Wooden decks were recently removed from the second and third floor levels at the rear of 22-24
Park Street. These decks were not part of the required egress. Each deck was served by a
dedicated access door from the interior of the building. The access doors remain in place—each
blocked by a single 2x4. This condition is unsafe and must be mitigated.
The basic work described in Building Permit B-14-957 has been completed,but additional
construction is needed to close-out this project. The remaining doorways must be in-filled by
permanent wall construction, including insulation, exterior weather proofing, etc. Additionally,
beam pockets in the exterior brick wall,were left vacant by the removal of deck framing and must
be repaired and made weather-tight.
Please submit your action plan and timeline—in writing- to the Salem Building Department no
later than June 25, 2014.
Failure to resolve the issues cited above will be construed as non-compliance and may result in the issue of
Municipal Tickets and Fines, as well as further enforcement actions.
If you feel you are aggrieved by this order, you have the right to appeal to the Massachusetts Board of Building
Regulations and Standards (BBRS) at One Ashburton Place/Boston/MA.

Dear Owner,
Yesterday, I was asked by the Community Impact Team to look at the first floor apartment of 24 Park
Street. The concern was that more than three unrelated individuals were living there.Your first floor
tenant invited us in and we were able to see the condition of the unit. I called the Health Department at
that point to have them look at the Sanitary concerns. Their findings will be handled in a separate
correspondence. The apartment did not have any working smoke detectors nor carbon monoxide
detectors. Additionally, the front bedroom wall is open to the outside. The overall condition of the unit
is poor. I am removing the Occupancy permit for unit#1 and I have caused it to be secured. A new
Occupancy permit will be issued after permits are pulled and Inspections are completed
The exterior porches on the rear of the property need to have all items stored on them removed. The
porches need to be repaired and or replaced by a licensed contractor. Failure to address these items
will result in Municipal Code tickets and further enforcement activities.

Dear Owner:
On Friday, March 14, I received and investigated a complaint concerning bricks that had
fallen from your building located at 24 Park Street. Upon arrival, several bricks were on
the ground in the paved area to the right side of the building. Looking up at the top of the
building, the parapet wall showed missing bricks and signs of water infiltration and
subsequent bulging as a result of freeze-thaw cycles. At this point, I determined your
building to be an "unsafe structure" as defined in the Mass State Building Code 780
CMR, Section 121. You were notified by Fire Dispatch of this condition:
Work must be done to correct this unsafe condition. The work must be supervised by a
Licensed Construction Supervisor and /or Mass Registered Engineer. A building permit is
necessary for the repair to be done.
If you have any questions, please contact this office immediately.
If you feel you are aggrieved by this order, your appeal is to the Board of Building
Regulations and Standards in Boston.

Paragraph 2, your Notice Of Complaint Hearing
October 27th, and the Complaint Hearing with Ms .
Farmer , Clerk Magistrate held on November 17th :
I came into the Building Department this
morning, met with Mr . Kevin Goggin, Assistant
Building Inspector , and re-checked the Building
File and the information I received therein .
According to at least two City Department ' s
records, 22/24 Park Street and 23 Dow Street
have been recognized as a four unit building
for some number of years .
I purchased this property in July 1996 .
Before purchasing this building I came into
the City Building Department and requested
to see the Building File .

The only paperwork that was in the File were
two letters from the Health Departed dated
September 23rd and October 07th, 1986 . These
letters were signed by V. Moustakis, and both
letters refer to the building as a four unit
apartment building .

Inspector , Electrical Inspector and Fire
Prevention . ( See attached Health Department
letters )
I assumed that because there were no follow up
correspondences, any violations that might have
existed had been corrected .
I asked if there was any additional information
on the property, and the person on duty at the
desk suggested that I check with the City
Assessors Office .
At the Assessors Office they explained that
they have been assessing and taxing this property
as a four unit building since at least August
06th, 1973 .
They stated they suspect that they have been
taxing this property as a four unit long before
this date but could not confirm such because
they do not keep records before 1973 .
( See attached City Assessors Building Record )
In addition, just prior to purchasing this
property, the Salem Fire Prevention Bureau issued
a Certificate Of Compliance to the seller . This
Certificate clearly states the building has four
units . ( See attached Certificate Of Compliance )
After reviewing and relying on this information,
I was satisfied that the property was a legal
four unit building and concluded the purchase .

First please understand that the property located at
22-24 Park Street is a legal three ( 3 ) family dwelling, it
has never been legally changed to a four ( 4 ) family
dwelling. Proper permits to increase the dwelling units
were never applied for , or issued . In order to increase
the dwelling units in a structure that is a legal
non-conforming structure per City of Salem Zoning
Ordinance , you must apply to the City of Salem Board of
Appeals for a Special Permit . At which time if permission
is granted , an inspection of the property and a
Certificate of Occupancy will be issued if the unit
conforms to all City and State codes .
Please understand it does not matter that the Health,
Fire and Assessors office were mistaken the property to be
a legal four ( 4 ) family dwelling, they can only assume it
is a legal structure , for them to research every structure
they inspect is impossible . It is the responsibility of
my office to research the legal status of a building when
the legality is in question .
I will not cancel the hearing scheduled for January
16 , 1995 at 11 : 30 unless or until you file proper papers
with the City of Salem Board of Appeals to legalize a
fourth unit .

Per the request of a tenant residing at 24 Park
Street , I conducted an inspection and the following
violations were found ;
1 . My records indicate three legal apartments at this
address., you have a fourth illegal apartment . You must
make application to the City of Salem Board of Appeals to
legalize said apartment or discontinue its illegal use .
2 . Second means of egress at rear of building must be made
safe by removing all debris in hallway , and by removing
2x4 wood blocking from the exterior door .
3 . Ballasters must be replaced on porch railings , 2nd and
3rd floors .
4 . Repairs must be made to roof soffitt .
5 . Electrical must be repaired in basement by a licensed
electrician .
6 . Repair bell wire .
7 . Light must be installed at basement stairs .
S . Install handrail at basement stairs .
9 . Install smoke detectors were required by Fire
Department .
10 . Apartment on Dow Street side ;
1 . Missing door threshold .
2 . Vanity in bathroom loose .

may be entitled to hold back your rent payments.You can do this without being evicted if:
A, You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger

On recent inspection of the above mentioned property
with tenant Warren Mayer and Senior Sanitarian Virginia
Moustakis of the Board of Health, plumbing and gas
violations were found.
1 . Water closet flange needs to be repaired .
2 . Waste to all fixtures need to be trapped and vented.
3 . Boston Gas also found a gas leak in basement and
locked off gas meter .
All work must be done by a licensed plumber and
proper permits must be taken out . All work must also be
completed in a timely manner .

Street , I conducted an inspection and the following
violations were found;
1 . My records indicate three legal apartments at this
address , you have a fourth illegal apartment . You must
make application to the City of Salem Board of Appeals to
legalize said apartment or discontinue its illegal use .
2 . Second means of egress at rear of building must be made
safe by removing all debris in hallway, and by removing
2x4 wood blocking from the exterior door .
3 . Ballasters must be replaced on porch railings , 2nd and
3rd floors .
4 . Repairs must be made to roof soffitt .
5 . Electrical must be repaired in basement by a licensed
electrician.
6 . Repair bell wire .
7 . Light must be installed at basement stairs .
8 . Install handrail at basement stairs .
9 . Install smoke detectors were required by Fire
Department .

1 . Missing door threshold.
2 . Vanity in bathroom loose .
3 . Shower missing drain screen.

Legal Remedies for.Tenants of
Residential Housing
The following is a brief summary of some of the legal remedies tenants may use in order to get housing code violations
corrected:
L Rent W;lhholdine(Massachusetts General Laws,Chapter 239,section 8A):If Code Violations Are Not Being Corrected you
may be entitled to hold back your rent payments.You can do this without being evicted if:
A. You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger.
or materially impair your health or safety and that your landlord knew about the violations before you were behind in--
your rent.
B. You:did not cause the violations and they can be repaired while you continue to live in the building.
C.'You'are prepared to pay any portion of the rentiiito court if a judge order:you to pay it(For this,it is best to put the,
rent money aside in a safe place.)
2 RRMair and Dedncf(Massachusetts General Laws,Chapter 111,section 127L):The law sometimes allows you to use your rent
money'to.'make.the repairs yourself.If your local code enforcement agency certifies that there are code violations which
endanger or materially impair your health,safety„orwell-being,and your landlord has received written notice of the violations;
you maybe able to use this remedy.If the owner fails to begin necessary.repairs(or to enter into a written contract to have theifr
made)within five days after notice or to compiet repairs'.within 14 days after notice,you can use up to four months'rent m any
year to make the repairs. -- -
3 Reta_lInt=Rent Increases or Evictions Pmbibited(Massachusetts General Laws,Chapter 186,section 18,and Chapter 239
section 2A):Tlteowner may not increase your rent or evict you in retaliation for making a complaint to your local code
enforcement agency about code violations.If the owner raises your rent to tries to evict within six months after-you.have made
the complaint,%he or she.will-have to-showa good reason for the increase or eviction which is unrelated to your complaint You .
may be ableto sue the landlord for damages of he or she tries this.
4. Rent Receivership(Massachusetts General Laws,Chapter 11,section 127 C-H):The occupants and/or the Board of Health may
petition the District or Superior Court to allow rent to be paid into court rather than to the owner-The court may then appoint a
"receiver” who may spend as much of the rent money as is needed to correct the violation.The receiver is not subject to a
spending limitation of four months'rent
5. Breach of Warranty of Habitahility: You may be entitled to sue your landlord to have all or some of your rent returned if your.-
dwelling unit does not meet minimum standards of habitability,

violation of the consumer protection act and regulations, for which you may sue an owner.

that must be removed to provide for means of egress to be free and clear
of all obstructions at all times (Fire Prevention please note)
Wiring must be investigated and repaired in the upper left hand side of
back door (entry) leading to exterior.
Must repair and affix light fixture to wall on the 2nd floor.
Based upon said inspection, you are hereby ordered to take the following
action within 36 hours of receipt of this order:
Must have an operable smoke detector on the 3rd Floor Back hallway at
all times. (Fire Prevention please note)

on May 06th I met with John Keenan, Attorney for the
City, Kevin Goggin, Assistant Building Inspector, and
Virginia Moustakis, Senior Sanitarian, Board Of Health
to discuss the apartment at 23 Dow Street .
Also in attendance at this meeting was my attorney,
Christopher Hopkins .
At the time of this meeting I was still trying to determine
what action to take with respect to the Salem Board Of
Appeals ruling regarding this unit.
In deciding whether or not to Appeal the
"Decision On The Partition Of Stacy John Thomas
For A Special Permit and Variance At 22-24 Park
Street (R-3 ) " by the Salem Board Of Appeals, I
found the following additional information:
1 . At the City Of Salem Engineering Department,
on Page 25, Salem MA, New Sheet, April 1915,
of the Insurance Maps Of Salem, MA published
by the Sanborn Map Company, I have identified
23 Dow Street as actually being 33 Dow Street,
a residential unit in existence since the
original construction of the building . ( See
attached Exhibit 4 : 1 )

In my February 16th memorandum I pointed out
that a number of Salem City Agencies believed
this property to be four ( 4 ) units . I think
this was the case because the property has
always been four ( 4 ) units .
2 . To corroborate the findings at the Engineering
Department I referenced R.L . Polk & Co. 's Salem
City Directory.
I found that Polk ' s Survey shows 22/24 Park
Street and 33 Dow Street as a four ( 4 ) unit
property. (See attached Exhibit # : 2 thru 2c)
3 . I tried contacting R.L . Polk & Co. Publishers
with no success . However, Assistant
Postmaster/Salem, MA, John Marshall informed
me that the Post Office has recognized 33 Dow
Street as a Residential Address since early
1940, as far back as they keep records on hand .
(See attached Exhibit 0 : 3 )
In addition, the Reference Department of the
Salem Public Library advised me that the
information contained within the Polk City
Directory is at least twelve to eighteen months
in arrears . That is, information in any given
Polk book/directory is at least one year old .
I believe that I have confirmed that the property
has always been a four ( 4 ) unit building.
with the information forwarded in my February 16th
memorandum, I also believe that I Do Not/Did Not need
to file an Anneal to continue renting the Dow Street
Unit because I Did not need the Boards permission,
a Special Permit, or a Variance, in the first place .
