Dear Owner,
This Department has received complaints regarding the campers parked in your driveway.Be advised, City
Ordinance 24-21.1 States in part "No person shall park,store,keep or leave,or allow that there be parked,
stored,kept or left any trailer,commercial or recreational vehicle unless said trailer, commercial ,or
recreational vehicle is registered to the owner who resides at the property."
Additionally City of Salem Zoning Ordinance 6.2 States the following :6.21 General.No person shall park
,store or occupy a trailer for living or business purposes within the City of Salem,except:
1. The owner of residential premises may permit occupancy of such premises by a non paying
guest using a trailer for a period not to exceed twenty(20)days. A special permit for this purpose must
be obtained from the Building Commissioner before the land can be so occupied.No more than (1)
trailer is permitted within any one(1)residence or lot.
Please contact this office upon receipt of this letters to discuss your plans to comply with this ordinance. Failure
to address these violations will result in Municipal code tickets and further enforcement actions.

DECISION OF THE PETITION OF MARGARET PRESS REQUESTING A VARIANCE /
FOR THE PROPERTY LOCATED-AAT 55 MEMORIAL DRIVE R-1
A hearing on this petition was held October 20, 1999 with the following Board Members
present: Nina Cohen, Chairman, Stephen Harris, Michael Ward, Stephen Buczko and
Richard Dionne. Notice of the hearing was sent to abutters and others and notices of the
hearing were properly published in the Salem Evening News in accordance with
Massachusetts General Laws Chapter 40A.
The petitioner is requesting a Variance from rear setback to construct a 6 x 10 garden
shed for the property located at 55 Memorial Drive located in an R-1 zone.
The Variances which have been requested may be granted upon a finding by this Board
that:
1.Special conditions and circumstances exist which especially affect the land, building or
structures involved and which are not generally affecting other lands, buildings and
structures involve.
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioners.
3. Desirable relief may be granted without substantial detriment to the public good and
without nullifying or substantially derogating from the intent of the district of the
purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented at the
hearing, and after viewing the plans, makes the following findings of fact:
1. Petitioner, Margaret Press, represented herself.
2. The petitioner requested a variance for the rear yard setback in order to construct a 6
x 10 feet garden shed. The Petitioner's property borders the encroachment area for
Collins Cove.
3. The petitioner presented a plot plan, prepared by Carter & Towers Engineering Corp.
of Swampscott, Massachusetts.
4. Petitioner also presented sketches and a picture of the proposed garden shed.
5. There was no opposition to the proposal.

On the basis of the above findings of fact, and on, the presented at the hearing, the
Zoning Board of Appeal voted unanimously, 5 in favor, to grant the variances requested,
subject to the following condition;
1. Petitioner shall comply with all city and state statues, ordinances, codes and
regulations.
2. All construction shall be done as per the plans and dimensions submitted.
3. All requirements of the Salem Fire Department relative to smoke and fire safety shall
be strictly adhered to.
4. Petitioner is to obtain Building Permit prior to beginning any construction. 9 ri
5. Exterior finishes of the new construction shall be in harmony with the existingy� r

7. Petitioner is to obtain approval from any City Board or Commission having �?

A hearing on this petition was held June 3, 1992 with the following
Board Members present: Richard Bencal, Chairman; Richard Febonio,
Edward Luzinski, Francis Grealish Jr. , and Stephen Touchette. Notice
of the hearing was sent to abutters and others and notices of the
hearing were properly published in the Salem Evening News in accordance
with Massachusetts General Laws Chapter 40A.
Petitioner is requesting a Special Permit to construct a partial second
level to existing single family home. The property is located in an
R-1 district.
The provision of the Salem Zoning Ordinance which is applicable to this
request for a Special Permit is Section 5-3(j ) , which provides as
follows:
Notwithstanding anything to the contrary appearing in this Ordinance,
the Board of Appeal may, in accordance with the procedure and conditions
set forth in Section 8-6 and 9-4, grant Special Permits for alterations
and reconstruction of nonconforming structures, and for changes,
enlargement, extension or expansion of nonconforming lots, land,
structures, and uses, provided, however, that such change, extension,
enlargement or expansion shall not be substantially more detrimental,
than the existing nonconforming use to the neighborhood.
In more general terms, this Board is, when reviewing Special Permit
requests, guided by the rule that a Special Permit request may be
granted upon a finding by the Board that the grant of the Special Permit
will promote the public health, safety, convenience and welfare of the
City's inhabitants.
The Board of Appeal, after careful consideration of the evidence
presented at the hearing, and after viewing the plans, makes the
following findings of fact;
1. There will be no change in the use of the dwelling.
2. There will be no change in the footprint of the structure.

4. The impact of the addition is extremely minimal.
On the basis of the above findings of fact, and on the evidence
presented, the Board of Appeal concludes as follows:
I. The Special Permit requested can be granted without substantial
detriment to the public good and without nullifying or substantially
derogating from the intent of the district or the purpose of the
Ordinance.
2. The granting of the Special Permit requested will promote the public
health, safety, convenience and welfare of the City's inhabitants and
may be granted in harmony with the neighborhood.
Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant
the Special Permit requested, subject to the following conditions:
1. Petitioner shall comply with all City and State statutes,
ordinances, codes and regulations.
2. All construction shall be done as per the plans and dimensions
submitted and by legal building permit.
3. All requirements of the Salem Fire Department relative to smoke and
fire safety shall be strictly adhered to.
4. Petitioner shall obtain a Certificate of Occupancy for the addition.
5. Exterior finishes shall be in harmony with existing structure.
b. All requirements of the Salem Conservation Commission in a letter
date May 5, 1992 shall be adhered to.

accordance with Massachusetts General Laws Chapter 40A.
Petitioner, owner of the property, represented by Attorny John R. Keilty, 10
Chestnut St. , Peabody, is requesting a Variance to allow zero rear yard setback
so as to allow an existing deck in this R-1 district.
The Variance which has been requested may be granted upon a finding of the
Board that:

lands, buildings and structures in the same district;

not the district generally.
2. Literal enforcement of the Zoning Ordinance would work a substantial
hardship on the petitioner.
3. The relief requested can be granted without substantial detriment to the
public good and without nullifying or substantially derogating from the
intent of the district of the purpose of the Ordinance.

Therefore the Zoning Board of Appeal voted unanimously, 4-0, to grant the Variance
from rear setback requirement allowing for zero rear yard setback as requested, on
condition,petitioner meet all requirements of the Salem Fire Department relative
to smoke and fire safety, and that deck remain as shown on the plan submitted to
the Board.

CONSERVATION COMMISSION
REQUEST FOR DETERMINATION OF APPLICABILITY
The Salem Conservation Commission will hear a Request for a
Determination of Applicability, under the Wetlands Protection Act,
Massachusetts General Laws Chapter 131 , Section 40, at the request
of Margaret Press . The proposed work, located at 55 Memorial
Drive, consists of an addition of a partial second floor within the
existing footprint of an existing one story single family dwelling
as well as a small second level balcony outside of the existing
footprint . The Request will be heard on Thursday, May 28, 1992 at
