The above listed property has been found to be in violation of the following State
Codes and/or City Ordinances:
780 CMR, State Building Code, Section 118.1, States that it is unlawful to
erect, alter, change in use, or construct a structure without a Building Permit to do
so. You are Ordered to Cease and Desist from any construction activity until such
time as this work has been properly Permitted. Further, a shed is appurtenant to
the use of this property and as such must be placed at least five feet from any
property line, and twenty feet from any other structure on the same lot.
Said violations must begin to be corrected, repaired, and/or brought into
compliance within 2 days of your receipt of this notice. Failure to do so may result in
further actions being brought against you, up to and including the filing of complaints at
District Court.
If you have any questions regarding this letter, please contact the Building
Inspectors Office at (978) 745-9595, extension 5643. Your right to appeal from said
action would be through the Board of Building Regulations and Standards located at One
Ashburton Place, Room 1301, Boston, Massachusetts.

A hearing on this petition was held October 19, 2005 meeting with the following Board
Members were present: Nina Cohen Chairman, Robin Stein Steven Pinto, Bonnie Belair
and Richard Dionne. Notice of the hearing was sent to abutters and others and notices
of the hearing were properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
At the request of the Petitioner, the Salem Board of Appeal voted 5-0, to grant leave to
withdraw this petition without prejudice for a Special Permit and a Variance to allow
existing garage structure to be rebuilt as a single living unit for the property located at 72
Orchard Street located in an R-1 zone.

The building has been occupied as a two (2) family dwelling prior
to 1966 and this use has continued to date. The building is being
assessed as a two (2) family for taxes.
It is the determination of this office that 72 Orchard Street has
been, is and may continued to be a two family unit and will be
noted on our files.
This letter is in no way meant to confirm that the property does
