BURKINSHAW CITY CLERK MEMORANDUM OF UNDERSTANDING City of Salem/Peabody Essex Museum September 15, 1997 This memorandum of understanding is made and entered into between the City of Salem through its Mayor and City Council and the Peabody Essex Museum and its Board of Trustees through the President of the Board and Director and Chief Executive Officer. Whereas, the Museum has a long and distinguished presence in the City and has provided and continues to provide vitally important services to the City, the region, and the public at large; Whereas the Museum's collections represent the art, culture, and history of Salem, the region, and nations throughout the world, thereby providing an essential cultural and educational resource to the City's children, citizens, and the public at large; Whereas further expansion of the Museum will serve as a catalyst for economic development in the City of Salem, further enhance Salem's growing tourism industry, and further enrich the City and region's cultural and educational assets; Now therefore, the parties enter the following understanding as to the contributions each will make in a spirit of true partnership and collaboration: I. The Peabody Essex Museum agrees to: 1) Carry out Phase II of its expansion/renovation project in Salem using Liberty Street and the Empire parking lot, in addition to the Museum's currently owned property, including the former Salem Armory Headhouse lot Phase II of the Museum's expansion project will consist of three components: new construction on Liberty Street and the Empire parking lot, renovation of the Museum's Liberty Street facilities, and improvements to the Salem Armory Headhouse lot The type and extent of work at each location will be determined solely by the Museum, subject to approval by applicable City and other licensing and permitting agencies, and contingent on funding and related factors. Phase II of the Museum's expansion. project will commence no later than 23 September 2002. a) If for any reason the Museum does not proceed with the Phase II project and commence work by 23 September 2002, the Museum and the Cite will renegotiate the ownership of Liberty Street and the Empire parking lot. In that event, the City will have the right to request the return of all or any portion of the property; if the City exercises that right, the Museum will convey the property requested and the City will return to the Museum any funds paid to the City of Salem for the Empire parking lot. 2) Maintain free, interior or exterior pedestrian pathway between Essex Street and Charter Street through Museum property or facilities on a line similar to that of present Liberty Street during Museum open hours until 23 September, 2007, except such time as the Museum is preparing for or engaged in construction of facilities at this location. After 23 September, 2007, the City of Salem and the Museum will review the question and, without obligation on the Museum, may renew or renegotiate such access. 3) Provide for an alternate, all-hours, exterior pedestrian walkway between Essex Street and Charter Street. 4) Invest 520,000 a year for 5 years in a Business Improvement District dedicated to the enhancement of downtown Salem. 5) Continue to provide at least$65,000 annually in free services to the City of Salem, which include but are not limited to: a) Free general admission to the Museum for all children who reside in Salem and students enrolled in Salem education institutions b) At least one day a month of free admission to all Salem residents until the Museum expands its facilities at Liberty Street c) Education services and programs provided to Salem students. and d) Provide new services to the City by making use Of idluseu:n fat ilities available for special City of Salem events or activities, at cost or free, subject to Museum policies regarding facility use. e) After the Museum expands its Liberty Street facilities, all Salem residents will be provided with free general admission, contingent on item II.11 of this agreement. 6) Purchase the 'Empire' parking lot from the City at a cost of$343,000, payments to be made over a ten year period in equal annual increments of $34,300 commencing upon the date of the first bond payment made by the City of Salem for its new Church Street parking structure. 7) Contribute$300,000 to the City of Salem to help construct a parking deck on Church Street, payments to be made over a twenty year period in the amount of$15,000 a year commencing upon the date of the first bond payment made by the City of Salem for its new Church Street parking structure. 8) Assure that the design for the Armory Headhouse lot will include an appropriate commemoration of Salem's Second Corps Cadets. II. In consideration for the above, the City of Salem agrees to: 1) Take all necessary steps to undertake and complete the sale of the Empire Parking lot to the Peabody Essex Museum prior to 1 January, 1998 and transfer clear and unencumbered title to the Empire Parking lot from the City of Salem to the Museum upon 45 days prior notice by the Museum. Until such time as the Museum requests transfer of title, and demonstrates need to use the parking lot for Phase 11 construction, the City of Salem will continue to operate and be liable for the Empire Parking lot. The Mayor of Salem will execute an appropriate deed transferring title, which deed shall be held in escrow by the Mayor until such time as the Peabody Essex Museum requests delivery of said deed. The Museum will have the option of accepting title with an incumberance if it so chooses, with an appropriate adjustment in the purchase price. 2) To diligently take all steps necessary to abandon Liberty Street in order to deed it to the Peabody Essex Museum prior to 1 January 1998. The Mayor of Salem will execute an appropriate deed transferring title, which deed shall be held in escrow by the Mayor until such time as the Peabody Essex Museum needs Liberty Street for Phase H expansion and requests delivery of said deed. Within 45 days of receipt of a request by the Museum to transfer title of Liberty Street to the Museum, the City will deliver the quitclaim deed to said Liberty Street to the Museum. until the Street is deeded, and the deed delivered, to the Museum, the City will retain ownership, responsibility and liability for operation of Liberty Street 3) Dedicate the proceeds of the sale of the Empire Parking lot to help complete design and construction of a parking structure over the existing Church Street parking lot 4) Provide a comprehensive and expedited City approval and permitting process involving all relevant City permitting and licensing agencies to facilitate Phase 13 Museum expansion design and construction. 5) Agree that when the Museum concludes its analysis of options with respect to the building at 10 Liberty Street-and the Armory Headhouse Faeade—a process that requires the involvement of many concerned parties and a process that requires a determination of the role of these assets in Phase 11 expansion—the City will support the Museum's ultimate decisions. In addition to supporting the Museum at the local level, at the Museums request, the City will participate in support of the Museum's position in any approval, permitting, or review process that the Museum goes through with regard to the Phase H project at the state or federal level. The processes in which the City's support may be requested may include (but not necessarily be limited to) the Section 106 process under the National Historic Preservation Act and the Massachusetts Historical Commission and MEPA processes at the state level. 6) Waive any special requirement by the City of Salem to conduct environmental impact statements in excess of those required by the State of Massachusetts 7) Provide financial support equal to the Museum's investment necessary to establish a Business Improvement District for downtown Salem and assure that the Museum will have representation on the governing body of the BID. 8) Provide, by working with the parking authority, a special, reduced fee schedule for Museum patrons and staff parking in recognition of the Museum's financial participation in construction of the Church Street parking structure. 9) Waive all relevant fees for ail building permit applications, including but not limited to plumbing, building, electrical, fire inspection, SRA, Planning Board, and other City agencies. 10) Provide infrastructure improvements to facilitate Phase 11 expansion, including but not limited to: a) Construction of an exterior, all hours pedestrian walkway between Liberty Street and Charter Street b) Removal of all trees, curbing, sidewalk, and lighting on Liberty Street. The liming of such removal will be coordinated with the Museum. c) The City will also remove parking meiers, curbing, etc. from the Empire parking lot and assist in the removal and relocation of any City utility lines in Liberty Street. 11)Provide annual financial support for two full-time Museum security positions when the Museum opens its newly expanded facilities to help support increased costs associated with the pedestrian walkway on former Liberty Street until 23 September, 2007, at which time the provision will be subject to renegotiations, as set forth in item L2 of this agreement In return, the Museum will provide free general admission for all Salem residents. Parker, President of the Board of Trustees Peabo Essex Museu by the Director and Chief Executive Officer Dan L. onroe, Director and Chief Executive Officer Salem City Council, by its President, duly authorized by vote of the City Council Scott McLaughlin, President of Ci Council A CITY OF SALEM REQUEST FOR PROPOSALS EMPIRE LOT AND LIBERTY STREET DEVELOPMENT SITE The City of Salem requests proposals from prospective developers for the purchase of a development site (the "Development Site") which shall include the Empire Lot Parcel and a segment of Liberty Street from Essex Street to Charter Street, for the purpose of expanding the display and appreciation of the historical, education, ecological and cultural items and artifacts that show the history and development of Essex County.and the City of Salem. 1. Property Description The Development Site includes the Empire Parking Lot, Salem Assessor's map 35, lot 219, as approximately described in an instrument of taking recorded in the Essex South Registry of Deeds, Book 4129, Page 594, as well as a segment of Liberty Street which runs from Essex Street to Charter Street. See Attachment A, detail from assessor's map 35. H. Conditions for Sale and Development Sale and development will be based on the following conditions: A. The development should be part of an integrated plan to expand the quality and scope of the cultural, educational, ecological and historical exhibits within the City of Salem. B. The development will consist of a building, or buildings, and grounds which shall house display, gallery, performance and entertainment spaces, and the support space required for the same. C. The development will include site planning and any necessary reconstruction of the sidewalk or street on Essex Street and on Charter Street, along the entire length of the proposed development. D. The construction of any buildings to be located on the Development Site referred to herein shall commence no later than 23 September 2002. 1 E. The proposed construction shall include a design for and shall leave space for a pedestrian passageway, to be approved by the City Planner, along the eastern edge of the site free of construction, so that the City of Salem can construct a pedestrian walkway to connect Essex Street and Charter Street. F. The Development Site shall have an interior or exterior pathway which shall connect Essex and Charter Streets on a line similar to the present Liberty Street. This pathway shall be open to the public during normal working hours of the facility, until at least 23 September, 2007, except when the developer is preparing for or engaged in construction. Continuing public access of this pathway shall be subject to review and renegotiation between the City of Salem and the developer before 23 September 2007. G. A prior easement to the rear of 131 Essex Street and a prior easement for ten parking spaces for the Charter Street Housing Authority exist on the Empire Lot Parcel. These easements shall be relocated by the City to the far eastern corner of the site provided that they accomplish the original intents of access and parking. H. The selected developer shall be required to execute a"Contract for the Sale of Land for Private Development"with the City of Salem. Such contract shall be executed within 60 days of written notice of acceptance of the development proposal. 1. The selected developer shall adhere to all review and approval procedures of all City boards and commissions, as established by local ordinance, except as waived by the City. .1. The selected developer must comply with M.G.L. c.7, ss40J, which require a disclosure of beneficial interests to be filed with the Deputy Commissioner of the Division of Capital Planning and Operations. III. Proposal Submittal Requirements One original and five copies of the proposal shall be submitted. Complete proposals will contain the following: A. Development Plan 2 Proposal must include a narrative description of the educational and cultural development concept. It shall include: 1. A description of the type of development to occur on the site. 2. A description of the type of permanent educational and cultural exhibits and the types of temporary exhibits to be shown in the buildings and display spaces on the Development Site. 3. A description of how the development will incorporate an interior/exterior pathway along the line of Liberty Street and how the development will accommodate an exterior public walkway along the eastern edge of the site. 4. A description of how the development will influence surrounding traffic patterns, including how reception, drop off, and service areas will be handled, and an estimate of how much additional traffic the development will generate. B. Conceptual Design Package Proposal must include a conceptual design package including: I. Site plan, scale not more than 20 feet per inch. 2. Building floor plans, sections and elevations. C. Evidence of Development and Management Experience The proposal must identify the developer's name, street address, telephone number and legal form of organization. The proposal must list all officers, partners or owners of the development entity by name, title and percentage of ownership and their addresses and telephone numbers. In addition, the developer must: 1. Identify key members of the development team with experience in design, constriction, marketing and management and their experience on comparable projects. 3 2. Describe the development and property management experience of the principals in developing and operating comparable projects, with emphasis on the following: a. Project description, including date, location, concept, land uses, size, cost, and role of the development entity. b. Economic viability, including information concerning financial performance and capability. C. Financial structure of the project.. d. Timeliness of performance. 3. Describe the names and qualifications of professional consultants to be retained to assist in the design and construction of the project. D. Cost estimates The proposal must include an estimated development budget in sufficient detail to demonstrate that the developers understand the scope of the project and to meet the requirements of this request for proposal. E. Evidence of Financial Capability The developer shall demonstrate the financial capacity to carry out the proposed project. The City recognizes the sensitive nature of the financial information requested. This information will be used solely by City staff for the purposes of evaluation. The City will maintain confidentiality of the submitted financial information. For the developer, or in the case of a company formed specifically for this project, provide the following information: 1. An audited income statement and balance sheet for the most recent two fiscal years. 2. Identify current banking relationships and optionally the amount of credit line available to the entity and/or guarantors and participants. 4 3. Provide the name, address and phone number of two credit references (preferably those involved in financing similar projects) for the development entity and/or its guarantors and participants. 4. Provide written authorization to the City of Salem to contact banking relationships and credit references. (Copies of the authorization should simultaneously be provided to the banking references and credit sources.) 5. If the entity which is to undertake this project will be formed especially for this purpose and represents a subsidiary or joint venture, specify the guaranty relationship that will exist between it and its sponsors and participants. 6. The description of any in any litigation or other disputes that could result in a judgment or settlement having a materially adverse effect on the ability to execute this project. 7. Prospective developers should provide a letter of intent from a lending institution interested in financing their proposals or a timetable for receiving financing commitment. F. Development Schedule 1. The proposal must provide a detailed development schedule including any necessary reviews by local, State and Federal agencies. 2. The schedule shall demonstrate that the entity submitting the proposal can meet the 23 September 2002 deadline for the commencement of construction. G. Acquisition Terms At a minimum, any acceptable bid shall include: 1. Payment of no less than the assessed value of$343,700 which is the current municipal assessment at 100% valuation for the purchase of the Development Site. Payments to be made no less than equally over a ten year period. Payments shall commence at the same time as the contributions in paragraph below. 5 2. Contribute $300,000 to the City of Salem to construct a parking structure on Church Street or other equivalent downtown improvement. Payments terms shall be no less than $15,000 per year for a period of twenty years commencing with the first bond payments for the construction of said facility. 3. Investment of$20,000 per year for five (5) years in a Business Improvement District dedicated to the enhancement of business in downtown Salem.. IV. Evaluation Criteria A. Threshold Criteria 1. Conformance with all submission requirements and a clear presentation of the ability to meet the intent of this Request for Proposal. 2. Demonstrated experience, project management skills, operating and marketing skills, management ability, financial capability and commitment by the developer to complete the project on a timely basis. 3. Strong evidence of economic feasibility and sound public benefit. B. Preference will be given to proposals which: 1. Expand and add to the quality and scope of the City of Salem's historical, cultural and educational resources. 2. Promote general cultural, educational and economic activity in Salem by expanding visitation and activity in Salem's downtown area. 3. Increase public benefit to the City of Salem by a. Providing education services to Salem students and offering free general admission for all children who reside in Salem and students of Salem's educational institutions. b. Offering free admission no less than one day per month for all Salem 6 residents. c. Opening for free to all Salem residents the cultural and educational facilities on the Development Site at appropriate times and for appropriate celebration and ceremonies. d. Offering the use of the facilities to the City of Salem for special events or activities. V. Other Information A. Title to property and development rights are not transferable. B. The City of Salem will remove utilities, trees, curbing, sidewalk and lighting on the Development Site, prior to commencement of construction as necessary. C. The City of Salem will prepare the appropriate deed or deeds to the Development Site. D. The City of Salem will waive all fees for City permits. E. The City of Salem will construct a parking structure on Church Street or an equivalent public improvement with the financing outlined in this proposal. F. The City of Salem will construct, or pay for the construction of, any public ways crossing the Development Site. G. if the developer constructs an acceptable interior walkway at the Development Site the City of Salem will provide the developer the financial support necessary to fund two full time security guards for hours when any such walkways are open to the public. Any proposal which fails to include all of the above information may be rejected as unresponsive, and may not be afforded a complete review. The report identifies and documents, as the result of visual inspections, the present condition of the Armory situated on Essex and Brown Streets in Salem, Massachusetts, particularly in connection with the development proposal by the Museums Cooperative. My review and examination included a review of engineering and consultant reports made available by the Planning Department relating to inspections and site evaluations completed recently and made available to the City. In addition to this detailed review, the site was examined and investigated during the weeks of February 18 and February 25, 1991. The following represents the findings and conclusions of this examination and investigation. Appropriate exhibits are part of this report. These include by reference studies made available to me by the City of Salem. The past history of the Armory building includes a significant and damaging fire that occurred in February of 1982 , resulting in roof and multiple floor collapse 1 along with damage to structural elements of the building. Since the fire, the structure has essentially been exposed to the ravages of the elements, without any appreciable protective procedures being implemented by the owner of the property, who, as I understand it, remains the Commonwealth of Massachusetts. Present Condition Attention is called to existing code violations and non-compliance, which deal with the need for temporary repairs and bracing. Code Section 836. 1 and Table 2103- 6 of the State Building Code indicates the procedures which must be followed with specific regard to the situation involving the Armory. These sections are brought to your attention in connection with this report, and perhaps should be made available to the State, since it is presently the owner. It is apparent from our detailed inspections that very significant deterioration has taken place and is continuing in the materials making up the subject Head House masonry walls. Brick mortar is in poor condition or in many cases missing in significant areas of exterior wall surfaces. Cycles of freezing, thawing, and then refreezing have set in motion a continuous process of deterioration, which has reached a hazardous stage. The Head House has been particularly affected by 2 this continuous process of deterioration. With the narrow elongated window openings and other openings in the structure, access for water infiltration and saturation of all surrounding masonry has been readily available. In effect, you have a sieve-like situation. Much of this damage is apparent to the eye, but I do feel that significant damage exists which is not readily apparent. The entire Head House structure as it stands is in a dangerous condition and, regardless of future use of this structure, alleviating the condition wherein the structure might collapse requires temporary action to at least forestall any immediate problem. The estimated cost of this required action is attached. Alternatively, of course, if the Head House were to be razed quickly, then it would not be necessary to expend these funds. On the basis of information available, it appears that the Armory complex does show evidence of mortar repair to the exterior surface. However, the most recent repairs to mortar and brick were apparently done ten years prior to the 1982 fire. Therefore, deterioration throughout the entire complex is very serious. similar to apparent brick damage, when mortar joints have deteriorated to the point of falling out and powdering, the remaining mortar joints, though in place, are suspect 3 and may be seriously defective. Samples of the brick mortar removed from the Head House were unsatisfactory and crumbled to a powder with finger pressure, and in certain instances the bond between the brick and mortar had broken. Also, it is apparent that the interior wall surfaces, which were never built to accept exposure to weather and damaging elements, have for the last ten years been exposed as a result of the fire, and there now is a high percentage of voids in both horizontal and vertical mortar joints. In addition to the above damage, the brick units are seriously damaged throughout all the wall areas. The interior side of the west wall and south wall of the Head House, along with the dividing wall between the Head House and Drill Shed, are in the same condition as the east wall interior surface. The general condition of the interior masonry surfaces is poor and possibly dangerous. Dangerous is appropriate in describing a condition which reduces the required structural integrity of a wall system such as the existing Head House walls. The interior Head House wall surfaces have in excess of two hundred total and partial masonry penetrations allowing internal water accumulation and saturation of the softer back-up brick, mortar, and voids within the wall sections. 4 The Armory masonry walls are typical of brick masonry built in the past. Basically, the exterior skin or wythe was a selected brick, hard-burned, dense and generally water and weather resistant. The back-up brick and remaining courses were constructed using a less expensive brick called "salmons" . This back-up brick is softer and is sensitive to the elements. When exposed to the weather, the back-up material will disintegrate rapidly, as a result of freeze-thaw cycles combined with water saturation. Evidence of this phenomena is obvious at the subject site. Upon inspection, it is noted that spauling and brick disintegration is taking place. The degree or extent of brick damage is difficult to ascertain. Since spauling is apparent by visual observation, however, it is reasonable to assume that significant additional brick is damaged, but surfaces have not yet fallen off. Locating the extent of damage can only be done by physically testing the brick throughout all wall areas. Drill Shed The Drill Shed area was not a part of scope of services requested with the inspection of the Armory site. However, certain observations made during my site visits are as follows. Exterior masonry is in need of repair and 5 repointing. At the south end of the west wall, the masonry has disintegrated on the right side of the overhead door location. The masonry above the overhead door has bulged out of wythe indicating that water has saturated and frozen within the wall. The result is that the header courses in the brick work have fractured. I would recommend not using this overhead door entrance, since the masonry may collapse on those opening the door which causes vibration in the wall above. There are areas of brick masonry in the parapet areas in the north wall, which have become dislodged and disintegrated. The building is in generally fair condition. However, evidence of the brick masonry failures on the west, north and east walls, which are easily identified, indicates more extensive damage exists, but is not apparent at the present time. The interior portions of the building structure seem to be in fair condition. The door opening in the south dividing wall is allowing the elements to enter and resulting damage is evident to the drill shed floor at this location. Immediate Cost Considerations The present owners of the Head House structure must perform the following work immediately in order to make 6 the existing walls safe and eliminate the present dangerous condition. 1. Bracing (MASS. STATE CODE) 15 Structure Units @ $4 , 000. 00/Unit $ 60,000.00 2 . Interior wythe brick masonry; remove and replace deteriorated material or replace missing material to meet code wall thickness. 7, 000 square feet @ $25. 00/square foot 175,000.00 3 . Parge interior exposed wall surfaces (1/4" to 3/8" thick) 14 , 000 square feet @ $2 . 00/square foot 28,000.00 4 . Allowance 15,000.00 Subtotal $370,000.00 Neither the City of Salem nor the Commonwealth of Massachusetts enjoys the time involved with usual bureaucratic processes in this matter. The work outlined above should proceed immediately on a design build emergency basis. The subtotal figure of $370, 000. 00 would include all labor, materials, engineering and profit for performing the work necessary in stabilizing and making safe the 7 Head House structure at this writing. It is important to point out that the Commonwealth is unlikely to expend $370, 000. 00 to protect this deteriorated building. Therefore, it is reasonable to assume that left in its present condition the deterioration will worsen. Basement Area and Drainage There have been suggestions made regarding lowering the basement floor of the Head House for various reasons. Addressing the basement area, a review was made of the management of ground water and recommendations regarding the installation of a subsurface perforated drainage system around the interior perimeter of the building, including below spread footings, which may be located within the confines of the Head House area. Any approach such as has been suggested should be given careful and conservative consideration. There are conditions which could substantially affect the ground water elevation around the New Liberty and Essex Street neighborhood. Leaking storm drainage and sanitary sewer systems along with leaking water distribution lines or a possible water line break could seriously increase the elevation of ground water around the Head House, the relief of which could increase the ground water flow under the building wall footings to the proposed drainage 8 r system which is at an elevation below adjacent to and on the interior side of the Head House footings. The writer would prefer a solution of installing the ground water drainage system around the exterior perimeter of the building at an elevation necessary for ground water control in relation to the proposed basement floor elevation. This solution of handling ground water before it enters the building may be more expensive initially; however, it may be, by far, the least expensive ground water handling method in the long run. Exterior perimeter drainage installation including but not limited to, dewatering sheathing, shoring, piping, appurtenant structures, replacement of disturbed surfaces, excavating and backfilling. Four Hundred (400) linear feet more or less at $200. 00/linear foot equals $80, 000. 00 Premium Development Cost Consideration A development program within the existing Head House footprint may produce approximately thirty thousand (30, 000) gross square feet of rentable area, including the existing basement. The Museums ' desire to construct an auditorium adds considerably to the complexity of the project, in view of working within the confines of the existing Head House 9 structure, and reflects on the premium construction cost significantly. Basic construction cost for new commercial office space would approximate one hundred (100) to one hundred twenty-five (125) dollars per square foot. These are examples of current costs for buildings in the three to five story range, including quality materials and finishes. The Head House site is very tight for mobilization and construction purposes with the additional encumbrance of working around and maintaining the existing walls. A construction contractor would be required to add twelve (12) to fifteen (15) percent to normal construction costs to adequately provide for restraints at this location. The writer must also point out that demolition of the existing structure and new construction will be more expeditious than renovation of the existing structure. The Essex Street facade can, as an engineering concept, be salvaged, and architecturally can be included as an integral part of the final solution. However, I must again point out that repair of that portion of the Head House should be performed forthwith. While the cost of retaining the front facade has not been projected because of various unknowns, and would certainly be more than the square foot cost of new construction, I believe it would be significantly less than the $224 . 00 per square foot projection above described. The difference in cost of developing this area with the existing structure, as noted, would be almost twice the square foot cost of providing a new facility to replace the existing one. This one hundred percent premium cost is extremely difficult to justify when the desired interior functional space may not or cannot be accommodated because of the existing facade. 11 In discussing this matter with the architectural component of our company, we make the following observation. This site, developed properly, could be one of the premiere sites of the City. It is important to bear in mind that any building that has as its function serving tourists, museum patrons, and some commercial uses must have an inviting atmosphere. Therefore, the design of renovation to the existing building or a new building must consider the necessity that the building be inviting to visitors and tourists. A fire gutted the headhouse several years ago. Last year, the Museum had most of the damaged structure demolished to minimize the threat to the public until plans could be formulated to determine how the property is to be utilized. At that time, steel framing was installed behind the south facade to support the masonry wall while reuse of the facade is being evaluated. Attached for your reference is a copy of a memorandum issued by the structural engineer regarding the steel bracing. As you are aware, the first phase of the revitalization of the property, the National Park Service Visitor Center facility, is currently under construction at the Drill Shed. The contractor was recently directed to install a fence to separate and protect the area of construction activity from the rear of the headhouse. At this point in the construction process, the interior steel framing is nearing completion, and it is anticipated that the Drill Shed will gradually be fully enclosed over the course of the next few weeks. Although options relative to the disposition of the headhouse facade are being considered, no final decisions have yet been made. We will be able to respond to you in greater detail by mid-December. Perform all work required to complete the work of this section as indicated. Such work includes but is not limited to the following: 1. All work shall comply with the rules and regulations of the Division of Industrial Safety and all other Local, State, and Federal agencies and authorities having Jurisdiction. B. Obtain and pay for all permits required to perform the demolition work as required by all agencies and authorities having jurisdiction. 1.3 MAINTENANCE OF TRAFFIC AND ACCESS A. The steel trusses and beams appear to be in structurally sound condition. They have supported the roof adequately for many decades and there is no evidence of any structural overstress . In some areas, whereroof leaks have occurred , the 2x8 wood roof rafters and decking have deteriorated and require replacement . This is noted on the structural roof Plan . The structural adequacy of the roof rafters , if they are in sound condition, was verified . The replacement of . the old roofing with the new roofing andand insulation, also the new skylights , will not acid any significant weight to the roof framing system. Therefore , it is not a structural concern. - This evaluation is to the hest of our knowledge and belief , based Ona visual inspection from a distance, since the roof framing elements are quite high and have not been inspected from a close range .
