Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioners, owners of the property, are requesting variances from density and setbacks to allow construction of a deck and existing above ground pool in this R-1 zone. The Variances which have been requested may be granted upon a finding of the Board that: a. special conditions and circumstances exist which especially affect the land building or structure involved and which-are not generally affecting other lands, buildings and structures in the same district; b. literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner; c. desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal , after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1 . The pool was erected by a legal building permit in 1984. 2. The proposed deck would not be any closer to the street line than the existing house. 3. The proposed deck would add to the safety, welfare and convenience or the inhabitants. 4. The placement of the deck in this location would be the only practical place for it. 5. September 19, 1986 James Hacker, Chairman Zoning Board of Appeal One Salem Green Salem, MA 01970 RE: Compliance with Special Permit conditions issued for property located at-2 Orleans Ave. Dear Mr. Hacker: At your meeting of August 27, 1986 the question was raised as to whether the conditions imposed by the Board in the grant of a Special Permit for prop- erty located at 2 Orleans Ave. have been met. Based on a site inspection by this office, it is my opinion that the conditions as noted by the Board have been adhered to. Condition #1 - The shed has been attached to the house with a fence and gate, no requirement for a permanent attachment. Condition #2 - The shed has been shingled and painted as close as could reasonably be expected due to weathering of the house. Condition #3 - Shrubs have been planted which in time will assist in shielding the shed from the abutters view. Due to the topography of the properties, shrubs would have to ex- ceed fifteen ( 15) feet in height to completely block the shed from view. The Board indicated no height requirement for these shrubs and therefore, I feel the petitioners have attempted to comply as well as could reasonably be expected. Condition #4 - Weather conditions this spring, as we all know, were not con- ducive to outdoor activity and work was done as conditions allowed. If I can be of further assistance in this matter please contact me. Sincerely, William H. September 19, 1986 James Hacker, Chairman Zoning Board of Appeal One Salem Green Salem, MA 01970 RE: Compliance with Special Permit conditions issued for property located at 2 Orleans Ave. Condition #,2 - The shed has been shingled and painted as close as could atA reasonably be expected due to weathering of the house. C- Condition #3 - Shrubs have been planted which in time will assist inh'0_ n shielding the shed from the abutters view. Due to the \41 W4^ topography of the properties, shrubs would have to ex- ceed fifteen ( 15) feet in height to completely block the li..✓ shed from view. The Board indicated no height requirement for these shrubs and therefore, I feel the petitioners have, u attempted to comply as well as could reasonably be expected.g_ K"'1- Condition #4 - Weather conditions this spring, as we all know, were not conll^ Gb ducive to outdoor activity and work was done as conditions allowed. If I can be of further assistance in this matter please contact me. Sincerely, William H. Notice of the hearing was sent to abutters $ oTthers and notices of the hearing were properly published in the Salem Evening i'iiegaf1G65With Massachusetts General Laws Chapter 40A. Petitioners, owners of the property, are requesting a Special Permit to allow and existing shed in this R-1 district. The provision of the Salem-Zoning Ordinance which is applicable to this request for a Special Permit is Section V B 10, which provides as follows: Notwithstanding anything to the contrary appearing in this Ordinance, the Board of Appeal may, in accordance with the procedure and conditions set forth in Section VIII F and IX D, grant Special Permits for a-aerations and reconstruction of nonconforming structures, and for changes, enlargement, extension or expansion of nonconforming lots, 'and, structures, and uses, provided, however, that such change, extension, enlargement, or expansion shall not be substantially more detrimental than the existing use to the neighborhood. In mor-- general terms, this Board is, when reviewing Special Permit requests, guided by the rule that a Special Permit request may be granted upon a finding by the Board that the grant of the Special Permit will promote the public health, safety, convenience and welfare of the City's inhabitants. The Ecard of Appeal, after careful consideration of the evidence presented at the hear:-, and after viewing plans of the property, makes the :ollowing findings of fact: 1 . Said structure was constructed prior,to the petitioner. purchasing the property; aAEoa,,.e, of c Water in the basement of the main dwelling necessitates applicant to find storage on his property; Any other location on his property would also require Variance; 4.
