We met with Mr. Marcello Trolio and he agreed to construct a conforming egress stair within 30 days. We issued a Building Permit (copy enclosed) on November 2, 2009. The stair that was constructed, however, does not meet the building code. Our position is that Mr. Trolio has breached his agreement with the Building Department and the building at 23 Park Street remains in violation of the Building Code for Unsafe Egress as defined in 780CMR 120.5.4.
