MASS CLCRK'S OFFICE DECISION OF THE PETITION OF.ROBERT &_RACHEL LUTTS REQUESTING A VARIANCE FOR THE PROPERTY LOCATED AT 92 ORNE STREET•(R-2) A hearing on this petition was held April 16, 1997 with the following Board members present: Gary Barrett; Chairman, Nina Cohen, Joseph Ywuc, Arthur LeBrecque and Richard Dionne. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner, requests a Variance from side setback to construct a two car garage with family room above for the property located at 92 Orne Street (R-1) , The Variance which has been requested may be granted upon a finding of this Board that: 1. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other land, buildings, or structures in the same district. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner. 3. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogation from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful considerations the evidence presented at the hearing, makes the following findings of fact: 1. The petitioner was represented by Craig Bell, an architect. 2. The petitioner requests to construct a two car garage with family room above. 3. The petitioner also requested to withdraw the Special Permit without prejudice. Petitioner's motion to withdraw the Special Permit was granted by a unanimous vote by the Board. 4. There was no opposition to this petition. On the basis of the above findings of fact, and on the evidence presented at the hearings, the Board of Appeal concludes as follows: 1. Special conditions exist which especially affect the subject property and not the district in general. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substation hardship to the petitioner. 3. Desirable relief can be granted without substantial detriment to public good and without nullifying and substantially derogating from the intent of the district or purpose of the Ordinance. DECISION OF ROBERT & RACHEL LUTTS REQUESTING A VARIANCE FOR THE PROPERTY LOCATED AT 92 ORNE STREET page two On the basis of the above findings of fact, and on the evidence presented at the hearing, the Zoning Board of Appeal voted unanimously, 5-0 to grant the variance requested, subject to the following conditions: 1. Petitioner shall comply with all city and state statures, ordinances, codes and regulations . 2. All construction shall be done as per the plans and dimensions submitted and approved by the Building Inspector. 3. All requirements of the Salem Fire Department relative to smoke and safety shall be strictly adhered to. 4 . Exterior finishes of the new construction shall be in harmony with the existing structure. 5. Petitioner is to obtain a building permit prior to beginning any construction. 6. A Certificate of Occupancy is to be obtained. Back in August I spoke to you with my deep concern on the method in which you would connect the new framing with the old post and beam. Under Artical I , Section 113.7, I am allowed to ask for details or other engineering data that I need. I asked you for framing plan. and when you were in my office I asked about details on certain fastning points. You chose to do neither of the two. On Monday November 15, 1993 I did a priliminary rough inspection. I was appalled to find out that you had not supplied the contractor with any guidance ie ( drawings/framing ) or details of any of the connections. I found that the framing was left to sit directly on the stress skin panels which are not designed for this load application. I found the rear roof framing to also be questionable for the same reason as above. There was a microlam in the basement unsupported which also could not be found on the plans. I talked to the contractor about these problems and was told you were away. I find it very difficult to believe that you would not leave an associate in charge during your absence. Thus I was in no way obligated to provide an "associate in charge", as you state, in my absence, since my office was not contracted to do so. Early in the design process I had advised the Lutts of the possibility of their having to contract the services of a professional engineer, should the contractor or the building department deem it necessary. Unfortunately my recollection, and that of the contractor Larry Hudak, of our brief meeting over the counter with you in which the drawings were reviewed differs from your account. Larry Hudak did respond to a few questions you had on the roof framing. However I do not remember any request for "details or other engineering data" on your part. The teats were conducted in accordance with the ASTM Standard E 72-81. DESCRIPTION The two 4-by-8 ft. panels consisted of 3-1/2 in. urochane foam core bonded to surfaces of 7/16 in. vaferbaard sheathing. TEST PROCEDURES The tests were conducted in accordance vi.th ASTM Standard E 72-80, paragraph 12. The panel is simply supported horizontally on pipe rollers at the ends and load is applied at the quarter points of the 90 in. span. The load is generated by a 20-eon Enerpac hydraulic ram and transmitted to the two load points by a vide-flange steel I-beam. Center deflection is recorded by a Teclock dial gauge accurate to .001 in. attached to a 2x4 beam spanning the panel from support to support. The testing apparatus ix shown in Figure 1. The deflections recorded for the two panels at each increment of load are given in Table 1 , and graphically presented in Figure 2.
