Dear Ms. Gardell:
As per your request I have researched the history of the
property located at 35 Summit Ave./32 Ocear? Ave. prior to 1965,
the year that the City of Salem accepted its current Zoning
Ordinance.
It would appear from information available to this office,
that in 1965, 35 Summit Ave. was occupied by a Halle and Larkin, and
32 Ocean Ave. by a Butts family.
Although the property is located within a residential single
family zone, based upon the above, it is a nonconforming, grandfathered,
three family dwelling and may continue to be used in that manner.

Dear Mr. Munroe ,
I am writing to clarify the zoning compliance status of my third
floor condominium at 35 Summit Avenue , Salem.
I intend to put the property on the market as soon as it is possible .
I have received varying responses from different sources as to the
marketability of the condo and therefore seek your opinion on this
matter .
For your information, I have enclosed a copy of the previous owner ' s
Listing Statement . The document appears to indicate that the pro-
perty was cleared, through your office, for all applicable zoning
and permit requirements . (see page 2 & 3)
I have been led to understand that the former owner and his attorney
have presented certain documents to you which will ascertain the
building is a non-conforming grandfathered three family unit. Is
this information correct? If not, what must I do in order to es-
tablish the marketability of my property?
