Mr. Thomas St Pierre,
Upon inspection of the structure located at 38 Palmer St, the fire department views this
structure to be a safety hazard. In its present condition, it has structural issues causing it
to be unstable. There will be no interior firefighting in this building due to the potential
for injury to our firefighters. The bow in the brickwork is also a cause for concern for
those who may enter its collapse zone. This includes the sidewalk and street along the
rear of the building.
This structure is considered unsafe by this department and we urge you to take the
appropriate actions to remedy the situation.

Today I was called to the above rental property, owned by you, by the Salem Fire Department.
They had received a call from the tenant at 40 palmer who had a severe leak coming through the
ceiling. Also called were Salem Board of Health and Salem Electrical Department.A quick
Inspection of the unit, the large amount of water pooling on the roof and the fact that the wiring
was wet and the Fire Alarms had been silenced, caused me to Declare the Building"Unsafe"per
Mass State Building Code 780 CMR sections 116. . I asked the Electrical inspector,Mark
Rochon, to have power to the building cut. The Occupancy permit is revoked until such time as
repairs are made and Inspections are complete.All work must be performed by licensed
individuals with the exception of painting
91 A Massachussetts licensed structural engineer must evaluate the structural condition of the
building. In particular, the roof and parapef walls.Any repairs will require a licensed i
Construction Supervisor
#2 A licensed Electrician must secure a permit and check out the Electrical systems in the
building and repair or replace the Fire Alarm System.
#3 A licensed roofer must evaluate the unpermitted installation of the rubber roof and associated
flashings.
#4 The Board of Health must inspect each unit and issue a Certificate of Inspection for each unit.
If you feel you are aggrieved by this order, your appeal is to the Board of Buildings and
Regulations and Standards in Boston.

You requested that I inspect the Utility Roorn loaned at the rear of 38-40 Palmer Street and
assess its condition. Today, July 9, 1998, 1 met with you and reviewed the room.
DeSCi7 nttion
The utility room shares a common brick wall with 3$40 Palmer Street to the north, and a
common brick wall with .35-37 prince Street to the west. Its south and east walls are load bearing
brick exterior' walls, each at least tw'o wytlles thick, A boarded window and recessed entrance
door are located on the east wall. The room appears to have originally had it flat roof, but now
has a north to south sloping roof covered with asphalt shingles. The roofterminates at its lower
edge with a vertical board, that apparently formed a gutter.
Condition
/The roofguttel-is totally filled, to the point that tall grass and other vegetation is growing from it.
The gutter apparently no longer serves its purpose as serious leaks are obvious on the inside of
tile wall, and serious mortar and brick deterioration has occurred on the exterior,
The original that roofjoists have been repaired at least once where they enter the brick wall. The
later sloping rallers are not visible and their condition could not be determined, but should be
considered suspect.
The north brick wall has suffered from long-term moisture penetration, A small area of the outer
brick wythe has fallen off the wall, much of the mortar has deteriorated, and heavy moss growth is
evident in the mor tar joints, especially along the upper portion of the wall.

purpose of tearing down,cutting milities,tank removal and the leveling of the lot at the property to
at 38-40 Palmer Street. The Building ha been declared "unsafe" and is currently boarded up. A
Municipal lien will be placed on the property immediately after it is torn down.

This Department previously served you" in hand" a letter that revoked the occupancy of your property
and declared it to be "unsafe building". To date, we have not heard anything from you. The property
remains boarded up with the utilities cut. Per the authority of the Mass State Building Code 780
C.M.R. section 116.1 through sectionl 16.8 you are directed to begin to make repairs within 24 hours
of receipt of this notice. Failure to respond to this notice will result in Municipal Code Tickets and
further enforcement activities.
