1. The portions of the exterior wall running parallel to the
rear and side property lines will be constructed to one hour
fire rating. This will be accomplished by using 5/8"
firecode on the interior wall and a 5/8" firecode over the
framing and under the clapboard. Additionally, the one
opening for fresh air supply to the furnace will be fitted
with a fire damper.
2. The front walk will be widened to 5 feet and concrete tire
stops will be installed at those parking spaces located in
front of the building.
3. There will be a partition at the top of the stairs to the
attic. The attic will be used for storage only.
4. All drain piping will be cast iron.
5. Signs will be installed on the rest room doors to indicate
"Employees Only. "
6. Stamped structural drawings and calculations will be
forwarded when available from the manufacturer for the
canopy.

A hearing on this petition was held September 30, 1987 with the following Board
Members present: James Hacker, Chairman; Messrs. , Bencal, Fleming, Luzinski and
Strout. Notice of the hearing was sent to abutters and others and notices of the
hearing were properly published in the Salem Evening News in accordance with
Massachusetts General Law Chapter 40A.
Petitioner, owner of the property, is requesting variances from density regulations,
Section VII Table II to allow removal of existing building, island and tanks to
allow construction of new facility, use will remain the same. Property is located
in a B-2 district.
The Variance which has been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings and structures in the same district;
b. literal enforcment of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner;
c. desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent or the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented and after
viewing the plans, makes the following findings of fact:
1 . Plan, as presented, is an improved and better use of the land;
2. Plan as presented provides a better and less hazardous traffic pattern;
3. Uses would remain substantially the same;
4. Plan as submitted provides for more parking than what currently exists;
5• There was no opposition.
On the basis of the above findings of fact, and on the evidence presented, the
Board of Appeal concludes as follows:
1 . Conditions exist which especially affect the subject property, but not
the district generally;
2. Literal enforcement of the Ordinance would work a substantial hardship
. on the petitioner;
3. The relief requested can be granted without detriment to the public good and
without nullifying or derogating from the district or the Ordinance.

Therefore, the Zoning Board of Appeal voted unanimously; 5-0, to grant the

3. A demolition permit be obtained from the Inspector of Buildings;
4. A building permit for all construction be obtained prior to commencement
of work;
5. All construction be in accordance with plans submitted;
_. 6. Eleven (11 ) parking spaces be maintained as shown on plan submitted;
7• A Certificate of Use and Occupancy be obtained prior to occupying
the new structure.

layout in the„�City of Salem, locally known as Paradise Road or Route A_ for the purpose
of4resurfacing existing commercial drives toro at # 10 Paradise Road-Bursaw Oil

No equipment trucks, etc. shall occupy any part of the travelled way except between
the hours of 8:00 A.M. and 4:30 P.M. from Monday through Friday. Weekend work is
permitted under the terms of this permit. Also, no work shall be allowed on the day
before or the day after a long weekend which involves a holiday without the permission
of the District Highway Engineer.
--It shall be the responsibility of the Grantee to contact the DistrictEngineer" regarding
the field location of any underground traffic control devices on this project.
Said drives shall be surfaced with Bituminous Concrete, Type I and shall be comprised
of a 3" Class I Bituminous Concrete Base Course and two (2) 11h” courses of Class I
Bituminous Concrete Pavement for a tot AI depth of 6" with a foundation of at least 6"
of compacted gravel . The finished surface shall butt into and not overlap the existing
highway grade at the road edge. All work shall be done in accordance with the
Commonwealth of Massachusetts Department of Public Works Standard Specifications for
Highways and Bridges.
The drives shall be so graded that no water shall be so graded that no water shall enter
the layout nor pond or collect thereon, including the roadway surface.
All disturbed areas, such as sidewalks, curbing, shoulder, grass plots, shall be .restored
to their original conditions.
The curb corners or radii may be painted at the time of installation. Said curb shall
be painted yellow only.
The curb shall be placed in conjunction with or immediately following completion of the
driveway surfacing —
The part of the drives located within the limits of the state highway shall be maintained
by the Grantee, at his own ekpense and to the satisfaction of the Engineer.

INSERT TO ACCOMPANY PERMIT " 5-19588
The Grantee shall be responsible for the hiring of police officers during the
entire time that work is being done within the State Highway Layout or as deemed
necessary by the District Highway Engineer.
The Grantee shall indemnify and save harmless the Commonwealth and its Department
of Public Works against all suits, claims of liability of every name and nature
arising at any time out of or in consequences of the acts of the Grantee and in
the performance of the work covered by this permit and/or failure to comply with
the terms and conditions of this permit whether by itself or its employment of
subcontractors. This permit is subject to the procurement of the necessary Town
Grant.
If it becomes necessary the Department shall place an Inspector on this project
and said Inspector will be paid for under a reimbursable by the Grantpe
Two way traffic shall be maintained at all times during this project.
At any time during the operation of this project it becomes necessary for the
Grantee to detour traffic it shall be his responsibility to notify the District
Highway Engineer in writing seventy-two (72) hours in advance of this detour.
The Grantee shall supply the District Highway Engineer with a plan showing the.
intended route of this detour along with the appropriate signing and the number
of Police Officers to be assigned to -this detour. The .Grantee= shall also state
the length of time said detour will be in existence and he shall have concurrence
from the area Police Chief regarding this detour.
All said detours are subject to review and concurrence by.the. District>Traffic
a
Engineer.
It shall be the responsibility of the Grantee to notify both this office
telephone number: 774-3190, ext. 15 , and the Area Maintenance Foreman (his location
is listed below) , forth-eight - (48) hours in advance of starting work on this project.
The Grantee shall also notify both parties when he has completed this project.
The Maintenance Foreman for this area is: David Rock

The Grantee shall place signs and cones for the protection of the workers and the
motoring public, in accordance with the Approved Safety Manual on Uniform Traffic
Control Devices, and the Work Zone Traffic Control Standards and Guidelines - USDOT -
FHWA, April, 1980 Edition.
When a snow or ice condition exists during the progress of this work, the Grantee
shall keep the highway well sanded to a point not less than 200 feet beyond the
limits of the barriers and signs.
The bound marked MHB shall not be removed or disturbed. If it becomes necessary to
remove and reset any highway bounds then the Grantee shall hire a registered
professional land surveyor to perform this work. It shall be the responsibility
of this land surveyor to submit to this office a statement in writing and a plan
containing his stamp and signature showing that said work has been performed.

Problems-
Contaminated soil was removed from tank excavation and is
stockpiled on site. DEQE has been notified. Extra tanks
not known to exist were found and removed under permit from
fire department. Water line was damaged, new stop has been
installed.

DECISION ON THE PETITION OF BURSAW REALTY TRUST FOR VARIANCES
AT 10 PARADISE ROAD (B-2)
A hearing on this petition was held September 30, 1987 with the following Board
Members present: James Hacker, Chairman; Messrs. , Bencal, Fleming, Luzinski and
Strout. Notice of the hearing was sent to abutters and others and notices of the
hearing_ were properly published in the Salem Evening News in accordance with
Massachusetts General Law Chapter 40A.
Petitioner, owner of the property, is requesting variances from density regulations,
Section VII Table II to allow removal of existing building, island and tanks to
allow construction of new facility, use will remain the same. Property is located
in a B-2 district.
The Variance which has been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings and structures in the same district;
b. literal enforcment of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner;
c. desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent or the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented and after
viewing the plans, makes the following findings of fact:
1 . Plan, as presented, is an improved and better use of the land;
2. Plan as presented provides a better and less hazardous traffic pattern;
3. Uses would remain substantially the same;
4. Plan as submitted provides for more parking than what currently exists;
5. There was no opposition.
On the basis of the above findings of fact, and on the evidence presented, the
Board of Appeal concludes as follows:
1 . Conditions exist which especially affect the subject property, but not
the district generally;
2. Literal enforcement of the Ordinance would work a substantial hardship
on the petitioner;
3. The relief requested can be granted without detriment to the public good and
without nullifying or derogating from the district or the Ordinance.

Therefore, the Zoning Board of Appeal voted unanimously; 5-0, to grant the
Variances requested, subject to the following conditions:
1 . Project comply with all requirements of the Salem Fire Prevention
Bureau;
2. Demolition of existing building and removal of tanks be in strict
accordance with all State and Local codes;
3. A demolition permit be obtained from the Inspector of Buildings;
4. A building permit for all construction be obtained prior to commencement
of work;
