DECISION ON THE PETITION OF MR. AND MRS. GARY SACKRIDER REQUESTING A VARIANCE
FOR 19 NORTH STREET
Pursuant to a proper notice of public hearing, a public hearing was held on
September 12, 1979 and continued on September 26, 1979 on the petition of Mr, and
Mrs. Gary Sackrider requesting a variance to renovate the building at 19 North
Street and to use the structure for three law offices and an office for a steno-
graphic reporter's office and two apartments. A variance is required because
the building is in an R-2 district (Two-family residential) where the proposed
use is prohibited without a variance.
The Board of Appeals, after consideration of the evidence presented at the
public hearing and after viewing the property makes the following findings of
fact:
(A) the location in question has been vacant for over a decade.
The building is currently in disrepair. The prior use for
the building was as a boarding house.
(B) the building in question is in close proximity to B-3 zoning
where the proposed use would be permitted.
(C) the building is in close proximity to several other buildings
which are used for businesses and law offices.
(D) the proposed use of the building presents a positive improve-
ment in the area in question and will benefit the public interest,
(E) the proposed .use of the building in question is strongly
supported by those in the neighborhood.
On the basis of the above facts, and the evidence presented at the public
hearing, the Board of Appeals concludes as follows:
(1) The unique character of the structure at 19 North Street
together with its current state of disrepair renders it
impossible to utilize the building for any purpose without .
the grant of a variance.
(2) The conditions described above especially affect the structure
in question but do not generally affect the zoning district
in which the building is located. The structure in question
is unique because of its age, its prior use and its current
state of disrepair.
(3) The conditions described above which affect the land in question,.
but not the zoning district generally cause the following special
hardship: without the grant of a variance the structure cannot be
utilized and will remain in disrepair.

(4), The desired variance may be granted without substantial
detriment to the public good because the renovation of
this building will improve the appearance of the neighbor-
hood, increase property values and in no way adversely
affect the property rights of others.
(5) The requested variance may be granted without derogating
from the intent and purpose of the zoning ordinance for
reasons stated in Paragraph No. 4 above.
Therefore, the Board of Zoning Appeals with Chairman Boulger and Messrs.
Nutting, LaBrecque, Piemonte and Feeherry voting unanimously in favor of granting
the requested relief, grant a variance to the petitioners on the following terms
and conditions:
(1) The variance is granted to use 19 North Street for three
law offices and a stenographic reporter's office and two
apartments.
(2) All renovations at the site will be in conformance with
plans submitted to the Board,
(3) Ten off-street parking spaces will be maintained at the
property.
(4) The exterior stairway at the site will be enclosed, with a 1k
hour fire-rated wall of masonry material on the face of the
stairway exterior wall.

SPECIFICAYI NSYt The City of Salem invites sealed proposals for the relocation ohe
dwelling located .at 19 North Street, Salem, Mass.
All proposals shall be made upon the bidder 's letter head and delivered
in a sealed envelope to the office of John J. O'Rourke, Superintendent of
Public Property, City Hall, Salem, Massachusetts, on or before 10 A.N.
Tuesday, April 27, 1943. The sealed envelope must be marked; "Proposal for '
Relocation of Dwelling at 19 North Street, Salem, Mass. ",
CHECK TO ACCOMPANY PROPOSALS:
Each proposal must be accompanied by a properly certified check for the
sum of four percent (4%) of the amount of the bid, payable to the City of
Salem. This check shall be enclosed in the sealed envelope containing the
proposal and no proposal will be considered unless accompanied by said check.
All deposits except those of the three lowest bidders will be returned to
the persons making them within three days after the contract is awarded.
After the award of the contract all checks will be returned to bidders,
r ` except the check of the successful bidder which will be retained until an
approved bond,. as specified below, -has-been delivered to the Owner. y
BOND
A' satisfactory bond will be'required to insure the faithful performance
*of the contract and payment for all labor performed or furnished and for all
materials used in carrying .out this contract in a sum to be• determined after
the bids are opened. This sum� will be not less than fifty percent (500- of
the contract amount. This bond shall continue in full force until the work.
is completed and approved by,the Superintendent of Public Property. These
bonds shall be ° issued by one or more surety companies as approved by the
Superintendent of Public Property,. and the premium on the bonds shall be paid
by the Contractor. In lieu of a bond the Contractor may deposit money with
the City, of Salem in the amount of such bond.
ACCEPTANCE OF PROPOSAL AND SIGNING 'OF CONTRACT:
The contract must be signed and the bond .or other security furnished
within six days (Sunday excepted) after the date the contractor is notified
by-the-City of Salem, of the acceptance of the proposal and readiness of the
contract for•°signature. If the bidder fails, after such notification, to
sign the contract and 'to furnish bond within the said time, the City of
Salem, may, at its option, determine that"the-bidder has abandoned the
contract and thereupon the proposal and award shall"be null and void, and
the City of Salem shall be at liberty to make other contract with other
parties for the work as it sees fit.
SUB-CONTRACTS:
No sub-#ontract is to be let unless approved by, the 'Superintendent of
Public Property. Blocking up and actual moving of the building must be
performed by, an experienced Building Mover now engaged inethis type of work.
In letting out sub-contracts for heating and plumbing, preference must be
given to local heating and`plumbing contractors. , .
PLANS, SURVEYS, MEASUREMENTS, ETC. :. '
Plans , srveys, measurements , dimensions, statements as to the
conditions under which the work is to be performed, etc. , are believed to
be approximately correct , but the Contractor shall visit the site and by
his own investigation and research satisfy himsdlf regarding all conditions
affecting the work to be -done and labor and materials required, and make
his bid in reliance thereon.

PAYMES.
Before any payments are made the Contractor shall submitAto the
Superintendent of Public Property for approval a proper sub-division� of
contract. On the twenty-fifth day of each month he shall submitto the
Superintendent of Public Property a-.request for payment , on an approved form,
for the amount of labor and materials in in the building, up to and
including that Sate..

The Superintendent of Publb Property%,will .issue monthly certificates
of .payment for 85% of the Contractor's application as approved, on 'the First
of each month. Payments will be made on or about the 'lOth of each month.
REJECTION OF BIDS:
The competency and responsibility of bidders and of their ,p$R"posed
sub-eontractor.will be considered in making the award. _ t

GENERAL CONDITIONS: '
The Contractor shall submit' a ,lump sum bid to relocate the dwelling, ,
furnish all necessary materials and to 'complete all work in accordance with
•these specificationsand. ,the attaclied plan that is made part of these
SpeciYicationa. .
It is optional with the Contractor to use the stone from the present
foundation or furnish and install a new concrete+foundation. Ifstone is
used the ' foundation walls shall be aot :less than 16" tlifckrand the underpinning .
walls shall• not ,be less than 12" thioko . All stones':shall be entirely embedded,
. —in cement mortar and the entire wall faced and properly pointed on both sides.
-Cement mortar shall be madeoftceinent and; sand in the proportion of one, part
of cem�nV and•.not more .than' three parts of sand and shall-be used immediately
after` mixing. It is optional with the contractor to r'emo.ve,= clean.and replace
that .xisting brick underpinning wall on the south si.de,bf the house or furnish
and install a 12"•stone underpinning wall at this section:'
If 'conerete is used the foundation°walls shall be not, less than 12"
thick on a footing of poured concrete 16" wide;and 10" deep. The concrete_
foundation .wall, is to be carried up to 3" below finished grade. The
underpinning walls shall be the same as required if stone foundation were used.
A11 concrete in foundation wall shall be 1:2:4' ready mixed. The new cellar
floor is to be -,311 concrete over the entire 'area of the'-cellar, poured over
`4" •of cinders properly tamped. Cellar floor concrete shall be 1:2a:5 ready
mixed. Column supports in cellar shall be in the same relative position under
the dwelling as at present. These columns may be 12"x12 brick or replace
with, 426" genuine sally columns. Column,,e 2d=himney foundations shall be 1.2:4
ready mix concrete and shall extend not less than 2!. below the cellar floor. ,
The bearing area of the column and chimney foundations shallbe -determined
the Superintendent' of Public Property. . 'The bearing area for columns shall in
no case'be less than. 4.,•sq. ° ft.
The -dwelling when relocated is to set 'the. same ,reikktive elevation with '
reference to the proposed sidewalk as it now sets in •relation to the existing,
. sidewalk.
The distance from the finished concrete cellar floor to the underside
of the .floor joist shall be 7'-4".
The contractor will relocate heaters , pipe lines and all other
facilities and complete all work to provide all facilities' in the new location.
The contractor is to protect ceiling over the heater with rocg lath
and J" of plaster to 6' outside the heater in all directions. i,
Cellar windows are to be relocated in the same relative position as
at present. Damaged frames , sash or glass must be replaced with new.

All chimneys A to be provided-, with a 7"x9" cleanout door at each flue.
Bottom of cleanout 'doors to be 6" above cdllar floor.
Contractor is to rebuild all partitions in cellar as shown on attached
plan. Material from existing partitions may be used except any material
damaged as a result of this work shall be replaced with new.
Contractor will install a new concrete walk on the north and west. side .of
the dwelling as shown on attached plan. Concrete to be 1:2:4 ready mixed; 4" ;'.
thick and poured over 8" of cinders or crushed stone properly tamped in place. =
Contractor will .replace sill of piazza at south side of the house.
Piazza columns are to be relocated and set in concrete foundation carried 3'f
below grade.
Contractor will remove a 121 section of fence to provide a temporary
driveway to this property from the rear of the adjoining property owned by the,
Order of Elks. . This fence is to be replaced at completion of the work.
The water pipe to the storehouse at the rear of the dwelling is to be
maintained; relocated if necessary- and left in good condition at completion
of -the work. ,
Y The granite -comer posts, and curb at the front of this property, along `
. the back of the present "sidewalk are to be- relocated in the same relative
position with reference to the proposed sidewalk. Back fill between this curb
and the front of the house with 18" of loam to provide for planting.
Theyproposed street line and grade at the back of the proposed sidewalk
will be staked out by 'the City. of Sal em. ' ' From this line,and grade the'

contractor will set all .necessary lines and grades for the relocation-of the , F :
dwelling and will be held responsible for .same , ; '
Trees deemed necessary to be removed will be removed to grade by the City
of Salem;'
The contractor will contact the City and other various Public Service .
Companies for -the relocation of p6leb, wires, pipes , etc. Any expense 'for this -, ;
work will -be paid for by.the contractor:
All material of any value to the owner now -stored in the cellar will be
removed by the owner of the propertybefore the contractor starts any work in
the 'cellar.
At completion of the work all new woodwork is to be painted three coats
/to match as near as possible the existing paint on this dwelling.
The 'contractor is to have a competent foreman on the job at all times
`who .is •to give his personal superintendence and direction to the work, . and '
, the contractor is to furnish all .transportation, labor, materials, apparatus ; i
scaffolding, and all utensils needful for performing his work in the best
manner, according to thetrueintent and meaning of these specifications and
the planswhich accompany them.
Contractor' sh`all obtain and .pay for workmen's compensations and public
liability insurance covering the entire work and must assume all risks and bear
all losses occasioned by neglect or accident during the progress of the work. ,,;
A certificate to show that the insurance clauses in the contract are
complied witli must be furnished by the contractor to the City in accordance
with the law.
The contractor shall at all times cover and pretect his work and the
material to .,be used therein, from damage by weather or otherwise , and shall, r
repair and make -good any damage thus occurring. .
The contractor_ shall remove all dirt and rubbish resulting from his work, '
from time . to time as the Superintendent of Public Property shall direct and
shall make the premises neat and tidy delivering the building. at the completion
of the work clean and whole and tight and fit for occupation` 44'

Any omission to disapprove the work at the time of inspection or at the
time of any monthly or other estimate shall not relieve the contractor of
any of his obligations, and sll work of whatever kind, which during its
progress and before it is finally accepted, may become damaged from any cause
shall be removed and replaced by good and shtisfactory work.
LABOR: _ --
In the employment o.f mechanics and laborers,, preference must be given to
citizens of Salem who are United States War veterans and",secondly to citizens
of Salem who have families or monor children dependent upon them for support,
and =thirdly to citizens of Salem generally; provided that no competent and
faithful mechanic or laborer shall be discharged to make place for anohher.
In compliance with Chapter 461 , Acts of 19.35., the attached schedule of
minimum wages must be paid as determined by the State of Massachusetts
Department of Labor and Industries.
EXAMINATION OF SITE:
Before submitting his estimate , the contractor. shall visit the site,
examine the condition and thoroughly acquaint -himself with the obstacles and
advantages for performing the work. He shall study the drawings explanatory
of his contract and 'compare them wit$ the information obtained by his
examinaft6n of the cite, as no extra charge will be allowed for -extra work
caused by his unfamiliarity with the site or drawings.

contract.
