All plantings, seedings, mulch, grading and other work shown on the Planting Plan is to be done per plans and dimensions as submitted, with a stamped as-built plan to be submitted by the property owner upon completion of the work; 2. An appropriate in-ground irrigation system shall be installed to water the plantings; 3. The rear of the building is to be painted brown so as to prevent glare to abutting neighbors to the rear of the property; 4. All recently added road base and mounds of"fill"to be completely removed to a depth of at least 2 feet below intended finished grade. 2. Prior to planting, add a minimum of 20 inches of top quality, screened, compost- enriched sandy loan, spread over the entire rear and side planting areas. 3. Rear and sides of property to be graded so that the slope begins at the building and gradually tapers to the top of the retaining wall with no level space. Finished grade not to exceed 3:1 (33%). 4. Excavate and install retaining wall to be built along the rear and south side of the property within 2 feet of the abutters' property lines and to be made of decorative, interlocking gray stone material beginning at a height of 3 feet in the rear next to the A&A property line and increasing to at least 4 feet in the opposite corner as well as along the south side property belonging to the Yeannakopoulos brothers on North Street. All debris previously left behind to be removed beforehand. 5. Six foot privacy fence to be replaced along the full length of both side properties, as well as extending in a perpendicular fashion to meet the rear corners of both sides of the building. 6. Drainage and soil erosion issues to be addressed by the City of Salem engineers and all recommendations for remediation/prevention of any potential problems to be incorporated into the landscape plan and carried out accordingly. 7. Maintenance Plan contract to be signed, and copies provided to one representative abutter, with a professional landscape company which will address all water and nourishment needs for a minimum of one full year, including a professional drip irrigation system to be installed such that all new plantings receive adequate and consistent watering, as well as appropriate feedings. 8. All chain-link abutters' property line fencing to the rear and sides of the property be returned to pre-construction condition: a.) Chain-link fence to rear of abutters' properties (which was damaged during tree removal) to be replaced with six foot cedar privacy fence. b.) Privacy wood fence, belonging to and abutting 16 Buffum Street, to have split rails and buckled panels (which was damaged during tree removal) replaced. 9. Escrow account to be funded by gas station property owner with $5,000.00 to be used in the event the plantings are deemed by the abutters to be too sparse. 10. All plant materials is to be of the type and size specified on the landscape drawing (attached) and to be sound, healthy and vigorous. All plant material is to have a normal habit of growth. All trees and shrubs are to be planted in accordance with industry best practices. 11. Newly planted areas are to be mulched with a top quality, true, shredded mulch, dark brown in color, to a depth of 4-5 inches. 12. Agree in writing that there will not, at any time, be any pavement of any description installed to the rear of the building and nor will there be any loading or unloading of any type to the rear of the building, via the rear door or any other egress. Also, that the trees and vegetation will never be removed or altered in any way, unless to replace a failed planting, which is to be done at the first feasible opportunity. 13. Install appropriate lighting on the property which deflects glare and spillage form abutting properties. 14. Reimburse neighbors for expenses such as landscape design and legal fees incurred. 15. Your correspondence is in response to my Order dated January 30, 2009, in which I directed that plans be submitted, prepared by a landscape professional, addressing the landscaping issues behind the building to the rear of the property. You have submitted a professionally prepared Planting Plan dated March 2, 2012, stamped by Lorayne Black, ASLA, Registered Landscape Architect in the Commonwealth of Mass aChuSCdS. You have stated and 1 have confirmed that this plan is the result of collaboration with the landscape architect hired by the abutters to the property. The Plan, as submitted, includes 35 new trees and 94 new shrub plantings, as well as ground seeding and a new retaining wall, all built upon an engineered Grading Plan as referenced in the Plan Notes. The plan is intended to provide an adequate landscape buffer between the l 1 l North Street property and the residential neighbors. After reviewing the plan, [ find that this plan meets with the requirements set forth by this office and adequately addresses the landscape buffer requirements intended in the 1970 Zoning Board of Appeal Decision for the property. Flowever, because this plan incorporates all new plantings, which will take time to mature, the following conditions are put into place to insure successful and maintained growth of the landscaping, so as to achieve fuller screening and buffering of the property in the future. Conditions: t. All plantings, seedings, mulch, grading and other work shown on the Planting Plan is to be done per plans and dimensions as submitted, with a stamped as-built plan to be submitted by the property owner upon completion of the work; 2. An appropriate in-ground irrigation system shall be installed to water the plantings; 3. The rear of the building is to be painted brown so as to prevent glare to abutting neighbors to the rear of the property; 4. To insure the plant material thrives and matures, the owner shall not stockpile snow and ice, often containing salt and sand, on the planting beds; 5. Soft security lighting only shall be installed to the rear of the building; 6. All debris, dirt piles, etc. are to be removed from the property prior to the issuance of a Certificate of Occupancy; 7. The plantings are to be guaranteed by owner for a minimum of two years. Any planting that dies or fails to thrive is to be replaced at owner's expense. To ensure plantings are replaced as necessary or that more may be added if deemed necessary by the City, the owner agrees to deposit $3,000.00 in an escrow account held by the City of Salem for a period of two years with my unused balance to be returned to the owner after two years; S. After purchasing the Property last September, Tricked proceeded to compieteiy clear ali the existing trees, shrubbery and other vegetation behind and on both sides of the Property. This action was a clear violation of a Special Permit issued by the City of Salem Zoning Board of Appeals in August, 1970, notice of which was recorded with the Essex South District Registry of Deeds (copy attached). The Permit, which allowed the construction of a service station on the site, specifically required the property owner to leave all trees to the rear of the property undisturbed. The record of the proceedings before the Board of Appeals makes it abundantly clear that the Board issued the permit upon conditions which preserved the natural and dense screening between the residential properties on Buffum Street and commercial activity of a service station. Myclients have tried over the course of several months to work with Trickett to solve the problem', however, we have encountered nothing but empty assurances and missed deadlines. Hearing was held on this appeal pursuant to notices mailed postpaid to the petitioner, abutters, board members, and others, and advertisements published in the Salem Evening News. All Board members were present , excepting Mr. Doyle who was unable to at- tend. Counselor David T. This plan is the result of much review, discussion and study of the site by both Ms. Black and Mr. Blier, the landscape architect hired by several of the abutters.
