0 ORD STREET COURT - BUILDING INSPECTION ORD STREET COURT TELEPHONE 744-0697 RESIDENCE 691- 9908 LAW OFFICES WILLIAM B. WELCH 221 ESBEX STREET SALEM. MASS. 01970 TIMOTHY J. DAVERN ROBERT W. WELCH January 15, 1973 ' Mr. Daniel J. O'Brien Building Inspector 5 Broad Street Salem, MA 01970 Dear Mr. O'Brien: Please be advised that this office represents John and Joyce Bilodeau of Ord Street Court, Salem, MA. It has come to our attention that there may be applica- tion for a building permit to construct a two family house on a vacant lot located on Ord Street Court. This lot is shown as Lot 1 on a plan recorded on April 20, 1965 in the Essex South District Registry of Deeds, Plan 186 of 1965 and recorded in Book 5260, Page 1. It is my interpretation of the law, and in particular, Chapter 40, Section 5A, that since this land was owned in common ownership on April 20, 1965 , in order for a building permit to issue, the zoning requirements as they presently exist in the City of Salem would have to be complied with. It is my further understanding that Lot 1 does not comply with the zoning requirements for the City of Salem. As you probably know, Ord Street Court is a street which is only 10 feet wide at the point it begins on Ord Street and is already heavily congested with the present structures that have been built thereon. My client does not feel that the sewage system or the road would be able to bear the burden of an additional two family house being constructed. The purpose of this letter is to present these facts to your attention in the event that such a building permit is requested. If you have any questions concerning this matter, please feel free to contact me. Yours very truly, Robert W. Welch jam cc: Albert R. Pitcoff, Esquire
