I am fully aware of when the. city of Salem adopted it 's zoning ordinance and the Mass. state building code. To repeat what I wrote to Mr. Dennedy "the shed would be in full compliance witl, �4e policies of the city of Salem", albeit those policies may have unofficial at the time. If you have problems with that statement then you should take whatever action you think is necessary. This small shed is not fastened to the ground, I am sure it can be moved, which should eliminate the problem. I know that you do not make the rules and regulations that you enforce. The interpretation is yours just as it was mine at the time the shed was placed on Mr. Dennedy 's property. I take umbrage with your statement that "I do not believe you had the legal right to permit the shed", that is something that would have to be determined by a court of law, not by you. I presume that you enforce all of the rules and regulations unilaterally in an impartial and unbiased manner. For example do you require a variance to be issued for fences, flagpoles, radio antenna masts, retaining walls which are customarily placed in front, side and rear yards? These are all defined as structures in Article 2 of the building code. Mr. Tremblay I have no wish to become your adversary. I have probably spoken to half of the building inspectors in this state and many of them disagree with each other regarding the interpretation of various sections of the code. As you have probably ascertained by now, you have a job where-in you are often damned if you do and damned if you don't. Dowhatyou think is right in this case. Good luck and best wishes. Richard T. The City of Salem also adopted and made major changes to the City of Salem Zoning Ordinances in 1965 . Both of these buildings and zoning codes were in effect while you were the Chief Building Inspector for the City of Salem, and these are still the building codes and zoning ordinance that exist today that the City of Salem is requesting the Building Department to enforce today, such as the City of Salem was asking you to enforce in 1981. I find no amendment in the Zoning Ordinance, or do I find an amendment in the State Building Code per City of Salem Council to change the status of storage sheds . Having a neighbor given his consent to infringe on a setback, does not give the Chief Building Inspector the right to approve an illegal location . As for the number of illegal sheds in the City of Salem the numbers are in the hundreds I 'm sure, but this would have not been the case if the Chief Building Inspector in the 1980 to 1985 would have been enforcing the City of Salem adopted codes and ordinances . The point of requiring Board of Appeals approval for a Variance and or Special Permit to infringe on setbacks a Massachusetts General Law Chapter 40A that is strictly enforced by the Building Department . Mr. McIntosh, I do not make the rules and regulations , I am here to enforce said rules and regulations to the best of my ability, and to the satisfaction of the Mayor and the city citizens . I do not believe you had the legal right to not issue permits for sheds or to allow some sheds to infringe on lot setbacks . I thank you for your interest in this matter, but still due feel that Mr . I am fully aware of when the city of Salem adopted it's zoning ordinance and the Mass. state building code. To repeat what I wrote to Mr. Dennedy "the shed would be in full compliance with 14e policies of the city of Salem", albeit those policies may have unofficial at the time. If you have problems with that statement then you should take whatever action you think is necessary. This small shed is not fastened to the ground, I am sure it can be moved, which should eliminate the problem. I know -that you do not make the rules and regulations that you enforce. The interpretation is yours just as it was mine at the time the shed was placed on Mr. Dennedy' s property. I take umbrage with your statement that "I do not believe you had the legal right to permit the shed", that is something that would have to be determined by a court of law, not by you. I presume that you enforce all of the rules and regulations unilaterally in an impartial and unbiased manner. For example do you require a variance to be issued for fences, flagpoles, radio antenna masts, retaining walls which are customarily placed in front, side and rear yards? These are all defined as structures in Article 2 of the building code. Mr. Tremblay I have no wish to become your adversary. I have probably spoken to half of the building inspectors in this state and many of them disagree with each other regarding the interpretation of various sections of the code.
