I have initiated a proposal involving the Cogswell School Public
Property through Richard McIntosh, City Building Inspector
and James Flemming, City Councilor representing my Ward. Pursuant
to their instructions, I have forwarded a written copy of the
proposal to Richard Stafford, City Solicitor for his review,
amendment, and submission in a final form before the City Council .
This proposal will benefit both the City of Salem and the owner/
tenants of 143/1431-, North Street. Some of the congested park-
ing' on North Street at Moody Square will be reduced. Plus there
will be a heightened visibility and activity around the Cogswell
School building during the "off hours" by concerned, involved
residents.
I trust that you will view this proposal favorably. Should you
want more information or have questions, I would welcome the
opportunity to appear before the City Council or one of the
related committees .

An agreement between the City of Salem and
Jay Krauter, owner/occupant 143/1432 North Street
Permission is granted to remove 2 sections of chain-link fence, ap-
proximately 20 feet total , that runs along the common property line.
Specific location is noted on the attached Plot Plan. Removal will
be executed by Jay Krauter. The work will be of professional quality
and completely at the expense of the owner/occupant 1432 north Street.
A Right-of-Way will be granted across the Cogswell School parking lot
from the Buffum Street entrance, running close to the building, pro-
ceeding directly to the property boundry with 143/1432 North Street
as indicated on the attached Plot Plan. With the exception of one
parking space in the Right-of-Way at the common property boundry,
this Right-of--Way will not obsrtuct or interfere with any existing
parking accomodations for the Cogswell School tenants.
Permission is granted to utilize the paved area immediately adjacent
to the Cogswell School building, parallel to the 143/1432 North Street
rear property boundry, as a parking area for the owner/tenants of
143/1432 North Street. The specific location is indicated on the
Plot Plan. This will not obstruct, interfere, or reduce the size of
the existing parking accomodations of the Cogswell School tenants.
Snow removal or rubbish collection activities will not be affected
by this parking arragnement.
Owner 143/1432 North Street will be responsible for snow removal
on the owned portion of the Right-of-Way, the private parking area
on the property, and the public property, immediately adjacent to
the Cogswell School building, utilized for owner/tenant parking.
The general Cogswell School parking lot snow removal activity will
not be obstructed, hindered, or interferred with by this agreement.
The City of Salem and tenants of the Cogswell School building are
released by the owner/tenants or 143/1432 North Street from all
liabilities for damage, theft, fire, and collision to vehicles
and from all personal injuries incurred while vehicles are travel-
ing on the Right-of-Way or while parked on the Cogswell School lot.
This agreement will remain in force for such time as the Cogswell
School property is public property within the jurisdiction of the
City of Salem. At such time as the property ownership passes to
the private sector, this agreement will be rendered null and void
and will not be a condition of such transaction. However, this
agreement will be transferable and assignable to subsequent owner(s)
of 143/1432 North Street should that title be passed and the Cogswell
School property still remain public property.
It will be the responsibility of the titleholder to 143/1432 North
Street to establish a new agreement with subsequent owner(s) should
the Cogswell School property pass to the private sector. The removed
portion of chain-link fence will be restored, in a prompt fashion,
at the 143/1432 North Street owner's expense, should a subsequent
private sector owner so request in writing.
