The petitioner is requesting Variances from lot area, lot coverage, parking, front, side and rear setback regulations to allow a division of land for the property located at 31-33 Osgood Street R-2. The Variances, which have been requested, may be granted upon a finding by this Board that: a. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structure involve. b. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioners. c. Petitioners, owners of the property, are requesting Variances from the residential density .regulations of Section VI, Table 1 , specifically, from minimum lot area,' ,,. . .lot area per dwelling unit, lot width. Petitioner also seeks variance from use . ' regulations Section V A 2, to allow use of the existing two family dwelling as well as the proposed single family dwelling. The Variances which have been requested may be granted upon a finding of the Board that: . a. . special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings or structures in the same district; . b. literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner; c. desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent fo the district or the purpose of the ordinance: The Board of Appeal, after careful consideration of the evidence presented, and. after viewing the plans, makes the following findings of fact: 1 . Most lots in the area are about 3500 sq.ft. ; 2. Said lot is about twice the size of the lots in the immediate area; 3. No major neighborhood opposition; -4. Mary Coughlin next door is willing to sell us an additional 10-1/2 feet to insure enough parking spaces . Our lot is 31-33 Osgood St. There are several houses in the neighborhood the same setup, so it would not be out of place for the area. I am not sure that you know, but Fred is fast becoming paralyzed in the legs and will soon be in a wheelchair, so we have to move somewhere in order to have him on ground level. I would rather not move from Salem as I can walk to work, church, etc. , and have lived here all my life, but if I have to I will go to New Hampshire. The two-family house we live in in front would help pay for the small cottage. The first floor in the two- family is only four small rooms and access into the bathroom would not accommodate a wheelchair, thus we would have to tear out the back of the house and remove the porches to make another room and bath and ramps . I did get an estimate for this and the cost would be such that it is not practical. Both Bob Gauthier and Jim Ballou have looked at it and said that it would be better to do what we want . We have one abutter who is opposing us on the grounds that he doesn' t want to have anything spoil his open view (our backyard) . We would be a good 30 feet from the property line dividing his yard and mine. Frannie, thanks for any help you might be able to offer, we will appreciate it very much. AYERS RE: 31 -33 OSGOOD STREET, SALEM, MA 01970 The Petitioner seeks a Variance to allow construction of a detached single family "cottage" dwelling as shown on the attached plans. The Petitioner seeks relief from the residential density regulations of Section VI, Table 1 , of the Zoning Ordi- nance. Specifically, the Petitioner seeks relief from the mini- mum lot area, minimum lot area per dwelling unit, and minimum lot width requirements. The Petitioner also seeks relief from the use regulations of Section V.A.2 in order to use the existing two-family dwelling in its present use, as well as the additional one-family cottage. As is shown on the attached plan of land, the Petitioners present lot consists of approximately 7,612 square feet, with 52 1 /2 foot frontage on Osgood Street, and is 145 feet deep. Lot B as shown on said Plan, is to be conveyed by Mary E. Coughlin to the Petitioner, said Lot B containing approximately 1, 466 square feet as shown on said Plan. The combined totals for Lot A and Lot B would be 63 feet wide, containing approximately 9, 135 square feet. The proposed new cottage structure would conform to all present . set back, sideline, and. rear yard regulations. The attached plans depict a parking layout for 6 parking spaces. The Petitioner intends no subdivision of the premises and intends the cottage to be owner occupied. Special conditions and circumstances exist which especially affect the land involved. Specifically, the existing two-family dwelling is located on the furthermost southwesterly portion of the premises. The Petitioner' s land has one of the largest open yard areas within the general neighborhood, therefore, the addi- tion of the proposed structure would not be inconsistent with the character of the neighborhood in general. AYERS RE: 31 -33 OSGOOD STREET, SALEM, MA 01970 The Petitioner seeks a Variance to allow construction of a detached single family "cottage" dwelling as shown on the attached plans. The Petitioner seeks relief from the residential density regulations of Section VI, Table 1 , of the Zoning ordi- nance. Specifically, the Petitioner seeks relief from the mini- mum lot area, minimum lot area per dwelling unit, and minimum lot width requirements. The Petitioner also seeks relief from the use regulations of Section V.A.2 in order to use the existing two-family dwelling in its present `use, as weil `as the additional one-family; cottage. As is shown on the attached plan of land, the Petitioners present lot consists of approximately 78612 square feet, with 52 1 /2 foot frontage on Osgood Street, and is 145 feet deep. Lot B as shown on said Plan, is to be conveyed by Mary E. Coughlin to the Petitioner, said Lot B containing approximately 11466 square feet as shown on said Plan. The combined totals for Lot A and . Lot B would be 63 feet wide, containing approximately 9,135 square feet. The proposed new cottage structure would conform to all present set back, sideline, and. rear yard regulations. The attached plans depict a parking layout for 6 parking spaces. The Petitioner intends no subdivision of the premises- and intends the cottage to be owner occupied. Special conditions and circumstances exist which especially affect the land involved. Specifically, the existing two-family dwelling is located on the furthermost southwesterly portion of the premises. The Petitioner' s land has one of the largest open yard areas within the general neighborhood, therefore, the addi- tion of the proposed structure :would not be inconsistent with the character of the neighborhood in general.
