Board of Health Regulations 3.10 You are hereby Ordered to make a good-faith effort to correct these.violations,within twenty-four (24) hours of receipt of this Notice. 410,600: Storage of Rubbish and Cartage �Garbage or mixed garbage and rubbish shall be stored in watertight receptacles with tight-fitting covers. Said receptacles and covers shall be of metal or other durable, rodent-proof material. Rubbish shall be stored in receptacles of metal or other durable, rodent-proof material. Garbage and rubbish shall be put out for collection no earlier than the day of collection. ? Plastic bags shall be used to store garbage or mixed rubbish and garbage only if used as a liner in watertight receptacles with tight-fitting covers as required in 105 CMR 410.600(A)'provided that the plastic bags'may be put out for collection except in those places where such practice is prohibited by local rule or ordinance, or except is those cases where theDepartmentof Public Health determines that such practice constitutes a health problem. In any dwelling,. the owner shall be responsible for maintaining in a clean and sanitary condition free of garbage, rubbish, other filth or causes of sickness that part of the welling which is used in common by the Occupants and which is not occupied or controlled by one occupant exclusipely. (1) The owner of any dwelling abutting a private passageway or right-of-way owned or used in common with other dwellings or which the owner or - occupaxts under his control have the right to use or are in fact using shall be responsible for maintaining in a clean and sanitary condition free from garbage, rubbish,, other filth or causes of sickness that part of the passageway or_right-of-way which abuts his property and which he or or which he owns, BOARD OF HEALTH REGULATION p7 SECTION 3.10 CONTAINERS OR BUNDLES OF HOUSEHOLD AND ORDINARY COMMERCIAL WASTE GARDEN AND LAWN WASTE These shall be placed at the outer edge of the sidewalk appurtenant to the premises of the owner not later than 7:00 a.m. on the day of collection and not before 6:00 p.m. on the day preceding the day of collection, and shall be removed from the sidewalk on the same day as emptied. No commercial establishment shall puce or cause to be placed more than four barrels or other containers of ordinary - noa7mercialwastes or any extraordinary commercial or industrial wastes or tree waste,upon any"sidewalk or way for disposal.' Should you be aggrieved by this Order, you have a right to request a hearing before, the Board of Health. The two fronts I speak of are...The City of Salem and certain Officials and...In City Halls employ, one Marcia Lambert. This is a letter of complaint against both parties mentioned. Against Marcia Lambert for improper use of City offices and City Officials. Explanation: This residence was confronted by Marcia Lambert on two separate occasions about requesting the City of Salem planting a tree in front of our property. Due to current problems With drainage on this side of the street we negated the idea. Mrs. Lambert never approached the home owner, but instead approached the cities requisitions to find out if this household requested a tree. She confronted our tenant and when an unsatisfactory reply was given she took it upon herself to file a complaint with the City of Salem Building Inspector about our house. She is also planning wedding festivities for one of her daughters and wants the neighborhood to conform to her standards, which we evidently do not! The results of her visit and/or call is attached. The fact that one employee at City Hall can create such a stir because she can not have her own way not only mystifies me, but scares the hell out of me. Talk about vindictive! Needless to say my second complaint is against the office of Building Inspector. I feel if the inspector had done his job properly he would have found that this residence has been worked on regularly since the good weather arrived. Not one person from his office even tried to contact this residence about any complaint. It is my belief that after my sister talked with him the same day we received the attached letter that he was aware of why the complaint was initially filed, and still filed the final action letter. We have lived in this community since 1988 and always done our best to keep up our property appearance and be good neighbors, so much so I can not believe this is happening. We are not a wealthy sort and projects sometime stretch but they do get done. There are only three people living in this massive house and we are all doing our best to keep it going. This harassment is the last thing we need. Most of these projects will be done in the allotted time by the Building Inspector. Unfortunately the gutter and under roof areas may take a bit longer due to lack of ability in this household and insufficient funds to bring in a contractor, Unless the City has a program that will help pay for this large undertaking. We are checking with contractors presently. This household looks forward to your response to this unwarranted attack on this household by one individual and her friends in city employ.
