As you know we met at my office on 12/12/01 to discuss the enforcement of
zoning for the properties located at the end of ocean Ave west and abutting
the "decisive boundary being Railroad main track and our property at 8-10
Broadway known as 8-10 Broadway Realty Trust llc.
I am formally requesting in writing what actions have been take since our
meeting. And that this letter serve as a formal written request to enforce the
zoning.
Under the establishments of districts we find the following:
R-2 is similar to R-1 but for the more then one family. "but are in all
other way" similar in character to R-1 districts.
Permitted uses under R-2 section (6)
"Private gages and other uses and buildings, Provided that
such uses are clearly incidental to the principal use'
Cls yxvarehousing and wholesale distribution of components,
electrical devices industrial switching gear, pine conduit, wire etc. are
not incidental to the residential principal use. Permitted use of this
nature clearly falls under the B-4 district section(3)

Decision
City of Salem Zoning Board of Appeals
Petition of KEVIN'rALI30T, seeking a Special Permit under Sec. 3.3 of the Salem
Zoning Ordinance in order to expand a nonconforming structure (construct a
second level over an existing first floor of a single-family home) on the property
located at 134 OCEAN AVENUE NVEST 112-21.
A public hearing on tlae above Petition was opened on October 20, 2010, pursuant to Mass
General Law Ch. 40A, § 11. The heating was closed On October 20, 2010 with tlre,following
Zoning Board Of Appeals members present: Robin Stein, Richard Dionne, Annie Harris,
Beth Debski, Becky Curran, Bonnie Belair(alternate), and Jimmy Tsitsinos (alternate).
Petitioner seeks a Special Permit pursuant to Section 3.3. of the City of Salem Zoning
Ordinances.
Statements of fact:
1. Petitioner and owner Kevin Talbot represented himself at the hearing.
2. In a petition dated October 6, 3010, petitioner requested a Special Permit to expand
a non-conforming structure.
3. At the hearing, abutter Melissa Pagliaro, 136 Ocean Avenue West, commented that
trees on 134 Ocean Avenue West are hanging over onto her property. In response,
Mr. Tremblay agreed to trim the trees on Ms. Pagharo's side of the fence to keep
them out of her yard.
The Board of Appeal, after careful consideration of the evidence presented at the public
hearing, and after thorough review of the plans and petition submitted, nukes the following
findings:
1. Desirable relief may be granted without substantial detriment to the public
good and without 1w11ifyui; Or substantially derogating from the intent or
purpose of the zoning ordinance.
2. 11ie applicant may vat}-the terms of the Residential Two-F,urlik Zoning
District to allow for the construction of the addition as shown on the
submitted plans.
?. In permitting such change, the Board of Appeals requires certain .appropriate
conditions and safeguards .as noted below.
On the basis of the above findings of fact and all evidence presented at the public hearing
including, but not limited to, the Plans, Documents and testimony, the Zoning Board of
Appeals concludes:
1. A Special Permit to expand a non-conforming structure is granted to allow
for the construction of an addition on the property located at 134 Ocean
Avenue West, as shown on the subnutted plans.
In consideration of the above, the Salem Board of Appeals voted, five (5) in favor (Stein,
Currin, Debski, Dionne and Harris) and none (0) opposed, to grant petitioner's requests for
a Variance and a Special Permit subject to the following terms, conditions, and
safeguards:
1. Petitioner shall comply With all city and state statutes, ordinances, codes and
regulations.
2. All construction shall be done as per the plans and dimensions subnutted to
and approved by the Building Coummissioner.
3. All requirements of the Salem Fire Department relative to smoke and fire
safety shall be strictly adhered to.
4. Petitioner shall obtain a building permit prior to beginning any construction.
5. Exterior finishes of the new construction shall be in harmony with the
existing structure.
6. A Certificate of Inspection is to be obtained.
7. Petitioner is to obtain approval from any City Board or Commission having
jurisdiction including, but not limited to, the Planning Board.
8. Petitioner is to cut back and maintain the,trees on the property along the
property line between 134 and 136 Ocean Avenue West.

Appeal from this decision, if any, shall be made pursuant to Section 17 of the Massachusetts

After receiving a complaint relative to you running a business out of your home, I have
found violations that are not allowed in a residential district under "Home Occupation"
which area more than one commercial vehicle and a storage trailer .
If these items are removed it will be legal for you to have an office at your residence
provided that any person working in the office has to be a resident of that dwelling.
