Dear Attorney Hopkins:
As you are aware the above captioned matter(s) are scheduled for next Friday. It
is my understanding that tenants in illegal apartment (Dow Street#1) have moved out.
The health department has received information that there may be a new tenant there.
This would be a flagrant violation of the code. Please address with Mr. Thomas.
It was also my understanding that the second floor tenants (22-24 Park, 2ad Fl)
would be out by March 28h. Please update. The tenants are still reporting problems to
the Health Department.
Each of the three existing apartments need certificates of fitness. Please have Mr.
Thomas contact both the Health Department (Ginny Moustakis 74 1-1800) and Building
Inspector Kevin Goggin 745-9595) to re-inspect the premises next week prior to our
court date.
Lastly, I have also enclosed the final receipt form The Clipper Ship Inn for
$373.00 for the time the Health Department had to put up the tenants because of no heat
in their apartment. Please address this with your client as well.

DECISION ON THE PETITION_ OF_STACY JOHN THOMAS FOR A SPECIAL PERMIT AND
VARIANCE AT-22-24 PARK STREET (;R-3)
A hearing on this petition was held February 18, 1998 with the following
Board Members present: Nina Cohen, Chairwoman; Richard Dionne, Paul
Valaskagis and Albert Hill. Notice of the hearing was sent to abutters and
others and notices of the hearing were properly published in the Salem
Evening News in accordance with Massachusetts General Laws Chapter 40A.
Petitioner, owner of the property, is requesting a Special Permit to allow
the expansion of a nonconforming three (3) family dwelling to a four (4)
unit dwelling and a Variance from parking requirements for the property
located at 22-24 Park Street. The property is located in a R3 district.
The provision of the Salem Zoning Ordinance which is applicable to this
request for a Special Permit is section 5-3(j ) , which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance, the
Board of Appeal may, in accordance with the procedure and conditions set
forth in Section 8-6 and 9-4, grant Special Permits for alterations and
reconstruction of nonconforming structures, and for changes, enlargement,
extension or expansion of nonconforming lots, land, structures, and uses,
provided, however, that such change, extension, enlargement or expansion
shall not be substantially more detrimental than the existing nonconforming
use to the neighborhood.
.n more general terms , this Board is, when reviewing Special Permit
requests, guided by the rule that a Special Permit request may be granted
upon a finding by the Board that the grant of the Special Permit will
promote the public health, safety, convenience and welfare of the City's
inhabitants.
The Variance which has been requested may be granted upon a finding of the
Board that:
A. Special conditions and circumstances exist which especially affect the
land, building or structure involved and which are not generally
affecting other lands, buildings or structures in the same district.
B. Literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship, financial or otherwise, to the
petitioner.

C. Desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented,
at the hearing, makes the following findings of fact:
1 . The Petitioner did not submit a scaled drawing for the property.
2 . Jean Martin of 32 Park Street, Salem, Mass. spoke in opposition to the
petition.
On the basis of the above findings of fact, and on the evidence presented
at the hearing, the Board of Appeal concludes as follows:
1 . The Special Permit and Variance cannot be granted without substantial
detriment to the public good or without nullifying and substantially
derogating from the intent of the district or the purpose of the Ordinance.
2 . The granting of the Special Permit and Variance requested will not be in
hara:onv with the neighborhood and will not promote the public health,
safety, convenience or welfare of the City's inhabitants .
Therefore, the Zoning Board of Appeal voted unanimously, 4-0, against the
granting of the Special Permit and Variance requested. Having failed to
garner the four affirmative votes required to pass, the motion to grant
fails and the petition for a Special Permit and Variance is denied.

On Friday,'February 20, 1998,Mr. Thomas was arraigned in Salem District Court
regarding violations of the state sanitary code.. Mr:,Thomas did appear with his attorney,
Christopher Hopkins. The matter is now scheduled for a Pre Trial Conference on April
3, 1998 which is the same day the hearing on the illegal apartment complaint was
previously rescheduled to.
Mr. Stacy has reached agreements with both the two men in the undersized
("illegal") and the minister to move out by February 28th and March 28th respectively.
As expected, Mr. Thomas' appeal to have the 169 square foot apartment approved as a
fourth unit was denied. I did advise of his right to appeal. He informed me that he did
not plan on appealing. His plan is tD either knocl down the wall and »hire entire first
floor one apartment or simply let the other first floor apartment use this space for
additional storage.
I informed Mr. Stacy that he needs to get permits for work to be done and needs a
certificate of fitness on the upstairs apartment before renting out. Ideally, any pending
health and/or building code issues can be resolved prior to April 3, 1998. We should
plan on inspecting a final time before that date.
Lastly; Joanne if you have a bill.on the second time we put up the tenants at
Clippef Ship,'please forward.and I will address with Mr. Thomas and his attorney.

First please understand that the property located at
22-24 Park Street is a legal three (3 ) family dwelling, it
has never been legally changed to a four ( 4 ) family
dwelling. Proper permits to increase the dwelling units
were never applied for, or issued . In order to increase
the dwelling units in a structure that is a legal
non-conforming structure per City of Salem Zoning
Ordinance , you must apply to the City of Salem Board of
Appeals for a Special Permit . At which time if permission
is granted, an inspection of the property and a
Certificate of Occupancy will be issued if the unit
conforms to all City and State codes .
Please understand it does not matter that the Health,
Fire and Assessors office were mistaken the property to be
a legal four ( 4 ) family dwelling, they can only assume it
is a legal structure, for them to research every structure
they inspect is impossible . It is the responsibility of
my office to research the legal status of a building when
the legality is in question .
I will not cancel the hearing scheduled for January
16 , 1998 at 11 : 30 unless or until you file proper papers
with the City of Salem Board of Appeals to legalize a
fourth unit .

I would like to extend my deepest sympathies during
your time of sorrow.
With respect to your letter dated September 23rd;
Paragraph 2, your Notice Of Complaint Hearing
October 27th, and the Complaint Hearing with Ms .
Farmer, Clerk Magistrate held on November 17th :
I came into the Building Department this
morning, met with Mr . Kevin Goggin, Assistant
Building Inspector, and re-checked the Building
File and the information I received therein .
According to at least two City Department 's
records, 22/24 Park Street and 23 Dow Street
have been recognized as a four unit building
for some number of years .
I purchased this property in July 1996 .
Before purchasing this building I came into
the City Building Department and requested
to see the Building File .

The only paperwork that was in the File were
two letters from the Health Departed dated
September 23rd and October 07th, 1986 . These
letters were signed by V. Moustakis, and both
letters refer to the building as a four unit
apartment building .
These letters were also copied to the Building
Inspector, Electrical Inspector and Fire
Prevention . ( See attached Health Department
letters )
I assumed that because there were no follow up
correspondences, any violations that might have
existed had been corrected .
I asked if there was any additional information
on the property, and the person on duty at the
desk suggested that I check with the City
Assessors Office .
At the Assessors Office they explained that
they have been assessing and taxing this property
as a four unit building since at least August
06th, 1973 .
They stated they suspect that they have been
taxing this property as a four unit long before
this date but could not confirm such because
they do not keep rer,ords before 1973 .
( See attached City Assessors Building Record )
In addition, just prior to purchasing this
property, the Salem Fire Prevention Bureau issued
a Certificate Of Compliance to the seller . This
Certificate clearly states the building has four
units . ( See attached Certificate Of Compliance )
After reviewing and relying on this information,
I was satisfied that the property was a legal
four unit building and concluded the purchase .

In accordance with Chapter III, Sections 127A and 127B of the Massachusetts General Laws, 105 CMR 400.00;
State Sanitary Code, Chapter I: General Administrative Procedures and 105 CMR 410.00: State Sanitary Code,
Chapter It: Minimum Standards of Fitness for Human Habitation, an inspection was conducted of the property
located at 22 Park Street Apt.#1 occupied by Mrs. Bautista conducted by Virginia Moustakis, Senior
Sanitarian and Joanne Scott, Health Agent on Thursday, November 13, 1997 at 1:00 P.M..
Notice: If this rental unit is occupied by a child or children under the age of 6 years, it is the property owner's
responsibility to ensure that this unit complies fully with 105 CMR 460.000: Regulations for Lead Poisoning
Prevention and Control. For further information or to request an inspection, contact the Salem Health
Department at 741-1800.
You are hereby ORDERED to make a good-faith effort to correct the violations listed on the enclosed inspection
report.
Failure on your part to comply within the time specified on the enclosed inspection report will result in a
complaint being sought against you in Salem District Court. Time for compliance begins with receipt of this
Order.
Should you be aggrieved by this Order, you have the right to request a hearing before the Board of Health. A
request for said hearing must be received in writing in the office of the Board of Health within 7 days of receipt of
this Order. At said hearing, you will be given an opportunity to be heard and to present witness and documentary
evidence as to why this Order should be modified or withdrawn. You may be represented by an attorney. Please
also be informed that you have the right to inspect and obtain copies of all relevant inspection or investigation
reports, orders and other documentary information in the possession of this Board, and that any adverse party
has the right to be present at the hearing.

Legal Remedies for Tertwttts of
Residential Housing
The following is a brief summary of some of the legal remedies tenants may use in order to get housing code violations
corrected:
L Renew hholdine(Massachusetts General Laws,Chapter 239,section 8A):If Code Violations Are Not Being Corrected you
may be entitled to hold back your rent payments.You can do this without being evicted if:
A. You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger.
or materially impair your health or safety and that your landlord knew about the violations before you were behind in,
your rent.
B. You did not cause the violations and they'can besepaired while you continue to live in the building. . .
C. You are prepared to pay any portion of the rent-into court if a judge orders you to pay it.(For this,itis best to put the,
rent money aside in a safe place.).__.- _
2; EW it nd 2 m (Massachusetts General Laws,Chapter 111,section 127L):The law sometimes allows you to use your rent
money to:make the repairs yourself.If your local code enforcement agency certifies that there are code violations.which
endanger.or materially impair your health,safety,.or welt-being,and your landlord has received written notice of the violations;•

3: R aliatory Rent Increases or Evictions Prohibited(Massachusetts General Laws,Chapter 186,section 18,and Chapter 239,:
section 2A):-The owner may not-increase your rent or evict you in retaliation for making a complaint to your local code
