this -
meeting, to make application for the required Building permit from this office.
Failure on your part to comply with this order will be met with the filing
of the appropriate legal action against you.
Violations of Massachusetts General Laws, specificly the Massachusetts
State Building Code, is a Criminal offense and not a matter to be taken lightly.

Dear Mr. Usovicz :
I am writing to you regarding my property which is located
at 4 Parker Court in Salem Massachusetts .
I began to re-construct the front steps on my house in
mid-March . I then received a letter from the city asking me to
"cease and desist" construction , because the city had reason to
i believe our house rests on city property. This is absolutely true ,
( please see print enclosed) but note that our house is almost
a 175 years old , much older than current building codes .
I contacted the city building inspector who told me this is
a fairly common problem in Salem. He mentioned the fact that we
may be able to lease this property for 99 years for $1 .00 , and
suggested we contact you for further assistance.
Please contact me as soon as possible concerning this matter .
I am home after 6 :00 p .m. , or feel free to contact my wife at her
work from 9 :00 to 5 :00 . Her number at work is 927-1060 ext . 105 .
