An on site inspection noted the parcel completely overgrown with weeds,
grass, trees, shrubs, etc. creating potential insect and rodent infestation
and harborage, as well as creating difficulty four pedestrian travel.
You are hereby ordered to cut, clean and remove all overgrowth and other
litter and maintain this land in a clean and sanitary manner within 14
days of receipt of this order.
Failure on your part to comply within the specified time can result in a
complaint being sought against you in Salem District Court.
Should you be aggrieved by this Order, you have a right to request a hearing
before the Board of Health A request for a Hearing must be received in
writing in the office of the Board of Health within seven (7) days of receipt

Complaints have again been received relative to the rear of a vacant parcel of land at 41 Northey
Street in Salem, said parcel owned by the Goneya family.
An on site inspection noted that a large quantity of masonary debris had been dumped to the
rear of the parcel that abuts several homes and was dumped on the property of at least one
abuttor.
This dumped debris appears to have altered the grade of the parcel, as well as of abuttors.
To the rear of 8 Woodbury Court,there is a large tree and brances fallen over onto the roof and
yard of that property owner.
We are requesting your assistance to have this debris removed and the area cleaned up,and the
portion of the tree that is hanging over the abettors property cut.
We also request that all branches of the tree that overhang to the rear of 8 Woodbury Court be
cut.
If you have any questions, please contact this office and/or Mr. Cempellin who lives at 8
Woodbury Court.

Dear Mr. Gonyea:
At our last Task Force meeting on August 19, 1993 a complaint of
debris being stored at the rear of 41 Northey Street was heard. On
August 24, 1993 I conducted an inspection and found that masonary debris
was dumped in rear of 41 Northey Street and that some wood had also been
dumped on this site. The wood pile causes a fire hazard and welcomes
unwanted rodents to the area. It is illegal to dump unwanted debris in
the rear of R-2 zoning areas without proper permits from the City of
Salem Engineering Department . You are ordered to remove this debris
from said area within 15 day upon receipt of this letter. You are also
required to contact this office when you do so. Failure to comply will
lead to legal action being taken against you.

DECISION ON THE PETITION OF ROBERT AND PATRICIA GONYFA FOR A
VARIANCE AT REAR 39 & 41 NOR= STREET (R-2)
A hearing on this petition was held on July 20, 1988 with the following Board
Members present: James M. Fleming, Chairman; Messrs. Bencal Luzinski, Nutting
and Strout. Notice of the hearing was sent to abutters and others, and
notices were properly published in the Salem Evening News in accordance with
the Provisions of Massachusetts General Laws Chapter 40A.
The petitioners, owners of the property are seeking a Variance from density
setbacks, and use to allow construction of a four (4) family dwelling on
each of the lots at the locus. The Property is located in a R-2 Zone.
The Variance which has been requested may be granted upon a finding of
the Board that:
a. special conditions and circumstances exist which especially affect
the land, building or structure involved and which do not generally
affect other lands, buildings and structures in the same district;
b. a literal enforcement of the provisions of the Criinance would
involve substantial hardship, financial or otherrise to the
petitioner; and
c. desirable relief may be granted without substantial detriment to
the public good and without nullifying or substantially derogating
from the intent of the district or the purpose of the Ordinance.
The Board of Appeal, after hearing the evidence presented at the hearing,
makes the following finding of fact:
1. Several neighbors spoke in opposition to the plan at the public
hearing.
2. The plan would add to the parking problem in the neighborhood.
3. As proposed, the plan is too dense for the existing neighborhood,
and would be detrimental to the neighborhoods quality of life.
4. As proposed, the plan would aggravate an existing water drainage
problem in the neighborhood.
5. The plans presented were deficient for a project of this scope
and magnitude.
On the basis of the above findings of fact, and on the evidence presented,
the Board of Appeal concludes as follows:
1. Special conditions do not exist which especially affect the
subject property and not the district generally;
2. Literal enforcement of the provisions of the Ordinance would not
work a substantial hardship on the petitioner;

3. The relief requested can not be granted without detriment to the

affirmative votes, is, thereby denied.
