TELEPHONE: 978-745-9595 2005 JAN 2b A 10• 51 MAYOR FAX: 978-740-9846 DECISION ON THE PETITION OF JERRY&PAMELA RYAN REQUESTING A VARIANCE FOR THE PROPERTY LOCATED AT4 NICHOLS STREET R-2 A hearing on this petition was held on January 19, 2005 with the following Board Members present;Nina Cohen Chairman, Richard Dionne,Edward Moriarty and Steven Pint.-Notice of the hearing-was-sent-to-abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. The petitioner is requesting a Variance from the number of stories to allow a third floor dormer for the property at 4 Nichols Street located in an R-2 zone. The Variances,which have been requested,may be granted upon a finding by this Board that: a. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structures involve. b. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise,to the petitioners. c. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district of the purpose of the Ordinance. The Board of Appeal,atter careful consideration of the evidence presented at the hearing, and after viewing the plane,makes the following findings of fact: 1. The Petitioner appeared and represented himself at the hearing. 2. Plans were submitted showing the proposed third floor dormer. 3. The area will be approximately 900 square feet and the home will remain a two family dwelling. 4. Special conditions exist when especially affect the subject property but not he 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship to the petitioner. 3. Desirable relief can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. Therefore, the Zoning Board of Appeal voted 4 in favor and 0 in opposition to grant the Variances requested, subject to the following conditions: I. Petitioner shall comply with all city and state stature,ordinance, codes and regulations. 2. All construction shall be done as per the plans submitted and approved by the Building Commissioner. 3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 4. Petitioner shall obtain a building permit prior to beginning any construction. 5. Petitioner shall obtain a Certificate of Occupancy. 6. The dwelling shall remain a 2 family residence. It is my understanding that solar panels weighing approximately 4 pounds per square foot(psf) are proposed to be installed on south-facing side of the main roof. Per your inspection and layout plan, the roof is framed with 2x6 rafters spaced at 24" on center, spanning 14'-0" horizontally from outside wall to ridge at the west end of the house and spanning 8'-6" on the narrower eastern end. The rafters slope at a 8:12 pitch. The Massachusetts Amendment to the 2009 International Residential Building Code snow chart indicates the design ground snow load in Salem is 40 pounds per square foot(psf), which translates to a flat roof snow load of 28 psf. The roof dead loads of the rafters/sheathing/shingles are approximately 10 psf and the addition of the solar panels results in a total dead load of 14 psf and overall total load 42 psf. For this evaluation, it was assumed the roof members are typical spruce-pine-fir mix, No.2 or better. Our calculations indicate that the shorter east 2x6 rafters are stressed to 55% of their total bending capacity under the code-required snow loading plus the existing dead loads with the new solar panels. However, the longer west 2x6 rafters are stressed to 149% of their capacity and therefore must be reinforced before the installation of the solar panels. I recommend sistering 2x6 rafters to each of the existing western rafters to increase their bending strength.The added members shall extend to within 12" of each end of the existing rafters and shall be attached with 10d nails at 12" on center, top and bottom, staggered. If an existing rafter is split or damaged, an additional member shall be added to both sides of the rafter. If the existing rafters are damaged near the ridge or wall bearing location, at least one sistered member shall extend to the ridge or just past the wall. The above opinion and recommendation are based on the above information provided by you and the assumption that the framing members are in sound condition.
