Re: Illegal Hoist
Ms. Smith:
The Building Department has received reports that you are operating an exterior hoist
from the 3d floor of the Muilti-Family Building at 6 Palfrey Court.
You were previously informed,by the Salem Building Commissioner, that any work to
accommodate a`hoist' from the third floor of that building would require a building
permit*; and that the permit would be contingent upon a load bearing calculation and
detailed construction documents, satisfactory to the Building Department, from a
registered structural engineer. The permit would also be contingent upon the written
consent of other condo owners within the Building.
None of those items have been submitted to the Building Department, and no permit has
been issued.

SECTION 105 PERMITS
105.1 Required. It shall be unlawful to construct, reconstruct, alter, repair, remove or
demolish a building or structure; or to change the use or occupancy of a building or
structure; or to install or alter any equipment for which provision is made or the installation
of which is regulated by this code without first filing an application with the building
official and obtaining the required permit.

All use of the hoist must cease immediately and remain stopped until the Building
Department has been satisfied that proper construction permits have been applied for, and
issued to appropriately licensed personnel.No work may be undertaken without written
approval from the Salem Building Department. Before the hoist can be used, the
completed installation must be inspected and accepted by the Building Department.
You must contact the Building Department immediately upon receipt of this letter
to discuss your plan of action.
Failure to resolve the issues cited above will be construed as non-compliance and may
result in the issue of municipal tickets and fines as well as further enforcement actions.
If you feel you are aggrieved by this order, you have the right to appeal to the
Massachusetts Board of Building Regulations and Standards(BBRS) at One Ashburton
Place/Boston/MA.

Subject: Hoist- illegal activity
Clare,
I received a letter from the City of Salem regarding your hoist. Apparently you have been using it
illegally and a neighbor has a picture of it and reported it to the City of Salem. The noise was invasive to
them and thus they made the call to the City.
The letter,which I have scanned and attached here, was addressed to me by mistake. I will rectify that
on Monday and let them know that the letter needs to be sent to your father(as the owner) and to you(as
the tenant).
In good faith, Bernice and I said it would be OK to let the current hardware that you had already
installed without the consent of the Palfrey Court Condominium Association or the City to remain there
until a decision is made as to whether the Association agrees to its installation AND the proper permits
were given from the City.
You have used this hardware to put the hoist in, use it, and then take the hoist down. This is illegal.
Due to your illegal use of the hoist we insist that you remove the hardware and repair the resulting
damage to the building by Friday, January 8. As the City states in the letter, you are to cease all use
immediately.

Thank you for removing the Hoist and Bracket from the 3`d floor of the Muilti-Family Building at
6 Palfrey Court.
As we discussed, permission to install and use a `hoist' from the third floor of that building would
require:
1. Plans produced by an architect or structural engineer,and submitted to the Salem
Building Department.
2. A letter of consent from the condo association.
3. A Building Permit, issued by the Salem Building Department.
4. Installation by a Massachusetts Construction Supervisor License holder.
5. Final approval by the Salem Building Department.
