WENDY'S SITE PLAN REVIEW 3 '7, ,5 TO: SRA MEMBERS Z� FROM: WILLIAM E. LUSTER EXECUTIVE DIRECTOR z RE: WENDY'S PROJECT REVIEW DATE: NOVEMBER 8, 1995 On Tuesday,November 7, 1995, Chris Greene of the DRB and SRA board members Barbara Cleary and Joan Boudreau met with me to review the design of the proposed Wendy's to be located on the corner of Lafayette and Peabody Streets. The following is a draft to approve the plan, dated August 16, 1995 and revised September 14, 1995 as submitted with the following conditions: 1. The mansard roof element be removed and the brick be continued to the roof line and all building details be carried around the entire building and a cross section of the sign attachment to the new brick area be submitted for final review. 2. Deletion of the Colorado Spruce trees and replacement with more urban type tree at all locations shown on plan, especially the Lafayette Street corner island. (NOTE: The applicant is requesting that the tree be removed from the Lafayette Street front island, and lower shrubbery be planted because of electrical lines that travel underground through this area. This request was amenable to the sub- committee) 3. The removal of the hedges on Lafayette Street in front of the building to be replaced by the continuation of the concrete sidewalk up to the building line. 4. The removal of the grass around the planter site by the drive-thru area and replacement with concrete and that a wider planter be installed. (NOTE: The applicant is requesting that this area remain.as drawn, and assured the Board that it would be properly maintained.) 5. The instruction to relocate the Lafayette Street tree to a different location be changed to relocate or replace tree, and that all trees being planted be of a substantial size and all street trees match existing species of trees on Lafayette St.. 6. Glen Gery 52DD -Mid Atlantic brick with light gray mortar color be approved and a sample be mocked-up for final review before installation. 7. The construction of a stockade fence be constructed along the future dining area portion of this project until the South River improvements are completed and the dining area is constructed. The fence should be a wooden, solid, stockade fence with a straight top and be 6' high and painted a dark neutral color, such as autumn brown. The Board requested a drawing be submitted for final review. 8. The rear striped areas be replaced with full landscape islands as shown on the original plan. (NOTE: The applicant is requesting that only the farthest rear island be fully raised and landscaped and that the other area remain striped because of snow removal and grading concerns. This request was amenable to the sub- committee) The sub-committee also recommended that the total signage package be excluded from the above approval and be submitted by Wendy's and reviewed separately. The second recommendation made was that the use of the red neon striping shown on the plan be excluded from the above approval and the applicant submit photographs of existing sites during the evening hours when the neon is lit, and further discussion take place with the applicant regarding the use of this design/lighting element. esd\sra\wendydec SRA Minutes November 8, 1995 Mr. Curran stated that these issues should be addressed separately; since we have not seen the redevelopment plan, we cannot comment on it. Wendy's Recommendation Mr. Luster explained to the Board that representatives from the DRB and SRA met to review the design plans for the proposed Wendy's to be located on the corner of Lafayette and Peabody Streets. The Wendy's Project Review memo is a draft approval to the plan, dated August 16, 1995 and revised September 14, 1995, as submitted with the outlined conditions . Mr. Luster continued that a new plan dated November 1, 1995 was submitted and approved by the Planning Board under the Site Plan Review Special Permit process. Several of the DRB's conditions have been addressed in this new plan. Mr. Luster began to review in detail each of the conditions listed in the memo. The SRA and DRB sub-committee recommended that the total signage package and the proposed use of the red neon striping shown on the plan be excluded from the approval. Ms. Cleary stated that items #1, #2 & #5 should read - "updated plans must be submitted to the DRB for final approval." She also suggested that item#8 be excluded from the approval so that the DRB can review the applicant's request and updated plan. She also stated that the phrase `including number and location of signs' be added to the last paragraph of the memo where it references the sign package review. Ms. Boudreau made a motion to approve the DRB recommendations outlined in the submitted memo with the change that the November 1, 1995 plan be referenced and the additional conditions offered by Ms. Cleary (see above) be added. Mr. L'Heureux seconded the motion, all were in favor, motion so carried. Chairman Guenther expressed the gratitude of the Board for the staff's diligence regarding this project. Other Business The next meeting date was scheduled for Tuesday, December 5, 1995 to discuss the Executive Summary of the Downtown Action Plan and review the Board's 1995 Work Plan. There being no further business, Mr. Curran made a motion to adjourn the meeting. Ms. Boudreau seconded the motion, all were in favor, motion so carried. Meeting stands adjourned. Dubinsky Secretary 2 MINUTES OF THE MEETING OF THE BOARD OF THE SALEM REDEVELOPMENT AUTHORITY HELD ON NOVEMBER 8, 1995 A regular meeting of the Salem Redevelopment Authority was held on Wednesday,November 8, 1995 at 6:00 p.m. Chairman Guenther called the meeting to order and on roll call the following members answered present: Joan Boudreau, Barbara Cleary, Robert Curran, William Guenther and Paul L'Heureux. Executive Director William Luster and Staff Assistant Michelle Cammarata were also present. BILLS Mr. Paul L'Heureux made a motion to pre-approve a check to the Red Raven Restaurant for the SRA's Annual Dinner Meeting in an amount not to exceed $300.00. Barbara Cleary seconded the motion. A roll call vote was taken, all were in favor, motion so carried. DISCUSSION/NEW BUSINESS Chairman Guenther asked Mr. Luster to update the Board on the Peabody Essex Museum expansion plan and the draft of the SRA's Executive Summary to the Downtown Action Plan. Mr. Luster responded that Dan Monroe presented the expansion plans to him and Mayor Harrington, and the Museum is scheduling a presentation to be shown to the SRA, City Council, Salem Partnership, Salem Chamber of Commerce, etc. over the next few weeks. The plan includes approximately 30,000 square feet of gallery space and the removal of some buildings, including the Armory facade. Mr. Monroe acknowledged the need for a downtown management system and the idea that the Museum has to provide financial outreach to the City by some type of payment in lieu of taxes. Another issue discussed at this meeting was the use of the Empire, L.H. Rogers and Boys Club buildings and the desire of the City for the Museum to provide retail/commercial uses in these buildings. The other major issue of concern is the removal of the Armory facade. At this time the Board began discussions when to release the SRA's Executive Summary to the Downtown Action Plan. The Board decided that the study should be released before the Museum's plans are made public. They felt the study would receive less of a negative response and would create less of a controversy if the SRA study was released first. The Board discussed the issue of the Museum's intention to demolish the Armory facade. Mr. Luster stated that any developer appearing before this Board has to prove the benefit of their proposal before the Board will allow the demolition of a building. Mr. L'Heureux felt that the Board needs to be consistent- citing the SRA did not allow Holyoke to tear down the Crombie Street building. Mr. Guenther pointed out that Holyoke did not provide a development plan for redevelopment of their site. Mr. L'Heureux continued that this Board made a decision, and it needs to stand behind its decision. The Museum's plans should conform to that decision. He stated that the SRA should release the summary prior to the Museum announcement - recognizing that we are aware of the expansion plans and we do not agree with all of its components. JOHN R. Wendy's Restaurant at Peabody and Lafayette Street. The public hearing was closed on October 19, 1995. At a regularly scheduled meeting of the Planning Board held on November 2, 1995, the Board voted by a vote of six (6) in favor, one (1) opposed to approve the application as complying with the requirements of a Site Plan Review Special Permit, subject to the following conditions: 1. Conformance with Plan Work shall conform to plan containing 11 sheets entitled, "Site Plan Set of Wendy's at 1 Peabody Street and Lafayette Street in Salem, MA", prepared by Ryan Engineering Corp., P.O. Box 161, Nahant, MA 01908, dated August 16, 1995, revised 11995. 2. Amendments Any amendments to the Site Plan or Waiver of Conditions contained within shall require the approval of the Planning Board. 3. Noise Mitigation —� The increase in dB(A) shall not exceed 4dB(A) above the ambient noise. Such ambient noise level shall be determined following noise level testing which is acceptable to Wendy's and the City. If Wendy's determines the sound level cannot be reasonably met, using alteMation me ods, the Planning Board shall reconsider this level. 4. Employee Parking Wendy's shall establish an in-store policy requiring employees to park in the rear parking lot shown on the approved plan as Parking Lot A. A copy of the policy shall be submitted to the Planning Department prior to the issuance of a Certificate of Occupancy. 5. Conservation Commission Wendy's shall comply with all requirements of the Salem Conservation Commission. 1VV v � 6. Board of Health Wendy's shall comply with all requirements of the Board of Health approval. 7. Exterior Building Materials The exterior of the building shall be predominantly red brick through the roof line. There shall be no mansard. 8. Salem Redevelopment Authority_ Wendy's shall receive final design approval and comply with all requirements of the Salem Redevelopment Authority. 9. Landscaping a. Landscaping shall conform with Landscape Plan Sheet 1 C. b. All curbing within the Wendy's site shall be cement concrete. C. Wendy's shall remove and reset vertical granite curbing on Lafayette Street as deemed necessary by City Engineer and on Peabody Street, around the entire Wendy's site. d. Wendy's shall install new cement concrete sidewalks and planting strips on Lafayette Street and new cement concrete sidewalks on Peabody Street, around the project site, as shown on the approved plan. e. All trees shall be a minimum of 3'/z" caliper. f. After all project landscaping is completed, and prior to the issuance of a Certificate of Occupancy, Wendy's shall be required to add further landscaping if such is required by the City Planner. g. Maintenance of all landscaping shall be the responsibility of the applicant, his successors or assigns. 10. Site Lighting a. Site lights shall be no higher than twenty-five (25) feet high above their two (2) foot support pedestals. b. Site lighting shall be designed to provide adequate site security at the same time, providing a shield to guard against glare on surrounding residences. 11. Outside Dining Area Wendy's shall agree to design and construct an outdoor dining area adjacent to the South River. The dining area shall be approved in writing by the City Planner prior to construction. The design and construction of this area shall be subject to the construction of the walkway around the South River by the City of Salem. 12. Si na e The signage for the proposed project shall be approved in writing by the City Planner. 13. Maintenance a. The Applicant shall employ an acceptable method or means for the holding and disposal of trash during site development with a copy of this method sent to the Planning Department and Health Department. b. Refuse removal, ground maintenance and snow removal shall be the responsibility of Wendy's, its successors or assigns. C. Winter snow in excess of the snow storage areas shall be removed off site. d. Winter snow and ice maintenance process shall be approved by the Salem Conservation Commission. 14. Utilities Utility installation shall be approved by the City Engineer. 15. Clerk of Works The City's Clerk of the Works shall be on-site as deemed necessary by the City Planner. The cost of the Clerk of the Works shall be borne by Wendy's. 16. Construction Practices All construction shall be carried out in accordance with the following conditions: a. No work shall commence before 8:00 a.m. on weekdays and Saturdays. No work shall continue beyond 5:00 p.m. There shall be no work conducted on Sundays or holidays. Inside work of a quiet nature may be permitted at other times. b. All construction shall be performed in accordance with the Rules and Regulations of the Planning Board, and in accordance with any and all rules, regulations and ordinances of the City of Salem. 17. As-Built Plans As-built plans, stamped by a Registered Professional Engineer or Land Surveyor, shall be submitted to the Planning Department and Engineering Department prior to issuance of a Certificate of Occupancy. 18. Violations Violations of any conditions contained herein shall result in notice being served on the Applicant to appear before the Planning Board at its regularly scheduled meeting. If it is determined by the Planning Board that a violation of any of the conditions has f occurred, and if corrective action is not immediately forthcoming, this may result in revocation of this permit by the Planning Board. jnVbd/pbwendv 1 SRA Minutes _ September 26, 1995 he would include it in the draft of the letter. Wendy's Mr. Luster informed the Board that Wendy's met with the City several months ago and agreed to `break the mold' of a traditional Wendy's and work with the City to design a restaurant that would be in keeping with Salem's urban character and would also be in concert with the City's future development plans at the South River area. Wendy's has met all of the City's requests, including: moving the building up to the street line; having its entrance on Peabody Street and an exit only on Lafayette Street; and constructing an outside dining area when the South River walkway and related improvements are developed. At this time, Attorney John Keilty presented an overview of the site and outlined the plans to construct a Wendy's at this site. He pointed out that the DRB recommendation that the building hold the corner had been adhered to by moving the building up to the sidewalk lines at the corners of Lafayette and Washington Streets. He showed the Board the enhanced landscaping proposed for the site, as per the DRB's recommendation. Attorney Keilty pointed out that the front traffic island landscaping has been changed, because of existing site conditions. It was discovered that electrical wiring runs below this area and therefore lower shrubbery has been substituted for the large tree that is shown. Another recommendation that could not be accommodated was the construction of an island in the rear portion of parking area. Because of water flow patterns on the site and because the creation of this island would cause great difficulty in snow removal, Wendy's is requesting that the crosswalk delineation, as originally proposed, be constructed. Wendy's is also requesting that the grass landscape portion of the island by the drive-thru area remain, stating that Wendy's is very aggressive in keeping up the quality of their site landscaping, and grassing this area would be more aesthetically pleasing and would be maintained. Attorney Keilty stated that a stockade fence, painted autumn brown, as per the DRB's recommendation, would be constructed in front of the proposed dining area until such time as the South River improvements are completed by the City. Mr. Keilty informed the Board that one of the major 'break the mold' changes Wendy's has agreed to is the replacement of their mansard style roof with an all brick facade. Mr. Luster suggested that designees from the SRA, DRB and Planning Board meet to review this proposal, so that all the Boards are assured that they are approving the same plan, and each Board's issues can be resolved. Attorney Keilty stated that the Planning Board has requested traffic study and decibel level information, which will be furnished to them at their next meeting. Ms. Boudreau asked the timetable for the project. Attorney Keilty responded that once all City approvals have been granted and the site has been cleared, it will take approximately 60 days to do the build-out. Wendy's is hoping to start construction in April. Ms. Cleary asked why the other lot was not acquired by Wendy's. Attorney Keilty stated that a 21E study showed there is hazardous material on the parcel, and cost analysis showed it would not be feasible for Wendy's to acquire this parcel. 2 SRA Minutes September 26, 1995 Ms. Cleary asked if there has been any residential feedback regarding this project. Attorney Keilty responded that only area business owners have expressed concern regarding this proposal at a recent Planning Board public hearing. Ms. Cleary stated the importance of meeting with the DRB and Planing Board to be sure it is clear what is being approved, especially since this is the first demolition of a building in the Urban Renewal Area in a long time. Mr. Curran asked how the future outdoor dining area would be serviced. Attorney Keilty responded that the area will serve as a place for take-out customers to sit. Chairman Guenther asked who will own the store after construction and what market it will serve. Mr. Hague responded that this store will be a company owned store, and the market serviced will consist mainly of foot traffic. He continued that is why Wendy's was able to adhere to many of the City's requests, such as increased landscaping,the loss of parking spaces, and the entrance only on Peabody St., and exit only on Lafayette St. Chairman Guenther thanked the applicants for their presentation. At this time, Chairman Guenther appointed Barbara Cleary and Joan Boudreau to be the SRA's designees for this project. Loan Consultant Progress Update Ms. Patricia Dee of Diarchy Development appeared before the Board to present her findings and progress regarding the SRA's loan program. Ms. Dee stated that she reviewed four of the SRA's recent loans: David& Brenda Butler (1805 Customs House); Olde Salem Brewery; Salem Flick; and the Advanced Educational Center for Nursing loans. She found that all the appropriate financial information was received and all projects had considerable community benefit. She continued that as part of her charge to improve the loan processes, she has developed with Ms. Cammarata a loan application and approval process description to be given to all applicants so that they will be aware of the entire loan process. She pointed out that the application form will also request that the borrower provide the SRA with a personal credit report. She stated that the SRA's previous financial statement form has been replaced with a standard RMA form. Ms. Dee stated that a Loan Request Summary has been developed. As a result of the submittal of a personal financial statement, a program will be added to the spreadsheets to determine ratios relating to this financial information. A program balance sheet and form has been created for Ms. Cammarata to analyze cash flow and debt service information and personal and company cash flows. An application rejection letter has also been drafted. Ms. Dee stated that a meeting was held with the members of the Bank Advisory Board to review the forms, and they were generally pleased, but requested some further definitions of the ratio calculations to make sure that everyone would be working with the same ratio information. 3 S, I TO: SRA MEMBERS FROM: WILLIAM E. Attorney Keilty presented plans that sited the building at the corner and up to the sidewalk line at Peabody and Lafayette Streets, as required at a previous DRB meeting, with a monument sign at the corner. Two plans were submitted,the original plan calls for an expanded parking area, if rear parcels could be acquired by Wendy's, an alternate plan was presented, which is basically the same plan with the exception of the configuration of the back parking lot area. (Please note: The Alternate parking plan will be used, since acquisition of this parcel has not been successful.) Mr. Keilty explained that Wendy's has committed to construct an outdoor dining area contingent upon the City's construction of a walkway and improvements to the South River. As per a prior suggestion of the DRB, vehicular traffic will enter on Peabody Street and exit only onto Lafayette Street. DRB RECOMMENDATION: The DRB approved the plans as submitted with the following conditions: The mansard roof element be removed and the brick be continued to the roof line and all building details be carried around the entire building. The Board conditioned the approval of the Alternate plan with the replacement of the rear striping areas be replaced with full landscape islands as shown on the original plan. Richard Winer- 2 North Street- Sign Application Mr. Richard Winer appeared before the DRB with a sign application to erect a 2' x 16' sign on mdo plywood with vinyl applied letters. The sign has a white background and blue letters. The top line has 6" letters and the second line has 3" letters. DRB RECOMMENDATION: The DRB approved this application with the conditions the top letters be reduced to 4" letters, the letter color be changed to black,the background color be changed to a cream, ivory or eggshell color, that a Times Roman seraph font be used on both lines, and a black wooden molding be used as a border for the sign. Other suggestions were made for the applicant to explore, such as considering using raised applied letters or using shadow pinstripe lines, gray in color around each letter. Wendy's considers the elimination of the mansard portion of the roof to be, in part, an elimination of their readily identifiable corporate logo and corporate identity. The SRA approved the sign package and requested that the Design Review Board (DRB) review the neon striping and accents once more. Board members and staff were unsure if the DRB had specifically reviewed the neon at previous meetings. SUMMARY OF DRB DISCUSSION OF WENDY'S The regular March meeting of the DRB was held on Friday, March 15. In addition to all five DRB members,SRA directors Joan Boudreau and Donna Vinson also were present, along with Wendy's representative Keith Hague. DRB members did recall taking note of the neon during their previous meetings. At those meetings, the design of the roof, samples of brick and landscaping plans were discussed in detail. Neon was not the subject of debate, as the DRB considered it appropriate to the site, the building and its use. They were willing to discuss the issue again however, for the benefit of the SRA Board. DRB members agreed unanimously that the use of neon on the building was both subtle and appropriate. Chris Greene captured the Board's feelings, stating that the neon "announced" the restaurant, without "screaming it". The Board also discussed the challenge of designing an urban building while preserving Wendy's corporate identity. They felt they had achieved this goal by extracting several concessions from Wendy's and were quite willing to allow them to retain their typical neon lighting. At this time, the attached memo of support from SRA Executive Director Bill Luster was distributed. He and the other DRB members felt both goals had been achieved in the design of Wendy' s restaurant. At this time, Donna Vinson asked whether neon is more appropriate in a suburban or highway setting than in downtown Salem. The DRB members believed that the thin strips of neon were subtle enough to avoid resembling a suburban or highway restaurant. They also noted that neon is often used downtown in restaurants and taverns. Chris Green assured Ms. Vinson that representatives of Wendy's had eliminated the board's "fear" of a suburban building by making several important concessions in the design of the building and in their landscaping plan. NEXT STEP I Since the DRB had indeed reviewed the neon when it first approved Wendy's building design, there is no need for a formal vote from the SRA. However, the SRA has never felt fully informed of the discussions about neon, as our confusion at last week's meeting demonstrated. The restaurant's site plan has been approved by the Planning Board, and its sign package received final approval from the Salem Redevelopment Authority (SRA) at its March 12 meeting. The request for neon striping is the last design detail requiring DRB and SRA review. As you know, the Planning Board, SRA and DRB have worked with representatives of Wendy's to ensure that the restaurant's design complements its downtown location. As a result of such ongoing deliberation, this Wendy's restaurant is unique to Salem. Representatives of Wendy's have been understanding of the City's need to encourage an appropriate urban site plan and building design. Meanwhile, the City has tried to be mindful of the corporation's need to preserve its distinct corporate identity. Summarized below are some of the concessions which the company has made to develop a restaurant in downtown Salem: Design/Planning Issue Amendments to Original Request Placement of Building The original site plan showed the building in the center of the lot. The Planning Board required that the building be moved to the corner of Lafayette and Peabody Streets to maintain the street line. As a result, traffic now enters only on Peabody Street and exits on Lafayette Street. 1 One Salem Green • Salem, Massachusetts 01970 0 (508) 745-9595, Ext. 311 0 Fax (508) 744-5918 Design/Planning Issue Amendments to Original Request Roof Design The DRB required that Wendy's signature mansard roof be eliminated and that the exterior of the building be predominantly red brick through the roof line. Outside Dining As a condition of developing this waterfront site, the Planning Board, under my recommendation, required Wendy's to agree to design and construct an outdoor dining area adjacent to the South Harbor. The design and construction of the dining area will be subject to the construction of the South Harbor Marina Walk. Landscaping The DRB made several changes to Wendy's typical landscape design to complement the building's urban setting. Brick Color The DRB chose the brick to be used in the building, requiring a lighter, more varied-toned brick than typically used. This brick resembles those of other downtown buildings. As this summary indicates, Wendy's has sacrificed several design elements that form its corporate identity. The requirements of the Planning Board, DRB and SRA were consistent with City ordinances, SRA regulations and the principles of good urban design. However, it is my opinion that the elimination of the neon band and accents would impose hardship on the business and jeopardize the project. Further, neon is allowed in restaurant and entertainment uses, after careful design review. Wendy's officials argue that the drastic changes to the roof and building materials require that some typical elements of the facade -- such as the neon striping-- be retained. I support this argument and recommend that the members of the DRB and SRA grant their approval, with the requirement that the neon lighting be turned off after normal business hours, and allow Wendy's to begin construction in Salem. In reviewing signage and building designs, members of the SRA and DRB balance the need to encourage investment in downtown Salem with their mission of preserving and enhancing Salem's distinctive environment.
