Board Members present at the July 27, 1994 meeting were: Stephen Touchette, Chairman; Gary Barrett, Nina Cohen and Albert Hill. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioners, owners of the property, are requesting Variances from rear and side setback requirements to replace existing structures, tanks, canopy and to allow a third curb cut. The property is located in the B-i/ECOD district. The Variances which have been requested may be granted upon a finding by this Board that: 1. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures involved. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioner. 3. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1. There was no vocal opposition to the petition. 2. The petitioner was cooperative and amenable to addressing the concerns raised by interested citizens and representatives of the City at the public hearing. 3. Correspondence was received from Owen Meegan; Staley McDermet, William Luster, City Planner; and Gary Jerome, Construction Supervisor for Merit. 4. Merit has agreed to remove the now existing billboards on the property. 5. Merit has further agreed to submit its proposed signage plan for review and approval to the Entrance Corridor Sign Review Committee. 6. Fire Inspector was in favor of the increased curb cut on Northi%ree� as requested by the petitioner for safety reasons having to do wrath L traffic concerns on North Street and in and out of the station. 8. Merit has agreed to work with the Planning Department to assure that the trees to be planted along Franklin Street are similar to others in the area. 9. Merit has reduced the northernmost curb cut on North Street to 30 feet, and it has maintained a 40 foot southernmost curb cut on North Street. 10. Merit has agreed to lay concrete sidewalks along North and Franklin Streets abutting its property. It has further agreed to install a handicapped ramp at the corner of North and Franklin Streets, and to further install curbing along Franklin Street to maintain a sidewalk of five feet in width. 11. The City Planner suggested petitioner plant trees along the North Street side of its property. Merit objected to said suggestion for safety reasons as the trees might impact visibility and ingress and egress. 12. The requested third curb cut will be used by tanker trucks making fuel delivery to the station, and will be utilized for cars exiting on Franklin Street. This will have a positive impact on traffic safety. 13. The placement of certain telephone poles affects the petitioners ability to change the placement of its requested curb cuts. 14. The petitioner has agreed to several other details in the layout of its station as set forth in a letter dated June 28,1994 from Gary Jerome to the City of Salem Planning Department, Zoning Board of Appeal and Fire Prevention and a letter dated July 22, 1994 from Gary Jerome to William Luster. On the basis of the above findings of fact, and on the evidence presented at the hearing, the Board of Appeal concludes as follows: 1. Special conditions exist which especially affect the subject property but not the district in general. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship to the petitioner. 3. Desirable relief can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. Therefore, the Zoning Board of Appeal voted unanimously, 5-0 to grant the variances requested, subject to the following conditions: 1. This store has 424 square feet of storage area, which includes only areas that are inaccessible to the public, such as those areas located behind the coolers, in the utility room, etc. Therefore, the correct parking calculation is as follows: 1, 660 square feet of gross floor area, minus 424 square feet of storage area = 1,236 square feet of floor area, divided by 150 square feet/per space = 8.24 or 9 spaces. However,after reviewing the plans, I must disagree with the information provided to you and with the Engineer's calculations as presented, and ask that you reconsider your decision for the following reasons: 1. There is no storage area shown on the original floor plan of the proposed building(Sheet 5)as submit- ted to the Board of Appeals. Areas are designated on the plan as: SALES, CASHIER,OFFICE, WOMEN, MEN, HALL, UTILITY, and COOLER. All spaces are labeled and no storage area is designated. 2. In response to my complaint,the engineer has submitted a plan on which a number of the above areas, totaling 424 square feet, have also (in addition to their original designation) been designated as storage areas for the purpose of determining required parking spaces. I disagree with the labeling of these areas as storage for the following reasons: a. One area cannot be designated for two uses. b. The engineer has designated the entire OFFICE area as storage. An office area by its title and use is obviously not a storage area. c. The engineer has designated the entire CASHIER area as storage. A cashier area by its title and use is obviously not a storage area. d. The engineer has designated the entire UTILITY area as storage. A utility area by its title and use is obviously not a storage area. Furthermore, a triple sink, an optional hand sink, and another piece of equipment are shown in the UTILITY area. Triple sinks and hand sinks are used in food preparation areas, again, not a storage area. e. The engineer has designated a portion of the COOLER as storage, with no explanation as to why a portion has been designated storage and the remainder has not. I submit that none of the cooler should be considered storage for the following reasons: I)The contents of the cooler are visible to and accessible by the public. Many stores stock their shelves and display racks with multiple items of a product, and all items on display are for sale and each is accessible for purchase. One does not have to buy the first item in a display. Indeed, many consumers will search through items to find the freshest, be it milk, aspirin, batteries, etc. Therefore, none of the contents of the cooler should be considered to be in a storage area. Fur- thermore, any aisle within the cooler providing access to the cooler's shelving(none is shown) cannot be considered storage, as it exists only to access the shelving. 2)Additionally, what appears to be an insulating wall along the exterior wall is designated as storage area. This is incorrect. It is a wall and not storage. f. Additionally,the contents of the storage area cannot be visible to the public (otherwise it's a display area) and cannot be accessible to the public (otherwise it's a sales area). To permit non-storage areas to be deducted from the calculations for required parking can only result in insufficient parking spaces being provided. 3. The situation with this proposed store is not that a storage area was not provided or accurately labeled on the originally submitted plans. Those submitted plans show that a significant amount of storage has been provided outside of the proposed new building. (Sheet 2 shows "EXISTING STORAGE BUILDING (TO REMAIN)"). The fact that this exterior storage was sufficient and that no storage was originally planned inside the new building is further demonstrated by the fact that the zoning analysis on the originally submitted plans did not deduct any storage area from the proposed new building in calculating parking spaces re- quired. Rather,the "ZONING ANALYSIS TABLE" on sheet 3, for "PARKING CRITERIA" shows "RETAIL USE: 1 SPACE PER 150 SF GROSS FLOOR AREA. 1660 SF/I 50= 11.06 (12 SPACES REQUIRED)". Even though the entry for "PARKING SPACES- REQUIRED" has been crossed out by hand and the number "9" written in, the "12 SPACES REQUIRED" under "PARKING CRITERIA" was not modified. This 12 spaces required matches exactly my October 9, 2003, and present contention that 12 spaces are required. The response and submission by the engineer appears to be an after-the-fact attempt to invent storage areas in order to circumvent the Zoning Ordinances' parking requirements. 4. Finally, the proposition that plans submitted to, reviewed by, and on which a decision is based by the Board of Appeals can be changed, elaborated on, or added to after the Board has made and recorded a decision is highly questionable. Specifically,the plans submitted to the Board a) show no storage area, and b)do not even refer to a deduction for storage area in order to determine parking requirements. On the contrary, the criteria on the submitted plans show 12 parking spaces required. Only a hand- written revision in another area(with no explanation or comment)contradicts this requirement. The result is partial, misleading, and contradictory information that the Board of Appeals was not aware of. Consequently,the Board did not have all the necessary information when they considered and granted the variances requested. It is too late to now provide information that would have been significant and relevant to the Board's decision. In summary, I submit that the 424 square foot reduction for storage area proposed by the Engineer is un- substantiated and incorrect, that the project requires 12 parking spaces, and information that should have been supplied to the Board of Appeals and that would have had a direct bearing on its decision cannot now be added to the plans or considered. Therefore I ani asking that you reconsider your October 23, 2003, decision and reinstate my October 9, 2003, complaint that the Salem Zoning Ordinances require 12 parking spaces for this project and only 9 are being provided. MAYOR DECISION OF THE PETITION OF AMERADA HESS CORPORATION REQUESTING A VARIANCE FOR THE PROPERTY LOCATED AT 86 NORTH STREET B-1 A hearing on this petition was held October 16, 2402 with the following Board Members present: Nina Cohen, Joan Boudreau, Stephen Harris, Nicholas Helides and Joseph Barbeau. Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. The petitioner is requesting Variances for side yard setback and Section 7-2 of the Salem Zoning Ordinance to construct a convenience store and one new pump location for the property located at 86 North Street located in an B-1 zone. The Variances, which have been requested, may be granted upon a finding by this Board that: a. Special conditions and circumstances exist which especially affect the land,building or structure involved and which are not generally affecting other lands,buildings and structure involve. b. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioners. c. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district of the purpose of the Ordinance. The Board of Appeal,after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: I. Attorney Joseph Correnti,63 Federal Street, Salem,represented the Petitioner Amerada Hess Corporation, the owner of the property located at 86 North Street. 2. On this site,Petitioner operates a gasoline service station, which presently has nine gasoline-filling positions, four vacuum cleaner positions and a kiosk used for retail sales and payment. The site has been used as a gasoline filling station continuously since at least 1964 and has been run as a 24-hour operation since at least the 1970s. 3. The business has a retail sales component and office use, both of which are allowed uses in this B-1 zoning district. DECISION OF THE PETITION OF AMERADA HESS CORPORATION REQUESTING A VARIANCE FOR THE PROPERTY LOCATED AT 86 NORTH STREET B-1 page two 4. The proposed plan, as submitted, seeks to eliminate the kiosk and vacuum cleaners, add a Hess Express convenience store at the rear of the property,add a new gas pump with two filling positions in place of the kiosk and replace one existing single pump with a double pump(adding one filling position)for a total of 12 filling positions. 5. The Petition seeks Variances from the side and rear setbacks to allow the construction of the building as shown on the plan, and variances to the lot area and frontage requirements to accommodate the additional pumps. Without these variances,the Petitioner would suffer a hardship, as the size and shape of the lot would not allow the present configuration or any improvements thereto under current zoning. 6. The Board finds that the proposed plan will improve traffic flow on the site by moving the retail sales and payment counter to the rear of the property. The plan will improve traffic flow into the site by changing the existing North Street curb cut closest to Franklin Street to an "entrance only," thus eliminating an awkward egress that crosses oncoming North Street traffic. These improvements in traffic flow will benefit the neighboring properties. 7. The proposed retail structure, which is approximately 1,660 square feet, will be of brick construction with an asphalt shingle roof, features suggested by the City's Planning Department and adopted by the Petitioner. 8. Except for the above design features which petitioner incorporated into the proposed plan, the Board found that some elements of petitioner's design were not sensitive to the predominent architecture of the area and to the site's prominent location in an Entrance Corridor District. The Board took the unusual step of mandating that specific changes to the design be approved by members of the City's Planning Department before a building permit could be issued. The design changes which must be approved are the following: removal of the green and white checkered banding from the building exterior, replacing steel pillars with brick pillars, and reconfiguring the glass entryway and white soffit with a more historically appropriate design, such design to be approved by the Assistant City Planner and her staff. 9. A petition in support of the project was submitted and signed by four abutting businesses. 10. There was no opposition to the Petition. On the basis of the above findings of fact, and on, the evidence presented at the hearing, the Zoning Board of Appeal concludes as follows • DECISION OF THE PETITION OF AMERADA HESS CORPORATION REQUESTING A VARIANCE FOR THE PROPERTY LOCATED AT 86 NORTH STREET B-1 page three 1. Special conditions exist which especially affect the subject property but not the district in general. 2. Petitioner shall comply with all city and state statutes, ordinances, codes and regulations. 2. All construction shall be done as per the plans and dimensions submitted. 3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 4. Petitioner is to obtain a building permit prior to beginning any construction. 5. Exterior finishes of the new construction shall reflect the surrounding neighborhood, which includes: a. The Hess Express building shall be constructed of clay brick; b. The roof of the proposed building shall be finished with asphalt shingles; c. The front doorway to the building shall be redesigned with the input and approval of Denise Sullivan, Assistant City Planner; d. The green and white checkered banding shown on the building shall be removed from the design; and e. The entrance columns shown on the plan will be clad in brick. 6. A Certificate of Occupancy shall be obtained. 7. Petitioner shall obtain proper street numbering from the City of Salem Assessor's Office and shall display said number so as to be visible from the street. Petitioner is to obtain approval from any City Board or Commission having jurisdiction including, but not limited to, the Planning Board. 9. The Petitioner shall take all reasonable measures to prevent loitering on the premises and monitor any continuing misuse thereof, particularly during the weekend evening hours. Such measures shall include, but not be limited to, maintaining two or more employees onsite at all times so that the exterior of the building can be monitored regularly, and training such employees on the detrimental effects of loitering on the neighborhood and on business. 10. The Petitioner shall not display any products(including soda) outside the building itself and will avoid the use of sandwich signs on the premises. 11. All deliveries shall be done in accordance with the City Ordinances.
