A hearing on this petition was held on September 28, 1988 with the following Board
Members present, James M. Fleming, Chairman; Richard A. Bencal, Vice Chairman;
John Nutting, Secretary; Peter Strout, and Edward Luzinski. Notice of the hearing
was sent to abutters and others and notices of the hearing were properly published
in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A.
Petitioner, owner of the property seeks a variance frau the Salem Sign Ordinance
to allow the erection of 1. 20'x3' roof sign in this B-5 zone.
The variance which has been requested may be granted by the Board upon a finding
that:
a. special conditions and circumstances exist which especially affect the
the land, building or structure involved and which are not generally
affecting other lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner;
c. desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing and after viewing the plans of the property in question, makes the
following findings of fact;
1. The property and business in question is unique to the area as well as
the City in general.
2. The new signage would enhance the business visibility as no signs are there
presently.
3. The roof locations for the signs allow the petitioner to retain the
characteristics of the existing facade.
4. The Design Review Board recommended to the Salem Redevelopment Authority,
(SRA) and the SRA concurred with the Design Review Board.
On the basis of the above findings of fact and on the evidence presented at the
public hearing, the Board of Appeal concludes as follows:
1. The property in question is unique.
2. Literal enforcement of the Ordinance would involve substantial hardship
to the petitioner;
,3. The relief requested can be granted without detriment to the public good
and without derogating substantially from the intent of the district or
the purpose of the Ordinance.
DECISION ON THE PETITION OF SALEM EVENING NEWS FOR A VARIANCE
AT 155 WASHINGS STREET, SALEM (B-5)
4. Special conditions exist which especially affect the subject property
but not the district generally.
Therefore the Zoning Board of Appeal voted unanimously 5-0 to grant the Variance
requested, subject to the following conditions:

Plans describing the work proposed, have been submitted to the Inspector of Buildings in
.accordance with Section IX A. 1 of the Zoning Ordinance.
The Salem Evening News proposes to place two 20' x 3 ' signs on the roof of their
building located at 155 Washington Street.
The Application for Permit was denied by the Inspector of Buildings for the following
reasons:
Section 3-45 subsection D and Section 3-45 subsection M of the Ordinance relating
to Signs and Billboards does not allow a sign or its supports to extend above the cornice
line of a building.
The Undersigned hereby petitions the Board of Appeals to vary the terms of the Salem
Zoning Ordinance and/or the Building Code and order the Inspector of Buildings to
approve the application fee permit to build as filed, as the enforcement of said
Zoning By-Laws and Building Code would involve practical difficulty or unnecessary
hardship to the Undersigned and relief may be granted without substantially dero-
gating from the intent and purpose of the Zoning Ordinance and Building Code for
the following reasons:
On behalf of the Salem Evening News, I respectfully request the Board of Appeals
to grant the appropriate variances for the following reasons:
1 . The Salem News building currently has no signage and would therefore
request these variances for the two proposed signs for the purpose of
enhancing the business ' visibility.
2 . In order to retain the characteristics of the existing Facadeofthe building,
the roof proves to be the only v!able alternative for a sign location.
3 . On June 22, 1988, the Design Review Board recommended approval to the Salem
Redevelopment Authority and concluded that both the signs and their Locations
were aesthicalLy appropriate.

DESIGN PHILOSOPHY - October 1982
The existence of the DRB is mandated by the provisions or the Plan. Its function is to review, and
prepare appropriate recommendations for reference to the Authority "for concurrence and approval_"
The buides for its review derive from the stated goals of the Plan and are essentially related to
preservation of structures of historic and architectural value and the restoration o.` neighborhood
quality, economic viability, and functional capacity. The emphasis is on exterior environmental
quality that is to streetscope and accordingly "local conditions and the historical importance of
the town hall area and Derby Sgiare will be major considerations_"
There are seven principal zones in the Heritage Plaza East U. R_ areas, each with its own speeiaT
characteristics which ought to be respected and odressed in the course or each review_
1 . The Derby Square/Front Street area: Federal style,. formal setting of town half; Front- Street
meandering; pedestrian scale.
2. Museum area: Intermediate scale; style juxtaposition
3. Essex moll: Commercial; style juxtaposition; intermediate scale; pedestrian
4. North area residential: Contemporary-picturesque;'lcndmark focal; pedestrian, presently
insular
5. Washington Street: Mixed scale; vehicular
6. New Derby Street: Factory lofts
7. Charter Street: Dominated by burial ground, scattered historic buildings, small scale
Other areas are transitional and reflect overlapping characteristics_
OF. the seven zones, the Derby Square/Front Street area is the most historically and architecturally,
significant since it represents the greatest concentration of buildings and spaces intact from Salem's
mosi architecturally significant period and the only such grouping located in the downtown, and
commercial in character and use. It is, however, relatively isolated_ Its linkages therefore
assume an inordinate importance.
The second most important zone is the continuum of Essex mall and the museum zone (old Essex
Street). This area is the heart of Salem and is, in fact, the linkage between the east and west
historic residential areas. Its commercial importance and central position throughout Salem's
history is expressed by its vigorous, if sometimes jarring, juxtapositions of style and scale_
There are numerous significant individual buildings within the HPE area upon which adverse
impact would in turn adversel.y'impoct the zones in which they are located_ Each plays an
important role.
