A hearing on this petition was held on April 29, 1987 withe the following Board
Members present:James Hacker, Chairman; Messrs., Bencal, Fleming, Luzinski, and
Strout. Notice of the hearing was sent to abutters and others and notices of the
hearing were properly published in the Salem Evening News in accordance with the
Massachusetts General Laws Chapter 90A.
Petitioner requests a variance from minimum setbacks to allow construction of. a
solvent tank storage and packaging building on an existing containment dike in
this I zone.
The variance which has been requested may be granted upon a finding of the
Board that;
a. special conditions and circumstances exist which especially affect
the land, building br structure involved and which are not generally
affecting other lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would in-
volve substantial hardship, financial or otherwise, to petitioner; and
c. desirable relief may be granted without substantial detriment to the
public good and without nullibying or substantially derogating frau
the intent of the district or the purpose of the Ordinance.
The Board of Appeal, after hearing the evidence presented at the hearing and
after viewing the plans, makes the following finding of fact:
1. The proposed addition is in harmony with the petitioners present
business.
2. No support or opposition was voiced at the hearing.
3. The proposed project would have close proximity to an existing
rail siding.
On the basis of the above findings of fact, and on the evidence presented
at the hearing, the Board of Appeal concludes as follows:
1. Special conditions exist which especially affect the subject
property but not the district generally,
2. The Variance can be granted without substantial detriment to the
public good and without substantially derogating from the intent
and purpose of the Ordinance.

Intent and plans and has held a public hearing on the project. Based on the information available to the

Therefore,the Commission hereby finds thatthe following conditions are
necessary,in accordance with the Performance Standards set forth in the regulations,to protect those inter-
ests checked above.The Conservation Commission ciders that all work shall be performed
in accordance with said conditions and with the Notice of Intent referenced above.To the extent that the fol-
lowing conditions modify or differ from the plans,specifications or other proposals submitted with the Notice
of Intent,the conditions shall control.
General Conditions
1. Failure to comply with all conditions stated herein,and with all related statutes and oftww regulatory meas-
ures,shall be deemed cause to revoke or modify this Order.
2. This Order does not grant any property rights or any exclusive privileges;it does not authorize any injury
to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of comptyi with a0
other applicable federal,state or local statutes,ordinances,by-laws or regulations.
4. The work authorized hereunder shall be completed within three years from the date of this Order unless
either of the following apply.
(a) the work is a maintenance dredging project as provided for in the Act;or
(b) the time for completion has been extended to a specified date more than three years,but less than
five years,from the date of issuance and both that date and the special circumstances warranting
the extended time period are set forth in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
8. Any fill used in connection with this project shall be clean fill,containing no trash,refuse,rubbish or de-
bris,including but not limited to lumber,bricks,plaster,wire,lath,paper,cardboard,pipe,tires,ashes,
refrigerators,motor vehicles or parts of any of the foregoing.
7. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or,it
such an appeal has been filed, until all proceedings before the Department have been completed.
8. No work shall be undertaken until the Final Order has been recorded in the Registry of Deeds or the Land
Court for the district in which the land is located,within the chain of title of the affected property.in the
case of recorded land,the Final Order shall also be noted in the Registry's Granter Index under the name
of the owner of the land upon which the proposed work is to be done. In the case of registered land,the
Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which
the proposed work is to be done.The recording information shall be submitted to the Comm; G G;on

9. A sign shall be displayed at the site not less than two square feet or more than three square feet in size

B. In the Wetlands District, a determination by a qualified engineer
of the seasonal high water table, performed during the last two
weeks of March or the first three weeks of April. A minimum of
two percolation tests for each leaching area shall be performed.
C. In cases of flood-proofing or pile construction, certification
by a registered professional engineer or architect as to the
elevation of flood-proofing measures and as to compliance with the
applicable sections of the Massachusetts State Building Code
concerned with flood depths, pressures, velocities, impact and
uplift forces, and other factors associated with the base flood.
Where specific methods or techniques have been previously certi-
fied, the Planning Board may waive, this requirement.
D. A list of Federal, State, and other local permits required by the
applicant.
E. Descriptions relative to all conditions applicable in Section III
below.

In the Wetlands and Flood Hazard Districts no structure or building,
including pipes and wells, shall be erected, constructed, substantially
improved, enlarged, or otherwise created or moved; no area shall be
paved; no earth or other material shall be stored, dumped, used as
fill, excavated, or transferred; and no sediment shall be caused to
be discharged from or onto a wetland, unless all the following condi-
tions are found to exist as part of the granting of a Special Permit by
the Planning Board (Use additional pages if necessary) :

IV. Procedure
The Planning Board shall, within 7 days after the filing of this
application, transmit one copy of said application, plans and all 'other
submitted information to the Inspector of Buildings, City Engineer, Board
of Health and Conservation Commission who may, at their discretion,
investigate the application and report in writing their recommendation
to the Planning Board. The Planning Board shall not take final action
on such application until it has received a report thereon from the
Inspector of Buildings, City Engineer, Board of Health and Conservation
Commission or until thirty-five (35) days have elapsed after dis-
tribution of such application without a submission of a report. The
Planning Board Shall hold a Public Hearing on said application as soon
as possible after receiving the above reports, in accordance with
Chapter 40A of the Massachusetts General Laws. The Planning Board
shall notify the applicant in writing of its decision on the special
permit. The decision shall document the proposed development or use
and the grounds for granting or refusing the special permit. The
Planning Board may, as a condition of approval, require that the appli-
cant give effective notice to prospective purchasers, by signs or
by recording the special permit at the Registry of Deacls, of the wet-
land or flood hazard conditions associated with said premises and the
steps undertaken by the petitioner or his successor in title to
alleviate the effects of same.

On Thursday, April 16 , 1981, the Planning Board of the City d Salem held a public
hearing regarding the application of Hamblet & Hayes Co. for a Special Permit under
Section P. Wetlands and Flood Hazard Districts , of the Salem Zoning Ordinance ,
with respect to the installation of new solvent storage tanks at Colonial Road, Salem ,
Massachusetts .
At a regularly scheduled meeting of the Planning Board on April 16 , 1981, the Board
voted, by a vote of five in favor, none opposed , to approve the application as complying
with the requirements .for the issuance of the permit with the to Llowing conditions:
1. That all work shall be done in accordance with plan entitled "New Solvent Storage
Tank Installation for Hamblet & Hayes Co. , Salem, Mass. , Project #8119 ,
Date 3/13/81" , prepared by Robert M . Rumpf & Associates , Consulting Engineers .
9 . Applicant agrees to install at least six observation wells to check for tank
leakage .
3 . This order does not grant any property rights or any exclusive privileges; it does
not authorize any injury to private/pubLic property or any invasion of public/private
rights .
I hereby certify that a copy of this decision has been filed with the City Clerk., and a
copy is on file with the Planning Board. This Special Permit shall not take effect until
a copy of the decision bearing the certification of the City Clerk that twenty days have
elapsed and no appeal has been filed or that if such appeal has been filed, and it has
been dismissed or denied, is recorded in the Essex County Registry of Deeds and is
indexed in the grantor index under the name of the owner of record or is recorded and
noted on the owner's certificate of title. The fee for recording or registering shall be
paid by the owner or applicant.

Sirs:
The Salem City Electrician has notified this office that you have
started work on the storage building project. He has also stated
that the installation of sprinklers has been initated.
No work on the sprinkler system nor the fire alarm system shall
be started until plans are submitted for stamped approval of
this office, It should also be noted that the Sprinkler O. S, &Y.
valve will not be permitted in the electrical room, unless separated
. from electrical equipment by a fire coded partition.

Sir:
Plans have been submitted by Connolly Bros, Inc. of 20 Oak St. ,
Beverly, Mass. for substantial alteration of an existing structure
for occupancy as an inside storage room for drums and containers
of flammable and combustible liquids.
Plans as submitted are inadequate for receipt of the stamped
approval of the Salem Fire Prevention Bureau, as of this date.
Plans are designated, Project #8112, Drawing #3, dated March 30, 1981.
The Salem Fire Prevention Bureau under provisions of Article 113. 5
of the Mass. State Building Code, hereby disapproves the plans as
submitted and stipulate the following to be included as requirements
for stamped approval.
1. A submission of a site plan with all buildings designated by
a letter, shall be provided with the plans. This occupancy has
currently reached the stage where the number and use of the
buildings requires a complete control and pre-fire plan for
establishment of actions for the protection of life and property,
within the occupancy as well as the adjacent areas. Each Building
shall be marked with the designated "letter" , with the letter
being twelve inches in height, and Red on a White background.
2. All tanks containing any fluid, shall be given a number designation,
and shall be so marked with the twelve inch numeral, in Red on
a White Background,
3. All buildings and tanks shall have prominantly displayed decals
which show the classification of the products stored therin. The
decals shall be the U.N. Type which comply with 527 CMR 24. 00
4. No smoking signs shall be posted on all buildings which have
storage of flammables or combustibles and on all tank loading
and unloading racks. These signs shall be legible and visible
on all sides of the structure or tank.
5. It shall be noted on the plans submitted that the roof construction
complies with the fire resistance required by Section 913. 2 of
the Mass. State Building Code.
6. All electrical work shall be subject to Section 400. 10 (S. B. C. )
and 527CMR12. 00

7. The roof shall be provided with an explosion relief system, per
Sections 401. 1,401. 2, 401. 3 and 401.4 of the Mass. State
Building Code. This venting system shall be included for
plan approval.
8. Fire Protection shall be required as follows:
a. A fire cabinet shall be provided on the exterior of the
stEucture which shall contain at least one 20BC rated
CO fire extinguisher and one 20BC rated Dry Chemical
fire extinguisher.
b. An approved dry type sprinkler system shall be required for
this occupancy, under provisions of Section 1202. 6 of the
Mass. State Building Code. Said sprinkler system shall
be installed under provisions of Section 1204. 0, with plans
submitted for stamped approval of the Salem Fire Dept.
A Fire Department Connection will be required under provisions
of Section 1213. 0 of the State Building Code.
c. An approved fire alarm system, with connection to the
City of Salem Fire Alarm office is deemed necessary at
this time to provide the early notification necessary
to ensure public safety and provide early warning upon
activation of any fire supression systems required. This
system shall also include local manual fire alarm stations
situated on each structure, with audible and visual warning
devices for notification of occupants in the complex. The
system shall be provided with a graphic annunciator located
at the building situated near the main gate, and shall be
as approved by the Salem Fire Department. This fire alarm
system shall be installed to protect the entire complex and
.shall provide for?donnections from devices on all buildings
and structures.
9. All exterior walls shall be shown on the plan in sufficient
clarity and detail to permit approval of the wall as an enclosure
for interior storage of flammables. Ref. Section 906. 0 (S. B. C. ).-
It is especially to be noted that all wooden overhead doors and
other openings shall meet the requirements for a H Use Group
Occupancy.
10. Plans shall show the designated egresses on the floor plan,
per table 607 and Section 609. 2 of the State Building Code.
11. A minimum of a six inch raised sill, with a double ramp or
grate covered trench across any door opening.
12. No heating equipment shall be permitted. in this structure.
13. An u,Pdated maximum anticipated inventory of Flammable, Combustible,
and/or Hazardous material, as stored. in designated buildings and
storage tanks, shall be provided the Salem Fire Prevention Bureau,
to determine the exact total storage under provisions of the
existing license. This inventory shall be provided the Salem
Fire Prevention Bureau, annually, on or before April 1, each year.

14. Plans shall be resubmitted, including plans for installation
of all fire protection and. alarm devices listed above, to the
Salem Fire Prevention Bureau for stamped approval, before
any construction is started.
15. The projected increase in use and occupancy of this complex
including the proposed 2000000 gallons of Flammable liquid
storage underground, make it necessary to bring this complex under
current recognized standards for fire safety and the protection
of life and property within the City of Salem.

Will give a public hearing in accordance with the Wetlands Protection Act,
Mass. G. L. Chap. 131, Section 40, at the request of Hamblet and Hayes Company,
Colonial Road. The purpose of the hearing is to determine the effects of the
installation of a valve chamber and sump on an existing drain in order to
prevent the possibility of a spill into the adjacent wetland area. The hearing
will be held on Thursday, September 13, 1984, at 7: 30 p.m. , One Salem Green,
second floor conference room.
