To whom it may concern:
It has come to my attention that the City of Salem does not have a Sign Permit on file for the above
referenced establishment. As you are aware,your storefront is occupied with several banner signs. The
Salem Sign Ordinance only permits banners signs as a means of temporary signage, used for
advertisement of special sales or events. Banner signs cannot be permitted as permanent signs. All
exterior signs, awnings,and interior signs that can be seen from the exterior require a City of Salem Sign
Permit prior to fabrication and installation. Therefore,you are in violation of the Salem Sign Ordinance
and your current signage is considered illegal. You are directed to immediately remove your illegal signs
and contact this department to find out the steps necessary to apply for a sign permit.
If you no do not respond within seven (7) days receipt of this letter, this matter will be forwarded to the
Building Commissioner who may enforce the penalties and fines under §3.36 and §3.29 of the Salem
Sign Ordinance and 780 CMR §3102.4 of the Building State Code.

lie following is a brief summary of some of the legal remedies tenants may use in order to get housing code violations

1.:Rent Q(Massachusetts General laws Chipter 239;section 8A): If Code Violations Are Not Being Corrected you
may be entitled to hold back your rent payments.You can do this without being evicted if-
A. You can prove that your dwelling unit or oommon areas contain code violations which are serious enough to endanger
or materially impair your health or safetyand'that your landlord kiiewabout the violations before you were behind in-

violation of the consumer protection act and regulatious, for which you may sue an owner

On September 21, 1998 , the Building Department
conducted an inspection of your property located at 99
North Street.
During our inspection we found the following building
code violations:
1 . Remove plywood from emergency egress windows in
bedrooms.
2 . Repair exterior and interior egress doors to operate
properly.
3 . Install door closers were needed on exterior doors .
4 . Install proper fire separation between all units.
5 . Install exterior lighting at means of egress .
6 . Certificate of Occupancy and Inspection shall be
obtained for all units .
Please contact the Building Inspector upon receipt of
this letter to inform us as to what course of action you
will take to rectify this situation.

Based on the plan reviewed at the Salem Health Department on February 27, 1990,
the Health Department makes the following recommendations:
- Plan item 1114 to be a stainless-steel, three-compartment sink with
drainboard for warewashing.
- Plan item 1113 to be a one compartment product-washing sink.
- In addition to the handwashing sink located at the front of the
cooking line, an additional stainless-steel, wall-hung handwashing
sink is to be installed adjacent to the product washing sink.
- Hot and cold mising valves to be installed under the handwashing sinks
to allow a hose hook-up for floor and surface wash down.
- A hot and cold mixing valve over a floor drain surrounded by a splash
guard to be located outside of food preperation area for washing of
mops, trash cans, and other cleaning equipment.
- Walls and ceiling in food preparation areas to be covered with an
impervious, easily cleanable surface such as "Glassboard" or a similar
material. contact Fire Prevention (745-7777) for information on surfaces
which must conform to Fire Prevention Codes.
- Floors to be covered with ceramic or quarry tile or an equivalent imper-
vious, easily cleanable surface. Suitable coving to be installed at
floor-wall junctions to prevent accumulation of grime or food debris
in crevices.
- All equipment to be constructed of stainless steel or an equivalent smooth,
easily cleanable material. Equipment to be installed with adequate space
surrounding it to allow for regular, effective cleaning.
- Floor drains to be installed in food preparation area. Floors should be
pitched to allow for drainage of the entire kitchen area:,

A hearing on this petition was held January 31 , 1990 with the following Board
Members present: James Fleming, Chairman; Messrs. , Bencal, Febonio, Luzinski
and Associate Member Dore. Notice of the hearing was .sent to abutters and others
and notices of the hearing were properly published in the Salem Evening News in
accordance with Massachusetts General Laws Chapter 40A.
Petitioner, owner of the property, is requesting a Variance from the minimum
parking requirements to allow a take-out Chinese Restaurant.
The Variance which has been requested may be granted upon a finding by the
Board that:
a, special conditions and circumstances exist which especially affect the Land,
building, or structure involved and which are not generally affecting other
lands, buildings and structures in the same district;
b. literal enforcement of teh provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner; and
c. desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of
the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented and
after viewing the plans, makes the following findings of fact:
1 . The site was previously used as a commercial establishment.
2. There are seven (7 ) parking spaces of site for use by building
occupants and customers.
3. Restaurant would be used as take-out only.
4. There was not opposition to the requested variance.
On the basis of the above findings of fact, and on the evidence presented, the
Board of Appeal concludes as follows:
1 . Special conditions exist which especially affect the subject property but
not the district generally.
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship to the petitioner.
3. The relief requested can be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of
the district or the purpose of the Ordinance.

Therefore, the Zoning Board of Appeal voted 4-1 (Mr. Dore voted in opposition)

Prevention Bureau relative to smoke and fire safety.
2. Renovations must be in accordance with the Salem Building Code.
3. Petitioner must comply with the requirements of the Salem Health Dept.
4. Hours of operation are limited to 11 :30 a.m. to 9:00 p.m. , Monday
through Thursday; 11 :30 a.m. to 10:00 p.m. Friday & Saturday; and
11 :00 a.m. to 9:00 p.m. on Sundays.

The following Is a brief summary of some of the legal remedies tenants may use In order to get housing code violations
corrected: ....
1. Rent VTthholdine(Massachusetts General Laws,Chapter 239,section 8A): If Code Violations Are Not Being Corrected you
may be entitled to hold back your rent payments.You can do this without being evicted if:
A. You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger
or materially impair your health or safety and that your landlord knew about the violations before you were behind in-
your rent
B. You did not cause-the violations and they can be repaired while you continue to live in the building.
C. You are prepared to pay any portion of the rent into court if a judge orders you to pay it. (For this,it is best to put the
rent money aside in a safe place.)
2. Repair and Deduct(Massachusetts General Laws,Chapter 111, section 127L):The law sometimes allows you to use your milt . .
