The administrative discussion was held on: Monday, September 10, 2007. 3. JURISDICTION: The Board took jurisdiction over the facility under Section 3.3.2, in that the work performed amounted to 30% or more of the full and fair cash value of the building, therefore the entire building is required to be brought into full compliance with all applicable sections of 521 CMR. 4. FINDINGS AND DECISION: The Board having considered the evidence hereby decides and finds as follows: As a review, the following is taken from the September 25, 2007, Amended Decision of the Board: ...Ms. Diane McLeod made a motion to GRANT the date for compliance of January 1, 1008. The motion was seconded by Mr. Donald Lang and carried unanimously upon a vote from the Board. Therefore the building must be in full compliance with the submitted plans on or before January 1, 2008, with pictures and written verification that the work has been completed to be submitted immediately upon completion... On December 17, 2007, the Board discussed the North Shore Rock Prayer House, located at 127 North Street in Salem. Mr. Thomas Hopkins, Director of the Architectural Access Board, explained that the petitioners were seeking until March 1, 2008 to install the vertical wheelchair lift, a two month extension from the Board's original date of compliance of January 1, 2008. He added that there was a delay in the installation process because the petitioners needed to receive a variance from the Elevator Board for the lift to travel 14 feet, instead of the allowed 12 feet, which was recently granted. Upon reviewing the matter, Ms. Nancy Angney made a motion to allow until June 1, 2008 for the completion of the installation of the vertical wheelchair lift, with compliance to be verified via both written and visual verification, including a copy of the elevator placard issued by the Department of Public Safety State Elevator Inspector, to be submitted on or before. The motion was seconded by Mr. Robert Bersani and the motion carried pending another vote from an additional member of the Board. On December 18, 2007, Mr. Doug Semple voted in favor of the motion, therefore the motion carried unanimously. First Floor Access Option No.1: This indicates a ramp on the front of the building which clearly is not adequate to provide the appropriate run needed since we have limited room in this area, but in addition we are sitting on City property and we do not have the authority to provide such a structure nor a lift of any kind. Option No.2: Not displayed. See attached plot plan. _The rear of the building is also not available for a ramp of any sort. The maximum width ramp we could provide is approximately 24 inches,which is very constricting. Option No. 3: Side entrance. We can manipulate the existing floor within the building and the existing floor joists can be ripped at an angle to provide a sloped surface.We can also provide an automatic outward opening door to allow for access into the building.We believe we can do this without considerable structural harm to the floor. We will however need to dig into the street so that the entire lip of the ramp/door is not obstructed by the street surface—see sketch. Second Floor Access: Access to the second floor has been indicated through three means. a. Elevator b. LULA elevator c. Stair/chair lift The first two of these options would put a strain on the already delicate structure of this building. By cutting through the both floors to accommodate the installation,would place added stress to the framing system. We have also consulted with an elevator company regarding the installation of a stair/platform lift, but it was determined that both front and rear stairs were not wide enough to accommodate such equipment. The building is currently vacant and the owners are making an effort to restore it for use as a Prayer House,a place where people can come specifically for prayer.All floors will be dedicated to this activity(except the basement).The building sits right on the property line with practically no space for handicapped accessible features. The existing front steps sit on city property. The right side of the building sits right on the street. Handicapped access through the use of either a wheelchair lift or a ramp would require construction on city property which is not permitted. A ramp on the side of the building accessing the rear door would create a traffic hazard,since the building sits on the street as indicated by the enclosed photographs. We believe that cost,though it may be a consideration under alternate circumstances, cannot be considered here because of the lack of adequate property on which to build,however,a cost for implementing something of this nature would be approximately$ 50,000(including labor and material for lift,doors, demolition,finishes etc.),putting a strain on this religious establishment.As such,we are asking for a variance as described herein. An application for variance was filed with the Board by Phillip A. Kritikos (Applicant) on October 16, 2006 The applicant has requested variances from the following sections of the20 06 Rules and Regulations of the Board: Section: Description: 25.1 Applicant seeks relief from having to provide an accessible entrance. NOTE: After reviewing the material submitted to the Board by the Salem Building Department on February 20, 2007, and reviewing information obtained from the Salem assessors office, the Board determined that under permit 377-07 with a estimated cost of project value of$110,000 and an assessed value of$300,000 that 521 •CMR Section 3.3.2 has been triggered and full compliance with 521 CMR is required. The Board requires that you contact its staff, so that further assistance may be provided in seeking additional variances and or developing a plan to bring the building into compliance with 521 CMR. 2. The decision was reviewed by the Board on Wednesday,February 26, 2007 3. After reviewing all materials submitted to the Board, the Board voted as follows: CONTINUE: the variance request until information requested from the Building Department of Salem is received so that a determination of the Boards jurisdiction to require an accessible entrance can be determined under 521 CMR Section 3 et seq. (Issued on 11/17/06) DENY: the variance to Section 25.1 for the reason that impracticability has not been proven in this case. NOTE: If the work being performed is reconstruction, renovation, addition, or alteration, compliance with this decision must be achieved by completion of the project and prior to final approval by the building department. Otherwise, if the work being performed is new construction, compliance with this decision must be achieved prior to the issuance of an occupany permit. Any person aggrieved by the above decision may request an adjudicatory hearing before the Board within TO days of receipt of this decision by filing the attached request for an adjudicatory hearing. The administrative discussion was held on: Monday, July 23, 2007. 3. JURISDICTION: The Board took jurisdiction over the facility under Section 3.3.2, in that the work performed amounted to 30% or more of the full and fair cash value of the building, therefore the entire building is required to be brought into full compliance with all applicable sections of 521 CMR. 4. FINDINGS AND DECISION: The Board having considered the evidence hereby decides and finds as follows: As a review, the following is taken from the June 5, 2007, Decision of the Board: ...At this point, Ms. Berloff made a motion to CONTINUE the hearing to July 16, 2007, by which time the petitioners must resubmit a compliant plan for an entrance into the building and access to the second floor, noting that the Board will not grant variances for a ramp with a slope of 1:6 or the use of a"Stannah Stair Lift". The motion was seconded by Mr. Bersani for discussion. Mr. Hopkins noted that the AAB Staff had met with the petitioners and had encouraged the petitioners to look at alternate designs for compliance when it was determined that an exterior ramp would not be feasible due to the lot lines. Upon a vote from the Board, the motion carried unanimously... On July 23, 2007, the Board discussed an extension request regarding the North Shore Rock Prayer House, located at 127 North-Street in Salem. He reminded the Board that a hearing was held on May 21, 2007 which was continued until July 16, 2007. The petitioners have hired a new architect and were seeking a 30 day extension to the present date, to allow for the new plans to be drawn. Ms. Diane McLeod made a motion to GRANT the extension to August 23, 2007. The motion was seconded by Mr. Robert Bersani and carried unanimously upon a vote from the Board.
