P. 5b) rn This action came to be heard before the Court, Brady, J. pre- siding, upon the motion of the plaintiffs Daniel T. Kardaris, Susan M. Kardaris, Maureen J. Kiley, James H. Kiley and Mary E. Budka for summary judgment pursuant to Mass, R. Civ. P. 50, the parties having been heard, the Court finds that there is no genuine issue as to material fact, and that the plaintiffs are entitled to a judgment as a matter of law. It is hereby Ordered that; the decision of the Board of Appeals of Salem granting of a Tariance and Special Permit for property located at 16 Ord Street, Salem, Massachusetts is annulled. Judgment for the plaintiffs. The Clerk-Magistrate of the Court is directed to mail an attested copy of this judgment within thirty days from the date hereof, to the Oity Clerk, Building Inspector, and Board of Appeals, respectively of the City of Salem.
