Re: Accessory structures
Dear Mr. Cappucio,
A few weeks back,I notified you of a zoning violation regarding the kayak racks located on or near the property
line.To date, the rack has not been relocated and you have not appealed my decision. Just after you received
the letter, you asked,at the counter, about the abutters shed and the proximity of the shed to the lot line. The
shed is too close to the lot line,(five feet required).Per MGL 40A section: 7,the shed has been there for ten
years or more and at this time no enforcement action can take place.
Please let me know when you plan to move the racks to avoid municipal code tickets and further enforcement
actions

Re:kayak rack
Dear Owner,
This Department has received and confirmed a complaint regarding the recent construction of a kayak rack. The
complaint is about the proximity of the structure to the lot line. The kayak rack is considered an accessory
structure. Salem Zoning Ordinance requires accessory structures to be ten feet from the primary structure and
five feet from the lot line. It appears this structure is either on the property line or perhaps, over the lot line.
Therefore , you are directed to relocate the structure five feet back from the lot line within ten days of receipt of
this notice. Failure to address this Zoning violation will result in Municipal Code tickets and further
enforcement actions. If you feel you are aggrieved by my Zoning interpretation, your Appeal is to the Salem
Zoning Board of Appeals.
Sincerely,
'Thomas StTierre
