A railing is only required to meet the code at the time it was constructed. In fact the rail in question meets past codes and complies with the current 8`s Edition of the Massachusetts Building Code which only requires a railing on raised surfaces more 30 inches above the finished grade. If you have any further questions please feel free to contact me. It is this Departments determination that the porch does not need a guard rail as the height above finished grade in less than the 30 inches required by the current Massachusetts State Building Code. This letter is determine the requirement of a rail and in no way meant to confirm or deny whether said property is in compliance with all Building Department,Plumbing Department, Gas Department, Electrical Department,Fire Department or Health Department codes and regulations. Their residence is located at 27 Orchard Street which is referenced as City of Salem Map#27-Lot#0438. The parcel they own on 24 Southwick Street is known as Map#27—Lot#0444. These properties have separate frontage on different City streets and although both are non-conforming,they have not suffered any merger. It is my opinion that the lot at 24 Southwick Street can be sold without any zoning action or any other zoning relief.
