Fax 978-927-9351 a-. fl N } _ 1 TENANCY AT WILL AGREEMENT Agreement dated as of January (2 1998 by and between The Salem Pioneer of 6 Manning Street, Salem, Massachusetts (hereinafter "Tenant") and Delulis Properties, LLC, with an address of 31 Collins Street Terrace, Lynn, Massachusetts 01902 (hereinafter "Landlord"). TERMS Premises: 231 Washington Street, Salem, Massachusetts, located on the ground floor and containing approximately 550 square feet. Term: Commencing February 1, 1998 and to continue on a month to month basis thereafter terminable by either party on sixty days written notice to the other party. Provided Tenant complies with the tennisof this Agreement, Landlord agrees that it will not exercise its right to terminate for a period of one year from the commencement date. Rent: Upon signing of this Agreement Tenant shall pay the sum of $800.00, which represents prepayment of Tenant's first month's rent under this Agreement and prepayment of a portion of Tenant's last month's rent. Beginning March 1 , 1998 and thereafter until otherwise notified by Landlord, on or before the first day of each month during the term of Tenant's occupancy Tenant shall pay rent in the amount of $400.00 per month. Landlord agrees that it will not notify Tenant of any increase in the rent for a period of one year from the commencement date. In addition to the payment of rent under the preceding paragraph, Tenant agrees to provide Landlord with advertising space in Tenant's newspaper at no cost to Landlord. Said advertising space shall be not less than the size indicated on the rate sheet annexed hereto as Exhibit A. Condition of Premises: Tenant accepts the premises in "as is" condition and agrees to undertake all improvements necessary to prepare same for Tenant's use and occupancy. Landlord agrees to allow Tenant access to the Premises to prepare the same for occupancy upon the signing of this Agreement. Utilities: The Premises are separately metered for electricity and natural gas, which is used in the operation of heat and air conditioning equipment. Tenant shall pay for electricity and natural gas servicing the Premises directly to the vendor or provider thereof. Repairs and Maintenance: Landlord shall. maintain and repair the heating and air conditioning equipment and the roof. Insurance: Tenant agrees to maintain appropriate liability insurance in connection with Tenant's activities in an about the Premises and shall provide Landlord with evidence of coverages.
