Revocation of previously issued Building Permit(B-16-357)
Dear Mr.St. Pierre
This letter shall serve as notice that J. Calnan & Associates, Inc. will NOT be the
contractor to perform the work as per the previously issued Permit mentioned above.
The owner has decided not to proceed with this project with J. Calnan & Associates
acting as General Contractor as well as Packard Design as the architect of record.
In the event work does occur within the "Lab Improvement' space, I would expect that
that you should receive a new application for permit as well as a new set of drawings
as it would not be J. Calnan & Associates nor Packard Design performing this work
under the current CSL you have associated with this permit #.
To that end, please advise as to how J. Calnan & Associates would be reimbursed for
the permit fee.
Should you have any questions, please feel free to contact me at your earliest
convenience. I can be reached via email at dferreira@icalnan.com or via cell at (781)

Thank you very much,

Subject: Reimbursement request
Good morning.
Mr.St. Pierre just forwarded me your letter. We have attached your letter to the permit showing that you are not the
contractor on this project.
Unfortunately, any and all requests for reimbursement must come from the party asking for reimbursement to the City
Council President directly. We cannot submit anything on your behalf.
The letter should be addressed to:
Josh Turiel
City Council President
City of Salem
93 Washington St.
Salem, MA 01970
In your letter you need to include the permit#B-16-357. You also need to include the check amount and the check#.
This request will then go before the City Council and they will make
a determination and get back to you.
Any and all correspondence should go directly to them.
Hope this helps.

RE: Proposed Wireless Communication Facility
39 Norman Avenue, Salem,MA
Ms. Sullivan:
Pursuant to our conversation, Southwestern Bell Mobile Systems, LLC, d/b/a
Cingular Wireless, requests a detetnnination of the zoning process for the above
referenced location and proposed facility_
You had indicated that all proposed wireless service facilities previously have
been approved through a Special Permit process. However, the language of your bylaw
is as follows: "Section 2 6)Personal Wireless Service Facilities: A Wireless
Communication Facility(WCF) can be located and allowed as a matter of right
provided it is located within or on a pre-existing nonresidential building or municipal
stntctum. " The Cingular proposed facility shall be on the roof of the Holyoke Square
MassMutual building_ We believe that we meet all criteria for a building permit only
permitting process,
Please refer this letter to your City Solicitor for review. 1 would available to
speak to him or her at any time at 617.538.0006. The date for filing for a Special Permit
on this site would be August 16, 2001. 1 would appreciate an answer by August 10`s to
ensure that I can file for the Special Permit,if necessary. Thank you for your assistance
in this matter.
very yours,

RE: Wireless Communication Facility (WCF)
Dear Ms. Sullivan:
You have asked for an opinion (clarification) relating to the above captioned
matter as pertains to inquiry of Cingular Wireless. In short, I believe Mr. McNeal
is correct in his interpretation of the ordinance. So long as placed on a pre-
existing nonresidential structure or municipal structure, a WCF applicant only
needs a building permit from the building inspector once meets other conditions
(ie. not more than 15 feet above building).
As you may recall, we have discussed changing this by right for only municipal
structures. Presently, however, the ordinance stands as originally drafted.
Hopefully this information is helpful. Do not hesitate to contact me with any
questions pertaining to same.

RE: Wireless Communications Facility Ordinance
Attached please find a letter from Johathan McNeal concerning our Wireless Communications
Facility Ordinance. In the past, the Planning Board has required antennas located on a structure
to undergo the special permit process.
Mr. McNeal has questioned the Board's interpretation. He feels that antennas proposed to be
located on a residential structure require a special permit and those located on a non-residential
building are allowed by special permit. This has not been the Board's interpretation to date.
Could you please review the ordinance and provide the Board with clarification as to how to
interpret this issue? Thank you in advance for your assistance in this matter.

James F. Brennan, Chief
Salem Fire Department
Sirs
Following is a report of conditions found to exist at the new
portion of the Holyoke Insurance Co. office building as a result
of several inspections conducted within the past ten days.
1. Protection guard rail has been provided as requested for air
handling unit located in lower level garage. The unit located
on the first floor level still requires protection.
2. It is to be noted that all sprinkler heads located in the garage
levels are still covered with tape , because the painter is not
throub i with his eel .ing This portion of the work should
be completed as soon as possible as the heads are not in proper
condition to serve in case of emergency. This is especially
important in the lowere level garage presently occupied under
a temporary occupancy permit.
3. Certification of the carpeting installed on all office floor
areas has not been received by this office. We have no flame
spread or smoke contribution ratings.
4, Permanant emergency lighting system was tested on April 17,
and the emergency generator was found to operate properly. The
cafeteria area was found to have no emergency lighting and
should be provided with same.
5. Several fire extinguishers are not in place as of this date.
Primarily the extinguishers recommended for the Hose cabinets.
6. It is to be noted that several cabinet doors for extinguishers
and fire hose are sticking, and sagging.

the structure and shall be completely filled in to prevent
spread of fire.
8. Self closing device shall be required on corridor door from
fourth floor office area and an exit sign shall be properly
positioned.

10. The box provided for spare heads located adjacent to the O. S. & Y.
valve has no spare heads as required by law. This box shall also
be properly labeled.
11. Fire alarm system plans were never submitted to this office for
stamped approval. The following items were noted as not proper
nor acceptable to this office.
a. The Salem Fire Prevention Bureau does not accept bells
as fire alarm sounding devices. Horns are the acceptable
means for fire alarm evacuation and all bells shall be re-
placed with properly installed horns. It shall be noted
that no provision has been made for lights on the fire alarm
system as required for handicapped areas.
b. Certain manual fire alarm pull stations are located at
the level of the electrical switches and should be placed

about 13 inches from the finished grade of this area and is t
in violation of Section 1206. 71 of the Massachusetts Statc
Building Code which requires a minimum height of two feet
above grade. This condition will apparently be a problem to
correct at this time, and a deviation will be permitted by
this office, if acceptable with the Building Inspector,
so as not to create an extreme hardship. This condition
shall be noted by the High Point Sprinkler Co. and they are
hereby notified that no deviation will be permitted on any
furthur installations by this company,
14. Occupancy will be contingent upon compliance with the pertin- t
ant sections stating deficiencies as noted above, baa

Dear Mr. O' Brien:
We have an opportunity to buy a piece of property located
at 13 Summer Street, Salem, as well as the Jannery property
on Crombie Street. As you are aware, we are soon going to
have to think positively in terms of building additional
office space, and I understand from you that when we build
we will have to provide a certain amount of parking space
for our employees. The property mentioned above would seem
ideal for this purpose if the. buildings thereon can be
razed and these two properties , with access from both
Summer Street and Crombie Street, used for parking of our
employees ' cars .
Needless to say, since many of our people now park on the
street or in the Riley Plaza, such a facility for our people
would take a large number of cars off the street.
We will appreciate your considered opinion as to whether or
not this property can be so used. For your convenience. I
enclose a copy of the Sanborn Map page showing this property,
which I have outlined in red.
Very truly yours , .

Dear Kr, A°Briena
We have an opportunity to buy a piece of property located
at 13 Summer Street, Salem, as well as the Jannery property
on Crombie Street. As you are aware, we are soon going to
have to think positively in terms of building additional
office space, and I understand from you that when we build
we will have to provide a certain amount of parking space
for our employees. The property mention above would seem
ideal for this purpose if the buildings thereon can be
razed and these two properties, with access from both
Summer Street and Crombie Street, used for parking of our
employees , cars.
Needless to say, since many of our people now park on the
street or in the Riley Plaza, such a facility for our people
would take a large number of cars off the street.
We will appreciate your considered opinion as to whether or
not this property can be so used. For your convenience I
enclose a copy of the Sanborn ?slap page showing this property,
which I have outlined in red.
Very truly yours,.
,
J in W. Knowlton
