In an effort to keep all parties concerned about the above referenced
property updated, I would like to advise you that Mr. Michael Andreas, the
new owner of the property came into the office to discuss the removal of
siding and the installation of a bulkhead. He assured me that all shingles
removed have been kept and will be used as spares for any shingles he may
have to replace. He also assured me that he would take out all necessary
permits in the future.

Dear Ms. Zocco:
This department is in receipt of a complaint regarding the alleged
removal of asbestos siding to allow for the installation of a bulkhead at the
above referenced property. There were no permits issued for this work, the
removal of the siding or the installation of the bulkhead which is a direct
violation of the Massachusetts State Building Code. Also, the removal of any
asbestos material can only be done under certain guidelines and must be
disposed of in proper and specific locations.
The asbestos siding on your home only contains a minimal percentage of
asbestos and can be covered should you, at some date, choose to do so. Please
contact this office to obtain proper instructions and procedures and do not
attempt to do any further work on this property without proper permits.
Failure to comply with these instructions can result in legal action being
brought against you.

Petition of JACK and PATRICIA BURNS, seeking a Special Permit per Sec. 3.3.2 Nonconforming
Uses of the Salem Zoning Ordinance, to allow a change from a nonconforming two (2) family
structure to a three (3) family structure at the property of 21 OCEAN AVE (Map 33 Lot 689)(R-1
Zoning District).
A public hearing on the above Petition was opened on May 18, 2016 pursuant to M.G.L Ch. 40A, g 11 and
closed on that date with the following Salem Board of Appeals members present: Tom Watkins, Mike Duffy,
Jimmy Tsitsinos, Paul Viccica (alternate) and James Hacker (Alternate).
The petitioner is seeking a Special Permit from the provisions of Sec. 3.3.2 Nonconforming Uses of the Salem
Zoning Ordinance to allow a change from a nonconforming two (2) family structure to a three (3) family
structure.
Statements of fact:
1. In the petition date-stamped April 26, 2016, the Petitioner requested a Special Permit per Sec. 3.3.2
Nonconforming Uses of the Salem Zoning Ordinance to allow a change from a nonconforming two (2)
family structure to a three (3) family structure.
2. Attorney Atkins presented the petition on behalf of the petitioner.
3. The subject property is located in a R-1 Zoning District
4. In 1999,when the property was purchased by the petitioners, it was a non-conforming three (3) family
dwelling. The property owners, then reduced the number of dwelling units to have a non-confomvng
two (2) family dwelling. The petitioner proposed to convert the property back into a non-confomming
three (3) family dwelling.
5. There are no exterior structural changes proposed to the building.
6. There are five (5) existing parking spaces that meet the parking requirements of the Zoning Ordinance.
Parking spaces will be accessed by an existing curbcut along Cliff Street.
7. The requested relief, if granted, would allow the Petitioner to allow the change from one
nonconforming use of a two (2) family structure to a three (3) family structure.
8. At the public hearing three (3) members of the public spoke in favor of and none (0) spoke in
opposition to the petition.

The Salem Board of Appeals, after careful consideration of the evidence presented at the public heating, and
after thorough review of the petition, including the application narrative and plans, and the Petitioner's
presentation and public testimony, makes the following findings that the proposed project meets the
provisions of the City of Salem Zoning Ordinance:
Findings for Special Permit
The proposed change in use is not substantially more detrimental to the neighborhood than the
existing nonconforming use.
1. The proposed change in use would not be more substantially detrimental than the existing non-
conforming structure to the impact on the social, economic or community needs.
2. There are no negative impacts on traffic flow and safety, including parking and loading as there are
five (5) existing parking spaces,which meets the parking requirements of the Zoning Ordinance.
3. The capacity of the utilities is not affected by the project.
4. There are no impacts on the natural environment,including drainage.
5. The proposal improves neighborhood character as the property was a three (3) family dwelling and
there are many multi-family dwelling units in the neighborhood.
6. The potential fiscal impact,including impact on the City tax base is positive.
On the basis of the above statements of facts and findings, the Salem Board of Appeals voted five (Tom
Watkins, Mike Duffy, Jimmy Tsitsinos, Paul Viccica (alternate) and James Hacker (Alternate) in favor and
none (0) opposed, to grant a Special Permit from the provisions of Sec. 3.3.2 Nonconforming Uses of the Salem
Zoning Ordinance to allow a change from a nonconforming two (2) family structure to a three (3) family
structure subject to the following terms, conditions and safeguards:
1. The Petitioner shall comply with all city and state statutes, ordinances, codes and regulations.
2. All construction shall be done as pet the plans and dimensions submitted to and approved by the
Building Commissioner
3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly
adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. Exterior fetishes of new construction shall be in harmony with the existing structure.
6. A Certificate of Occupancy shall be obtained.
7. A Certificate of Inspection is to be obtained.
8. Petitioner is to obtain approval from any City Board or Commission having jurisdiction including, but
not limited to, the Planning Board.

To whom it may concern:
I am writing to report that workers at 21 Ocean Avenue in Salem,
on May 1 and 2, 1993, demolished a bulkhead (and rebuilt it) which had
older siding. My fear is that this older shingling was asbestos.
The secretary at your office told me, on 6 May 1993, that she could
not locate any permits for work at that address.
I am afraid that continued work on the house at 21 Ocean Avenue,
which is covered with the same type of older shingle as the former
bulkhead, could expose the neighborhood to a serious health hazard, if
the shingle were made of asbestos material.
In any case, we may have been exposed already. I called the Salem
police department desk on May 1st. The duty officer could not help me
and his lieutenant told me that he could not do anything since your
office and the Health Department were closed on weekends.
In addition, I would appreciate it if my communication with your
office were to be kept confidential. Unless it is necessary for the
resolution of this situation, I do not wish to have happen what
happened the last time I notified your office by registered mail about an
illegal--the Health Department shut it down--day care in my
neighborhood. Somehow the owners found out my name!

Dear Mr. Moore:
Following my inspection of the referenced premises on
. September 16, 1980 with Lt. Goggin and yourself, I will require
the following items be accomplished prior to issuance of any
Certificate of Occupancy as a Group Residence.
1. Both stairways shall be painted with a fire retardant
paint with smoke contribution rating not to exceed
450. The front stair shall be painted for its full
height.
2. The second floor living room door opening into the
stairhall shall be made operational.
3. Close up all openings in flues.
4. Provide :an interconnected smoke detection system.
Detectors shall be located in each bedroom; at the
foot of the basement stairs; and on the first and
third levels in each stairway.
5. A manual pull station shall be provided.
6. The -Salem Fire Department will accept the existing
oil burner installation.
I would further recommend the porches and yard have debris
and trash removed. All hallways shall be cleared of any obstructions.
