also be responsible for the enforcement of this code.
107.2.2 Alternate inspector: An alternate inspector of buildings may be
appointed to act in the disability of the inspector of buildings in case of illness,
absence, or conflict of interest. The alternate inspector shall meet the qualifications
of Section 107.3.

Dear Mr. Tremblay,
Thank you for your missive of August 7, 1995 and for arranging to meet with
me on Monday the 14th at the property. I appreciate your willingness to return to
the property due to my being late for the first meeting.
I am glad that we had the opportunity to address each of the fifteen numbered
issues raised in your letter and that we mutually agreed on a speedy and effective
course to correct each point with the exception of 1 and 5 over which I have no
control. Further, while I never received the letter concerning the retaining wall, I
acknowledge the need to identify the owners thereof and to make the minor repairs
now before they become major ones.
I will immediately order the respective tenants to remove their personal
property from all hallways and access ways. Debris in other areas will be thrown
out within the next few weeks, or used in the reconstruction of the third floor.
Further, after we finished, I replaced all burned-out or missing light bulbs and
confirmed that all worked regardless of apparent tenant inabilities to use light
switches.
As noted to you at our meeting, due to financial difficulties (broken back) in
my practice, I find it necessary to move back to our Salem house. In order to do this
effectively, we would need to redo the third floor interior space. I will be
forwarding to your attention within a few weeks said plans/drawings detailing these
construction plans. I trust that they will meet with your personal approval such that
we would be able to begin building in September.
My intent is to rebuid the third floor according to the floor plan on record in
your office which would include a bedroom, bath living and kitchen area. As we
discused, this would require me to rebuild the second floor porch area into a larger
landing space for a second egress for the third and second floors. Our children
would reside in the second floor rear unit with two bedrooms, a bath and a play area
(present kitchen). I will forward the drawing/plans to you with all due alacrity.
Again, I greatly appreciate your succor in these matters, and I intend to
follow your requests to the letter. Should you have any further questions, pleae do
not hesitate to call or write to me at your convenience.

Upon receiving a complaint from one of your tenants at the above
mentioned property, I conducted an inspection and the following violations
were found.
1. There is some question to this Zoning Officer as to the legal use of
four units.
2. Kitchen wall in apartment #2 (rear of building) does not meet
required one and one-half (1 1/2) hour fire rating.
3. Ceiling in living room as well as exterior wall does not meet one
and one-half (1 1/2) hour fire rating.
4. Bath ceiling and walls do not meet required fire rating.
5. Water pressure on premises does not meet required pressure in
the Plumbing Code.
6. Hallway cluttered --ith construction debris must be made clear,
this is a means of egress.
i. Light not operating in front hall at first floor level, as well as
the light at the front porch area.
8. Light must be installed in rear entrance at first floor hallway.
9. Hand rails missing at basement stairway.
10. Basement must be kept clean.
11. Debris at rear of property near rear basement door must be kept
cleaned, this is a means of egress.
1_ Replace missing down spouts .
13 . Replace missing and broken tallasters at front porch.
1 . Stairs from first floor porch to second floors must be rebuilt
to State Building Code standards.
15 . Stairs from ground level at right hand side of house (2 sets ) must
be rebuilt to conform to State Building Codes.

is in violation of its allowed use . That property is only
allowed to be a four unit dwelling. It is now being used
as a five unit dwelling. There are two apartments on the

the owner, James Shannon, is living in a fifth apartment on
the third floor .
Having a fifth apartment decreases the value overall
of properties in that neighborhood . It also worsens an
already bad parking problem.

I 've been requested to confirm to you in writing that
the above locale which recently was destroyed by fire , will
not be reconstructed into a living space .
It is my understanding that your department refuses to
issue any permit (demolition , reconstruction, etc . ) until I
affirm in writing that said space will not be used for
living space . Clearly this request is not within your
statutory power . Further , this space has never been used in
any manner other than what was suggested by your
predecessors , to wit: as a townhouse part of the rear second
floor unit . It has been rented for years to three
males . While I find this request both troubling and nothing
short of administrative blackmail , I will not be using the
third floor for anything more than open common storage or
tenant usage space .
I need to get this space demolished and at least
cleaned up. Further, I need to repair the water damage to
the first and second floor apartments . All of which is being
held up by your request for this letter ! I repeat here that
the this house is a legal four unit building (note attached
letter) and it has only been rented out as same .
Solely to facilitate the issuance of a demolition and
repair permit (s ) do I hereby affirm that the third floor

He recently were contracted to install an aluminum greenhouse on
the rear of the referenced residence of Mr. James Menaies
Shannon. Due to the manufacturers inability to deliver the
greenhouse as promised, Mr. Shannon chose to cancel his order
and asked me to come up with an alternate design. I did redesign
the addition based on Mr. Shannons requests and requirements. I
submitted the plans to the Salem Building Department, and had
them approved. I have proceeded and built the addition as per
plan and have gotten all rough inspections and will soon be
requesting a finish inspection.
My concern and reason for this memo is that I want to go on the
record that I did not pull the permit, the Owner or Owners
representative did. Also, should the Owner chose to do any
additional work of his own, as I have reason to believe he will,
I do not and will not be responsible for his actions under my
license. I have told the Owner the same.
I am requesting that this memo be kept on file in such a case
that other work is performed without my knowing.

Petitioner appealed to the Board of Appeals. to grant a variance from the
requirements of the City Zoning Ordinance applicable to R-1 , single family
residence zones, to permit expansion of an existing nonconforming use for
the district and allow a fifth apartment in an existing four-apartment
structure at 13-15 Ocean Terrace.
A hearing was held on this appeal' on June 1 , 1972, pursuant to notices mailed
postpaid to the petitioner, abutters, Board Members, and others, and adver-
tisements were duly published in the Salem Evening News advising of this
Public Hearing.
Board Members present at this hearing were Arthur E. Labrecque, J. Norman
Welch, Jr. , Chairman John M. Gray, Sr. , and William F. Abbott who acted as
secretary for the meeting in the absence of Joseph F. Doyle; also unable to
attend this hearing were James H. Boulger, Sr. , and Associate Member Emery P.
Tanch.
Petitioner appeared and explained the case the same as in the original appeal
on file; he stated this is an existing four-family dwelling and he proposes
to increase occupancy to five dwelling units.
Councillor Stephen Salvo appeared for the petitioner.
Mr. Freeman E. Morse and Mr. Gerald E. Pressman, both abutters, appeared in
opposition to granting this variance.
The Board Members carefully reviewed the appeal and plans presented to this
meeting; they found that in this single-family residence area, the City
Zoning Ordinance requires 3500 square feet of lot area for each dwelling
unit; they also found that there presently exist four apartments in this
structure and the entire lot area comprises 5664± square feet, and to allow
an expansion of such existing nonconforming use would violate the intent
and purpose of the City Ordinance , and would substantially increase detriment
to the public good, and further found no hardship to petitioner, and for these
reasons voted unanimously to deny this appeal,. and direct petitioner' s atten-
tion to the Purposes of the City Zoning Ordinance as set forth in Section I,
' i.e. ,
1 "For the purpose of promoting the- health, safety, convenience, morals ,
or welfare of the inhabitants of Salem, the Zoning Regulations and restric-
tions of this Ordinance, ordained in accord with the provisions of Chapter
40A of the General Laws - - are designed among other purposes to lessen con-
gestion in the streets; to conserve health, to secure safety from fire, panic ,
and other dangers; to provide adequate light and air; to prevent overcrowding
of land; to avoid undue concentration of population; to facilitate the ade-.
quate provision of transportation, water, sewerage, schools, parks, and other
public requirements; to conserve the value of land and buildings; to encourage

It will be necessary for me to refuse to issue a permit to alter
the premises at 13-15 Ocean Terrace to increase occupancy from four to
five apartments .
This is an R-1 district , zoned for single-family residences . Your
building is presently nonconforming for the district and to increase the.
occupancy to five tenants would be an expansion of a nonconforming use .
The City of Salem Zoning Ordinance excludes multi-family dwelling units
in the R-1 districts .
When you were in this office you indicated that you would probably
appeal to the Board of Appeals for permission to alter this structure .
If you wish to appeal to that Board , kindly submit your appeal in trip-
licate on the enclosed forms ; also , a check in the amount of $25 . 00 ,
payable to the Salem Evening News , is required to cover the cost of ad-
vertising notice of the public hearing on this appeal .
As you will note on the enclosed list of requirements necessary
for filing petitions with the Board of Appeals , a plot plan and two com-
plete sets of working plans must be furnished if the Board is to consider
