Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening New in accordance with Massachusetts General Laws Chapter 40A. The petitioner is requesting a Variance from side yard setback and front yard setback to construct a two level front porch for the property located at 36-38 Ome Street located in an R-2 zone. The Variances, which have been requested, upon a finding Board that: a. Special conditions and circumstances exist which especially affect the land,building Or structure involved and which are not generally affecting other lands, buildings, and structure involve. b. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioners.. c. Desirable relief may be granted without substantial detriment to the public good and Without nullifying or substantially derogating from the intent of this district of the purpose of the Ordinance The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1. Petitioner is requesting a variance from side and front setbacks to rebuild a front two level porch. The proposed side setback is 2 ft and the required setback is 10 ft. The proposed front setback is 6 ft. and the required front setback is 15 ft. 2. Petitioners represented themselves at the hearing and presented plans showing the addition. 3. There was no opposition to the petition. Desirable relief can be granted without substantial detriment to the public good and Without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. Therefore,the Zoning Board of Appeal voted 4-0, to grant the Variances requested, subject to the following conditions; 1. Petitioner shall comply with all city and state statures, ordinances, codes and regulations. 2. All construction shall be done as per the plans and dimensions submitted. 3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 4. Petitioner shall obtain building permit prior to beginning any construction. 5. Exterior finishes of the new construction shall be in harmony with the existing structure. 6. A Certificate of Occupancy must be obtained. Shortly after Ms-Lesch moved into 36 Orne Street, she did go into the basement to reset the circuit breakers as one was tripped. To my knowledge,no breakers have been tripped since. I believe it was an overload situation which she has corrected. I am enclosing a copy of City of Boston web page in which it is stated, "Tenants need access if there are electrical over-current devices (circuit breakers),utility meters or oil tanks in the basement. Access does not always mean that a key must be provided." As this issue is part of the State Code, I believe it applies:to dwellings in Salem as well. There is access to the apartment utilities: the tenant notifies me and I let the tenant into the utilities area: Ms. Lesch's statement that I am not to be contacted after 8pm, and that I am frequently away for long periods of time is simply inaccurate. I have never asked not to be"contacted after 8pm". I did once send her a note stating a neighbor to call when I was away for 2 weeks in August, and the note did request her not to call the neighbor after 8 pm. Unfortunately, I meant to write not to call after'8pm"unless it was a true emergency",but rushed the letter and neglected to add the"true emergency"phrase. I "Frequently"and"long periods"are such subjective words it is hgd,to know how to respond: I am a stay-at- home mother of four,who does frequently go'out,but it's mostly picking up and dropping off children at destinations in Salem. These trips are almost always under an hour in duration. I always check my telephone answering messages when I return. If I am out of the house for more than 2 or so hours,I call into my telephone answering machine to retrieve any messages. I'm curious to know how closely Ms. Lesch has been tracking my days to come to the conclusion I'm"frequently away for long periods." Perhaps she sees me leave on one trip, and return from a second or even third trip later,not noticing I have been home in between. Also sometimes when I leave, my 19-year-old son, my 16-year-old daughter or a babysitter is still at the house. All are certainly capable of escorting her to the cellar utilities. Plus, Ms. Lesch has the name and telephone number of the neighbor who acts as my agent when I am away. I am unwilling to grant Ms. Lesch unfettered access as she has taken items from my cellar tool bench without permission. I am utterly dismayed by the conclusion that I am not complying with the law as stated in your letter of December 8. I am enclosing a copy of a Salem Board of Health finding from September 27, 2004 that the access I am providing is adequate. (I see your letter of December 8 was hand-delivered, and am guessing you rang my front doorbell to deliver it. I just discovered my front doorbell is not working. My back doorbell, and telephone are, though, so Ms. Lesch has alternate ways of reaching me.) I would like you to send an amended letter to Ms. Lesch, stating that if I am frequently away for long periods of time and if no one else is available to escort her to the utilities, then I would not be complying with the law.
