As we discussed, the Salem Sign Ordinance prohibits temporary signs located on the building's roof. Section 3-45(F) states that temporary signs "may be affixed to windows provided that their total area does not exceed thirty percent of the window." We also discussed the fact that the temporary Kalamari's sign has been in place for an extended period of time and can now be considered permanent. The Salem Sign Ordinance states that any permanent sign erected without a permit is an illegal sign. A violation of the Sign Ordinance may result in a fine of up to X$20 per day. On November 13, 2006 your application to erect a permanent sign on the roof of 33 Bridge Street was denied. As we discussed in our meeting on November 9, to appeal this decision you must apply for a variance from the Zoning Board of Appeals. Based on our conversation in December regarding the temporary sign, I expected to you to submit an application to the ZBA by the end of December. If your application for a variance is not filed within two weeks of the date of this letter, I will forward this matter to the Zoning Enforcement Officer. Please contact me within two days of the receipt of this letter to discuss your application to the Zoning Board of Appeals. The Salem Sign Ordinance in §3-45 ON-PREMISE SIGNS IN NON-RESIDENTIAL DISTIRCTS allows a sign attached parallel to a building, "provided that the top of such sign is no higher than whichever of the following is lowest: (1) twenty-five feet above grade; (2) the top of the sills of the first level of windows above the fust story; or (3) the height of the building at the building line." Pursuant g3-45, a sign attached parallel to the building must be no higher than the height of the building line. Because your sign is higher than the building line, we cannot issue a Sign Permit at this time. Should you want to appeal this decision, you must file for a variance with the Zoning Board of Appeals.
