Dear Andrew,
This letter shall confirm for the record the current disposition of the structural portico
columns on the above referenced project.
VP Engineering of Boston was retained to prepare the technical specifications for the
repair, restoration, and waterproofing of the building envelop and structure. Included in
the specifications were requirements to perform full depth investigations to the four
entrance columns to assess the internal structural condition and determine the cause
of the cracking and crumbling manifested in the stucco veneer.
Exposure of the steel structure on three of the columns revealed extensive
deterioration to the steel frame. VP Engineering subsequently did a site inspection and
prepared a repair detail which could be used in lieu of complete replacement of the
steel structures. The decayed condition of the two exterior columns was sufficiently
extensive where replacement was the more economically feasible alternative and
provided the best result in restoring the structural integrity to the canopy.
Upon completion of replacing the steel structures of the two outside columns, you
directed that no further work be done on the two remaining columns, one of which has
been partially exposed and has revealed extensive decay to the bottom portion of the
steel. The last column has not had any stucco removed to expose the internal steel.
Recently, you have stated that in an effort to cut costs on the project, you intend to
stucco over the deteriorated steel on the partially exposed column and not investigate
the internal condition of the last column. Since I have withdrawn from further
participation on this project, I strongly suggest that you engage the services of a

technically competent consultant to fully evaluate your decision with respect to the
structural feasibility of leaving the columns in their current condition and the cost
impact of performing the work now while while the project is in progress versus the
future replacement cost in the context of the disruptive impact on an ongoing business
and the difficulty in matching weathered color and texture.

This letter shall confirm for the record our discussion at the project office on 29 Friday 1999
regarding the disposition of the vinyl asbestos floor tile on the above referenced project.
As you know, four different material samples(steam pipe insulation, main level floor tile, floor
tile adhesive, and boiler room ceiling material) were submitted to an independent testing lab
for analysis as to whether they contained asbestos fibers. The test results proved negative for
floor tile mastic and boiler room ceiling and positive for steam pipe insulation and floor tile.
The services of a licensed and certified abatement contractor were engaged for the removal
and proper disposal of the pipe insulation.
As discussed on 29 January, it had been intended that the existing floor tile be encapsulated,
much in the same manner as during the previous renovation when it was covered with carpet
and to the extent that the condition of the floor tile was acceptable as a substrate to receive a
new floor finish, it would remain untouched. A partial abatement would be conducted in those
area affected by HVAC, plumbing, and electrical penetrations. Further, it has been explained
to you in prior discussions that partial abatement would require engaging the services of a
licensed and certified contractor and that any area in excess of three square feet would
require the mandatory ten day notification process. Either alternative will require manifested
disposal documentation.
During our 29 January discussion, I suggested to you that the upcoming suspension of work
at the project might provide you with the appropriate window of opportunity to conduct your
abatement activities, whether complete or partial, so as not to delay the project when you
decide to remobilize.

Window Repair Field Notes

Dear Andrew,
This letter shall confirm for the record my field notes of 02 February 1999 regarding glass
replacement to the existing windows on the above referenced project.
During my morning site visit on 02 February, the crew at the project working on the window
restoration phase informed me that you had, on the first of February, instructed them to order
standard window glass from Salem Glass Co. for installation in the remaining windows requiring
glass and glazing. This situation occurred during a time when the project was alleged to have
been suspended pending further design review.
The cost saving field directive given by you to install standard glass in lieu of light restoration
glass as had been planned violates the replace in kind guideline for historic restorations and
represents a deviation from what had been the guiding principal of the restoration work on the
project. The restoration glass necessary for the project is available from S.A. Bendheim
Company in New Jersey. An order for the glass was pending at the time you allege to have
suspended the work.
If your directive has been carried out and and is allowed to remain in place, you may need to file
a Certificate of Appropriateness with the Salem Historic Commission and the non-conforming
work may jeopardize your intended request for tax relief from the Massachusetts Historical
Commission and Federal Department of the Interior.
This work was done without my knowledge and at a time when you had requested a suspension
of my managerial services. As you know, I have since officially withdrawn from the project and
your permits to restore and alter the building have been revoked.

This letter shall confirm to you and your associate inspectors that I am no longer
involved in the daily management of the above referenced project and that 1 am
officially withdrawing all licenses from the permit and the project.
My services were suspended by the Owner as of Friday, 29 January 1999 under the
expressed intent of the Owner to temporarily suspend work on the project for the
purposes of reviewing the design submitted for permit and a review of the financial
implications of the project.
My daily visits to the project have revealed that work is in fact still in progress and that
the carpenters and electricians on the project are in fact working without a licensed
manager on site. This set of circumstances leaves me no choice other than to withdraw
from the project to avoid any liability for any unlawful or code violating activity which
may occur while my licenses are on the permit.
Thank you for your understanding in this matter as I have fully enjoyed the open and
above board relationship which we have worked to date on this project. My withdrawal
is official as of the date of this letter.

Dear Mr. Strout,
Enclosed please find field copy of the above referenced permit which is being returned
to you as part of my official withdrawal from this project, including the withdrawal of all
licenses from all other permits issued for the purposes of the execution of work on the
project.
The initial permit fee was predicated on an estimated demolition cost of $3,000.00 for
a limited scope of removal of existing conditions and systems. As of 29 January ,1999
the scope of demolition had expanded to include the removal of all existing plumbing
systems, boiler plant, distribution system and convectors, asbestos insulation on
steam distribution system, all electrical power distribution systems and fixtures,
removal of stairway from main level to existing mezzanine, removal of stairway from
main lobby entrance to lower level, and the complete removal of all existing
construction in the lower level from the plaster ceiling to the concrete slab and
everything in between.
The revised value of demolition work performed, including the cost of legal disposal of
removed material, is approximately $22,000.00.

A hearing on this petition was held May 20, 1998 with the following Board
members present: Nina Cohen, Paul Valaskagis, Michael Ward, Ronald Harrison
and Stephen Buczko. Notice of the hearing was sent to abutters and others
and notices of the hearing were properly published in the Salem Evening
News in accordance with Massachusetts General Laws Chapter 40A.
Petitioner requests a Variances on use and parking to allow a Hair, Nails
& Skin Care Salon for the property located at 47 Ocean Avenue.
The Variance which has been requested may be granted upon a finding of this
Board that:
1 . Special conditions and circumstances exist which especially affect the
land, building or structure involved and which are not generally affecting
other land, buildings, or structures in the same district.
2 . Literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship, financial or otherwise, to the petitioner.
3. Desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogation from the
intent of the district or the purpose of the Ordinance.
The Board of Appeal , after careful considerations the evidence presented at
the hearing, makes the following findings of fact :
1 . Petitioner , Andrew Coveliuzzi, a prospective buyer of the property was
represented by Attorney George W. Atkins of Salem.
2 . The petitioner seeks a variance from the use provisions and parking
provisions of the Zoning Ordinance to allow for use of the building as a
hair, nails and skin care salon.
3 . The subject property is located at 47 Ocean Avenue at the corner of
Ocean Avenue and Lafayette Street in a R-3 district and within the
Lafavette Street Historic District.
in 1986, the Zoning Board of Appeal granted a Special Permit to allow
the premises to be used for professional offices; however, the building
was never occupied.
i . The petitioner has maintained and operated a salon on Essex Street in
Salem for the past 14 years.
6 . The operating hours of business will be restricted to 8;00 a.m. to 8:00
p.m. , Monday through Thursday and 8:00 a.m. to 6:00 p.m. , Friday and
Saturday.
7. Client services will be provided by appointment only and no "walk-in"
services will be provided.

S. No tanning beds will be operated on the premises.
9. No toxic chemicals will be used on the premises.
10 . No more than 10 employees will be located on the premises.
11 . The petitioner will be an on-site owner operator.
12. The existing parking and landscaping will be maintained and the
exterior of the building will remain unchanged subject to any required
repairs approved by the Historic District Commission.
13. The petitioner is negotiating with Andrew J. Baungatner, Executive
Director, United Cerebral Palsy Association of the North Shore, to
obtain parking for his employees at the United Cerebral Palsy
Association of the North Shore's parking lot on Lafayette Street.
14 . It was represented that the petitioner had meet with neighbors to '
discuss the proposed use of the property and had invited the neighbors
to visit his Essex Street Salon.
15 . No opposition to the petition was presented.
16. A letter in support of the petition was submitted by Florence LeGoff
of 255 Lafayette Street.
17 . Speaking in favor of the petition was Ward 5 Councillor William Kelley,
Patricia Kessler, 284 Lafayette St, David Goggin, 9 Wisteria Street,
and Anthony Gattineri , owner of the California Olive Oil Company of 134
Canal Street.
On the basis of the above findings of fact, and on the evidence presented
at the hearings, the Board of Appeal concludes as follows:
1 . Special conditions exist which especially affect the subject property
and not the district in general .
2 . Literal enforcement of the provisions of the Zoning Ordinance would
involve substation hardship to the petitioner.
3. Desirable relief can be granted without substantial detriment to
public good and without nullifying and substantially derogating from
the intent of the district or purpose of the Ordinance.
On the basis of the above findings of fact, and on the evidence presented
at the hearing, the Zoning Board of Appeal voted unanimously, 3-0 to grant
the variance requested, subject to the following conditions:
i . Petitioner shall comply with all city and state statures, ordinances,
codes and regulations.
2 . All construction shall be done as per the plans and dimensions
submitted.

The applicant has requested variances from the following sections of the1996 Rules and Regulations of the Board:

2. The application was heard by the Board as an incoming case on Monday, November 1, 1999 .
3. After reviewing all materials submitted to the Board, the Board voted as follows:
GRANT the variance to Section 28.12 to allow the installation of a vertical wheelchair lift to access the lower level on
the following conditions: 1. the wheelchair lift provide access from grade level to the lower level of
the building; 2. the new accessible entrance with the wheelchair lift be open at all times the inaccessible front entrance
is open; 3. all services provided on the upper level, be provided on the lower level; 4. Signage be
installed at the inaccessible entrance indicating the location of the accessible entrance and 5. the wheelchair lift comply
with all provisions of Section 28.12.2.
NOTE: If the work being performed is reconstruction, renovation, addition,or alteration, compliance with this decision must
be achieved by completion of the project and prior to final approval by the building department. Otherwise, if the work being
performed is new construction, compliance with this decision must be achieved prior to the issuance of an occupancy

The Andrew Michael Salon & Day Spa is for review for variance by the Massachusetts Architectural
Access Board. We are requesting that a handicap accessible stair lift be put in place as shown on the
enclosed drawings rather than a handicap accessible ramp. The limited size of the lot and the building
placement makes lt difficult for any ramp design. A ramp to the first floor would require 72 feet, or 60 feet of
ramp to the lower level. Any ramp design would detract from the historic character of the 1912 Salem
South Branch Library Building. The 72 feet of ramp and platforms would require the whole landscaped
area to the right of the main entry of the building.
The owner can provide all services of his business on the lower level of the building therefore we would
hope that you would consider a handicap accessible lift for the site on 47 Ocean avenue, Salem,
Massachusetts.

Dear Madams/Sirs-
The Salem Historical Commission is writing in support of the application of the Andrew Michael Salon & Day
Spa for a variance from the Mmsachusetts Architectural Access Board for the property located at 47 Occan
Avenue. Formerly the South Branch Public Library,this property is located in the Lafayette Street Local Historic
District and was one of the few public buildings built in South Salem, largely a residential area, It was the first
branch of Salem's public library system to occupy its own quarters.
According to the building survey form on file with the City and the Massachusetts Historical Commission, the
property was built in 1912-1913 and is of Neoclassical style. The architect was Clarence H. Blackall. The one
story stucco structure is asymmetrically arranged, one end being circular and the other rectangular. At the center
is a full-height pedimented entry portico on Doric columns with a full entablature. Other details include the serni-
oircular fanlight over the door,the dentilled cornice and the 12 over 12 sash with blind transoms.
According to the architect for the current redevelopment project, achieving accessibility to the first floor of the
Andrew Michael Salon & Day Spa would require 72 feet of ramp plus four platforms. It would also require
adjustments to the front entry area to gain 4 feet of width, which is necessary,for accessibility, and the
alteration/replacement of the front doors. The proposed ramp would completely alter the unique identity of the
South Branch Salem Library Building. The character-defining elements of this building include it's shape and
architectural details, as well as the aspects of its site and environment. Introducing a 72 foot ramp would visually
be incompatible in terms of size and scale and destroy important architectural features, as well as the historic
relationship of the building to it's site,
The owner proposes to add a handicap lift at the right side of the building to provide needed handicap
accessibility to the lower level where all services of the Salon & Day Spa will be provided to the business'
handicapped and non-handicapped clientele. This solution would achieve handicapped access while preserving
the historic elements and setting of the site. The Salem Historical Commission supports this solution.
