Dear Mr. Shea:
At your request, Tim Flynn, Assistant Director of Public
Services, called me today and requested that I approve a
street-opening permit at 23 Nursery Street to install a new water
service, allegedly on a complaint of poor water pressure. I would
concur with that request, upon receipt of the following:
1 . Written confirmation from the Acting Director of Public
Services that the street opening will be repaved immediately
utilizing a heat treatment process to insure that the new street
surface will not be adversely affected.
2 . Written confirmation, after inspection, from the
following city officials that the premises at 23 Nursery Street
are not now, nor in the future, utilized as a three family.
a. ) Fire Inspector
b. ) Health Agent
c. ) Building Inspector
d. ) Plumbing/Gas Inspector
e. ) City Electrician
Upon receipt of the above, I would gladly concur in the
issuance of the street-opening permit.

Dear Mr. Shea:
* Regarding a letter received by this office for the
property located at 23-25 Nursery Street , an inspection
was conducted on May 15 , 1997 with the owner of the
property. The findings are as follows:
1 . Water pressure was fair to poor .
2 . The main service line is consisted of 3/4 inch
galvanized pipe and is inadequate by todays State
Plumbing Codes .

Per request of Councillor of Ward Six, Sarah M.
Hayes , this office conducted an on site inspection of the
property located at 23 Nursery Street and have found it to
be a legal two family dwelling at the present time .
I can not confirm that this will always remain a two
family dwelling, this would be a decision made by the City
of Salem Board of Appeals , should the owners decide to
apply for a Special Permit or a Variance to change the
use . All property owners have the right to apply to the
Board of Appeals if they so choose too, this right can not
be taken away by the Building Commissioner , or any other
City of Salem Official .
