Dear Mr. Tremblay,
We have this property under agreement with a closing
planned for June 20, 1995. The closing attorney, Paul Lausier,
called me and questioned if the shed is in compliance with item
1 of the special permit► "Shed can remain in its present
location as long as it is attached to the main dwelling."
The shed is attached to the house by a fence but the
attorney wants a letter from your office that this is sufficient
to comply with the intent of the word attached.
I do understand that there is a $30.00 charge for a letter
and I will bring in a check as soon as you let me know when I
may pick up the letter.

Petitioners, owners of the property, are requesting a Special Permit to allow and
existing shed in this R-1 district.
The provision of the Salem Zoning Ordinance which is applicable to this request
for a Special Permit is Section V §' 10, ahich provides as follows;
Notwithstanding anything to the contrary appearing in this Ordinance,
the Board of Appeal may, in accordance with the procedure and conditions ,
set Forth in Section VIII F and IX D, grant Special Permits for
alterations and reconstruction of nonconforming structures, and for X
changes, enlargement, extension or expansion of nonconforming lots,
land, structures, and uses, provided, however, that such change,
extension, enlargement, or expansion shall not ,be substantially more Cr
detrimental than the existing use to the neighborhood.
In more general terms,this Board is, when reviewing Special Permit requests, LU
guided by the rule that a Special:'�,�Permit request may be granted upon a finding —
by the Board that the grant of the Special Permit will promote the public health,
safety, convenience and welfare of the City's inhabitants.
The Board of Appeal, after careW consideration of the evidence presented at ttt

purchasing the property;
2. Water in the basement of the main dwelling necessitates applicant
to find storage on his property;
3. Any other location on his property would also require Variance;

5. No major opposition.
One the basis of the above findings of fact, and on the evidence presented, the
Board of Appeal concludes as follow3:

Dear Mr. Hacker:
At your meeting of August 27, 1986 the question was raised as to whether
the conditions imposed by the Board in the grant of a Special Permit for prop-
erty located at 2 Orleans Ave. have been met. Based on a site inspection by
this office, it is my opinion that the conditions as noted by the Board have
been adhered to.
Condition #1 - The shed has been attached to the house with a fence and
gate, no requirement for a permanent attachment.
Condition #2 - The shed has been shingled and painted as close as could
reasonably be expected due to weathering of the house.
Condition #3 - Shrubs have been planted which in time will assist in
shielding the shed from the abutters view. Due to the
topography of the properties, shrubs would have to ex-
ceed fifteen ( 15) feet in height to completely block the
shed from view. The Board indicated no height requirement
for these shrubs and therefore, I feel the petitioners have
attempted to comply as well as could reasonably be expected.
Condition #4 - Weather conditions this spring, as we all know, were not con-
ducive to outdoor activity and work was done as conditions
allowed.

Petitioners, owners. of the property, are requesting a Special Permit to allow and
existing shed in this R-1 district..
The provision of the Salem•Zoning Ordinance which is applicable to this request
for a Special Permit is Section V B 10, which provides as follows:
Notwithstanding anything to the contrary appearing in this Ordinance,
the Board of Appeal may, in accordance with the procedure and conditions
set forth in Section VIII F and IX D, grant Special Permits for
alterations and reconstruction of nonconforming structures, and for
changes; enlargement, extension or expansion of nonconforming lots,
land, structures, and uses, provided, however, that such change,
extension, enlargement, or expansion shall not be substantially more
detrimental than the existing use to the neighborhood.
In more general terms,this Board is, when reviewing Special Permit requests,
guided by the rule that a Special Permit request may be granted upon a finding
by the Board that the grant of the Special Permit will promote the public health,
safety, convenience and welfare of the City' s inhabitants.
The beard of Appeal, after careful consideration of the evidence presented at the
heari^_, and after viewing plans of the property, makes the following findings
of fac_:
1 . Said structure was constructed prior to the petitioner
purchasing the property;
2. Water in the basement.of the main dwelling necessitates applicant
to find storage on his property;
Any other location on his property would also require Variance;
4. Petition was submitted will all but one abutter in favor, most
of the neighborhood was in favor;
No major opposition.
