780 CMR Massachusetts State Building Code, Section 118.1, regarding violations of
the construction code, states that it is unlawful to add, alter, or construct any structure
without the proper permit to do so.
No further work may be done until such time as the order is lifted. Any person who shall
continue any work in or about the building or structure after having been served with a
Stop Work Order, except such work as that person is directed to perform to remove a violation
or unsafe condition, shall be liable to a fine of not more than $1000, or by imprisonment for
not more than one year, or both for each violation; with each day constituting a separate
violation.

Dear Mr. Tremblay:
I am in the process of refinancing the mortgage on property at 38 Ocean
Avenue, Salem MA. Salem Five Cents Savings Bank (Lisa Popielski) has
requested that I obtain verification from you that my property is indeed a
legal 2-family house. I spoke with a gentleman in your office this morning
and he informed me that it was not listed in your office as a 2 family but is
assessed in the Assessor's Office as such. He told me that I would need to
provide documentation which I am enclosing in the form of copies of city
directories, dated 1945 and 1965, listing two families at 38 Ocean Avenue. I
am also enclosing letters from former tenants and from current neighbors
verifying that my property is indeed at 2 family house and was a 2 family when
I purchased it in 1958 and had been for many years prior.
Would you please inform Salem Five and/or Liberty Appraisal Co., 7 Essex Green
Dr. in Peabody that this is the case.

I purchased the property at 40 Ocean Avenue sometime in 1956 or 1957.
My house is directly next door to 1138 Ocean Avenue, Salem MA. At the
time that I purchased my property, 1138 Ocean Avenue was owned and
occupied by a family by the name of Cote. They lived on the second
floor and the first floor was rented to a family by the name of
Cartwright. Sometime in 1957 or 1958, the house was purchased by
the Villani family. They occupied the first floor and rented the
second floor to a family by the name of Prevost. The Prevost
family lived in the second floor apartment from approximately 1958
until 1964-1965. After the Prevost family moved, a family by the
name of Kaplan moved into the apartment and lived there for a couple
of years or more.
To my very best knowledge, 1138 Ocean Avenue has been a two-family
house since, at least, the year 1957 and I would assume that it-had
been a two-family house for many years prior to 1957.
