Dear Owner. ,
This letter is an addendum to the agreement regarding the demolition of the garage at the above
mentioned property. The fencing will be installed along the left side of the property and will turn the
corner and connect to the fence at the rear of the property. This will require the removal of the tree.
The curb cut modifications to make the driveway work where the garage is being removed will be
approved by this office.

Right of Entry Agreement
Grantor and Grantee: For purposes of this Agreement, the parties to this agreement are Homeward
Bound L.L.C, acting through its manager Nancy Moore, 59 Lexington Street, Woburn Ma. 01801,
Grantor, and the City of Salem, Massachusetts, Grantee, acting by and through its Building
Commissioner Thomas St. Pierre.
Legal Description of Subject Property: 39-41 Prince Street, Salem, Massachusetts
A. Recitals
1. The City has contracted to remove the structure located at 38-40 Patmer Street.
2. A garage abutting and in direct contact with 38-40 Palmer is owned by the adjacent property ofthe
Grantor, 39-41 Prince Street.
3. The garage in question is in questionable condition and the Grantor wishes it to be demolished.
4. Demolishing the garage structure at 39-41 Prince Street is essential to the efficient and cost effective
demolition of 38-40 Palmer Street.
B. Access
1. Grantor hereby grants to Grantee and their representatives access to the subject property for the
purpose of demolishing the 38-40 palmer Street structure as well as Grantor's garage which directly
abutting the 38-40 Palmer Street structure.
C. Life of Agreement
This agreement is temporary. It shall commence on the date of signing of this agreement
and shall expire automatically when the pathway is fully installed, but later than 20 days from the
signing of this agreement.
D. Successors and Assigns
This agreement is intended to protect the value and desirability of the subject property and to benefit all
citizens of Salem. It shall run with the land and during the life
of the agreement be binding on all parties having or acquiring any right, title, interest, or
any part thereof, of the subject property, including the grantor,heirs, successors and
assigns. This agreement shall inure to the benefit of each present or future successor
in interest of the subject property or any part thereof, or interest therein,and to the
benefit of the citizens of Salem.
E. Indemnification
The Grantee hereby agrees to indemnify, defend, assume all liability for and hold harmless the Grantors
from all actions, claims, suits, penalties, obligations, liabilities, damages to property, environmental
claims or injuries to persons,which may be caused by Grantees' activities pursuant to this Right of
Entry or arising out of or in connection with such activities, whether such activities or performance
therof is by the Grantee or anyone directly or indirectly employed or under contract with them, and
whether such damage or claim shall accrue or be discovered before or after the termination of this Right

F. Compliance with Laws/Permits
The Grantee shall. in all activities undertaken pursuant to this Right of Entry, comply and cause its
comractors. aeems and employees to comply with all federal, state and local laws, statutes, orders,
ordinances, rules, regulations, plans, policies and decrees. Without limiting the generality of the
foregoing, Grantee, at its sole cost and expense, shall obtain any and all permits which may be required
by any law, regulation or ordinance for any activities Grantee desires to conduct or have conducted
pursuant to this Right of Entre.
G. Revocable Licenses and Termination
The right of entry granted herein is revocable and may be terminated by the Grantor in accordance with
the terms of this Agreement. This Right of Entry may be terminated at any time by either party upon one
(1) business day's prior notice in writing to be served upon the other party. In cases of an emergency or
a breach of this Agreement by the Grantee, this Right of Entry may be terminated by the Grantor
immediately.
H. Restoration of the Property
Upon the termination or revocation of this Right of Entry, the Grantees shall, at their own cost and
expense, shall have completed the demolition of the Grantor's garage and removed its concrete slab,
restored the grade of the property to its original grade,removed all debris, obtained all permits and
installed a fence to define the lot line between the two buildings at 39-41 Prince Street and 38-40 Palmer
Street.
I. Counterparts
This Right of Entry may be executed in one or more counterparts, each of which shall be deemed an
original but all of which together shall constitute one and the same instrument.
IN WITNESS WHEREOF, the Parties hereto have executed this Right of Entry on this I a day of
