Dear Mr. Bramble:
Many times in recent weeks , including today, my
wife and I b e been unable to use the sidewalk in
front of th iorman Street project due to workmen's
vans illegally parked there. Efforts to ask the '-men
to move the vans have resulted in rudeness and verbal
abuse to my wife on 3 occasions. Pedestrians, includin-
children in carriages (my own) and the elderly are
forced to detour into the middle of busy Norman Street.
The police have been involved numerous times .
The intent of this letter is not offensive and
I am sympathetic to the problems of parking in Salem.
However, the public safety has first priority and I
would appreciate it if you would do everything possible
to rectify this situation.

Legal Remedies for Tenaiits'of Residential Housing

The following is a brief summaryof some of the legal remedies tenants may use in order to get
housing code violation`s corrected
1. Rent Withholding(Massachusetts General Laws;_Chapter 239, section 8A): If Code Violations Are Not
Being Corrected you may be entitled to hold back your rent payments. You can do this without being evicted if:
You can prove that your dwelling unit or common areas contain code violations which are serious
enough to endanger or materially impair,your health.of safety_and that your landlord knew about the
violations before you were behind in your rent... ,
You did not cause the violations and they can be repaired while you continue to live in the
building.
You are prepared to pay any portion of the rent into court if a judge orders you to pay it. ( For this, .
it is best to put the rent money aside in a safe place)
2. Repair and Deduct:(Mas Laws;,Chapter al section 127L): The law sometimes allows
you to use-your rent money to make the repaus yourself )f your local code enforcement agency certifies that
there are code violations which mayendanger'or inatenally ft'r p&Fjotic health, safety, or well-being, and
your landlord has received written notice-of the violations,"you;may be;able to use this remedy. If the owner
fails to begin necessary repairs(or to enter into a written contract to have them made)within five days after

to make repairs. .
3. Retaliatory Rent Increases or Evictions Prohibited(Massachusetts General Laws, Chapter 186, section
18; and Chapter 239 Section 2"A):Thd owner may nof'increase your rent or evict you in retaliation for
making.a complaint.toyouciocal code-enforcement_agency.aboutcode:violations.If the owner raises your
rent to try to evict within six months after you have made:theeomplaint, he or she will have to show a good
reasodfor the increase or eviction which is unrelated to yourrccomplaiik. You may be able to sue the landlord
for damages or if he or she tries this: - -
4. :Rent Receivership (Massachusetts General Laws Chapter II,section 127 C-H)i The occupants and/or the
Board of Health may petition the District or Superior Court to allow rent to be paid into court rather than to
the owner. The court may then-appoint a"receiver"who may spend asmuch of the rent money as is needed
to correct the violation. The receiver is,not subject to a spending limitation of four months'rent.
5. :Breach of Warranty of Habitability: You may be entitled to_sue your landlord to have all or some of your
"rent-ietumed'ifynur dwelling unit does notimeet minimuft standards of habitability.
6. F Unfair.:&.Deceptive,P.ractiees.(Massachusetts-GeneriLIAChapter 93A) : Renting an apartment with
code violations is a violation of the consumer protection act:andregulations, for which you may sue an
owner.

DECISION ON THE PETITION OF ROBERT C. BRAMBLE FOR C(i'! [; -•r.-
VARIANCES FOR 24 NORMAN STREET, SALEM
A hearing on this petition was held on June 13, 1984 with the following Board
Members present: James Hacker, Chairman; Messrs. , Charnas, Gauthier, Luzinski
and Strout. Notice of the hearing was sent to abutters and others and notices
of the hearing were properly published in the Salem Evening News in accordance
with Massachusetts General Laws Chapter.40A.
Petitioner requests Variances from parking and use requirements in order to
convert an office building into thirty nine dwelling units in this B-3 district.
The Variance which has been requested may be granted upon a finding of the
Board that:
a. Special conditions and circumstances exist which especially affect
the land, building or structure involved and which are not generally
affecting other lands, buildings and structures in the same district;
b. Literal enforcement of the provisions of the Zoning Ordinance would in-
volve substantial hardship, financial or otherwise, to petitioner; and
c. Desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district or the purposes of the Ordinance. .
The Board of Appeal, after hearing the evidence presented at the hearing and
after viewing the plans, makes .the following findings of fact:
1 . The building, once used by the Telephone Company, is unique
in interior configuration and cannot be readily marketed or
economically converted for any use permitted in this B-3 zone;
2. Riley Plaza is in close proximity to the premises, is currently
underutilized in the evenings, and could serve to provide off-
street parking for the residents and their guests;
3. The addition of residential housing in the downtown area is
beneficial to the city.
On the basis of the above findings of fact, and on the evidence presented at
the hearing, the Board of Appeal concludes as follows:
1 . Special conditions exist which affect this lot which do not generally
affect the district;
2. Literal enforcement of the Ordinance would work a substantial hardship
upon the petitioner;
3. The Variances can be granted without substantial detriment to the
public good and without substantially derogating from the intent and
purpose of the Ordinance.

i Therefore, the Zoning Board of Appeal voted four to one to grant the Variances
requested provided that each occupied unit is required to pay an annual fee to
the Salem Parking Commission for each motor vehicle registered to each occupant,
in return for parking privileges at Riley Plaza. The fee is to be set by the
Salem' Parking Commission.
