Dear Mr. Callahan:
Last year this departmment gave permission to construct a shed in the
cafeteria area to be utilized for educating your pupils on-the sale of
materials and banking procedures. At the time of construction I gave
specifics to the teacher in charge of this project. Up to this date they
have ignored them. After speaking with with you on October 31, 1994 you
assured me they would meet our requirements.
1. Two fire extinquishers to be installed, one on each side of
structure.
2. Fire retardant paint was to be used on exterior of structure.
3. Remove all tables within (10) ten feet of structure.
4. Fire retardant sheet rock to be used on interior walls.
5. Interior paint to be fire retardant.
6. Roof of structure also to be fire retardant paint.
If these specifics are not met within (15) fifteen days I will have to
ask Mr. L'Heureux, Director of Building Service to remove it.
Thank you in advance for your anticipated cooperation in this matter.

R program designed to introduce the importance of
reading to preschool and elementary aged children.
Community Readers began at the Salem Early Childhood Center in 1992
to enhance the classroom libraries as well as bring community and
ciulc leaders into the classroom. This year we have eHpanded to
include the entire Bentley School.
In the younger grades Community Readers are Invited to bring in their
favorite childhood book and share it with the class. The book is then
donated to the class library.
In the older grades Community Readers are invited to, bring a chapter
book, or a book in which you have a special interest. You may share I a
chapter or two with the class, then donate the book and have the
teacher read the remainder with his/her class. The book will then be
donated to the (school or class) library.
RII books receive a special bookplate inscribed with the Community
Reader's name and are cherished for years to come.
The Bentley School and the Early Childhood Center have both English
and Spanish speaking classes.

Dear Ms. Dannenberg:
An inspection of the Bentley School was conducted on April 6, 1994 by this
department. The major safety devices such as the fire alarm, emergency
generator, emergency signs, emergency egresses and corridors were all found to
be in excellent condition. However, we did find a few violations that need to
be attended to, they are as follows:
The hot water temperature in the C wing bathrooms must be lowered to no
more than 110 degrees F.
Wood wedges cannot be used at classroom doors and fire doors, doors must
remain closed at all times.
Fire exit sign at classroom 107 is not working.
All art work and other papers that are hanging in rooms must be kept at a
minimum. Quite a number of classrooms are overdoing hanging of paperwork
turned in by the students.
You have received a directive from Mr. LaPointe the Fire Inspector on this
matter and we would appreciate your advising your teachers. Also, keep
corridors free from art work, paper work should be confined to bulletin boards
only. If you have any questions please do not hesitate to call otherwise, would
you please contact me when all the above violations have been corrected.
I thank you for your anticipated cooperation and prompt attention in this
matter.

This letter is to document the conversation that
occurred at the meatina, yesterday, regarding the possibility
of methane gas infiltration it the crawl space area of the
project. The information received from the Architect ; , '
indicated that an exhaust system will be requir®d by the ;r
D.B.P. because of the possibility that methane gam could be
trapped in the crawl space. I indicated that the wiring `
method that has been utilized and approved to date was not
consistent with grir+rig methods s0hich would need to be
utilized for a hazardous location as described by Article 500
of the Mase Electrical Code. In all cases, now that S.C.
Coombs Electric has been notified that a p9tentiA3 problem
exists, we can not proceed nor energize any electrical
circuits which exist in the crawl space area. This obviously
will impact, the circuits necessary to energize the old and
the new building. The schedule proposed by the contract'
documents will also be adversely affected.
Please note that very early in the project I entertained
the idea that gas infiltration in similar crawl space areas
was not uncommors. It was noted by the Architect .that a gas
hazard was not a consideration atthis partioulaLr Bite. The
A-rchitect indicated that the orig al statement is consistent
with :current conditions, but no samples of the crawl space
had been obtalned as of this date. '
In light of the revelations divulged at yesterdays
meeting,S.C. Coombs Electric can not proceed without
direction. The potential legality and hazard issues regarding
this problem are much more than S.G. Coombe Electric could
possibly entertain. please requ®et direction from the Arehsi-

discussions which were held at our project meeting on July 9, 1992 regarding the
possibility of methane gas build up in the crawl space.
Please be advised that it is imperative that this issue be resolved immediately. .
The consequence of the enclosed and those which are being requested by the
Department of Environmental Protection could have devastating consequences on
this project, both monetarily and completion wise.
Your firm must give an answer regarding this issue. As stated before, our
schedule calls for permanent power to be energized or. July 13, 1991 which is
imperative in keeping this project on schedule.

The Metropolitan Boston/Northeast Region of the Department of
Environmental Protection, Division of Solid Waste Management has
received a request for approval to re-use the material that was
generated during excavation activities associated with the
construction of the Bentley Elementary School Extension, Salem, MA.
This request was submitted in accordance with 310 CMR 19. 130 (32)
" Disruption of Landfill Areas " and 310 CMR 19. 143 (1) " Post-
Closure Use of Landfill" .
It is proposed to regrade a small berm constructed of the
excavate along Memorial Drive and to spread a thin lift of the
excavate over the school 's athletic playing field. This material
will then be covered with 18 inches of clean soil.
Based upon the results of chemical analysis performed under
the direction of the Waste Site Cleanup, the excavated soil was
observed to contain low levels of petroleum hydrocarbons (less than
480 mg/kg) . The excavate was originally disposed of as part of the
operation of the former City of Salem municipal landfill. The LF
was closed for the receipt of refuse in the early 1940 's. 310 CMR
19. 143 (2) requires approval for the project.

In reviewing the request for a change in use of a landfill,
the Department takes (3) three criteria into consideration:
a) the effect the new use will have on any "cap"
placed on the landfill as part of a past
closure.
b) the degree to which the project owner and
designer have considered the need to protect
structures from the accumulation of methane.
C) the relationship of the proposed use to other
post closure uses occurring on the landfill.
In reviewing your proposal the Department notes:
1) the landfill was abandoned prior to the
adoption of regulations in 1971 controlling
landfill closures.
2) the project as proposed will not involve the
receipt of solid waste materials from outside
of the former City of Salem municipal landfill.
The excavate is being relocated within the
landfill site.
It is the Department's determination that the proposed
project does not entail the re-opening of the former City
of Salem municipal landfill and thus does not constitute the
operation of a solid waste disposal facility as defined by 310
CMR 19.000.
The Department therefore in accordance with 310 CMR 19. 130(32)
and 19. 143 (2) , hereby approves the City of Salem Planning
Department's proposal to utilize the excavate for regrading the
site subject to the following conditions:
1) Within 60 days from the receipt of this approval
the City of Salem Planning Department shall comply with
310 CMR 19. 143 (4 xbL-! Post Closure Construction " by
submitting to this Department detailed plans prepared by
a Registered Professional Engineer for the proposed
construction of the school building extension, showing
techniques used to prevent accumulation of gas within the
structure.

2) In the event any further expansion of the Bentley
Elementary School facilities are planned, the Department shall
be notified at least 120 days prior to the planned start of
construction and such plans as the Department determines
to be necessary shall be submitted to facilitate the
Department' s review and approval of the proposed alterations
to the former landfill.
In accordance with 310 CMR 19 . 016 the Department hereby
approves the City of Salem's proposal to convert a portion of the
former landfill to an athletic playing field. Upon receipt of
this approval the City shall record with the Registry of Deeds, or
if the land is a registered land, with the Land Court Section of
the Registry for the district in which it lies, notice of
its issuance. Further the City shall record with the Registry
of Deeds, or Land Court, as applicable, notice that this site
was formerly utilized as a landfill for the disposal of solid
waste. That notice must be done in accordance with the provisions
of 310 CMR 19. 141 "Record Notice of Landfill Operation" .
NOTICE OF RIGHT TO APPEAL
The City of Salem (the "City") is hereby notified that it may
within twenty-one (21) days file a request that this decision be
deemed a provisional decision under 310 CMR 19.037 (4) (a) , by
submitting a written statement of the basis on which The City
believes it is aggrieved, together with any supporting materials.
Upon timely filing of such a request, the decision shall be deemed
a provisional decision with an effective date twenty-one (21) days
after the Department's receipt of the request. Such a request
shall reopen the administrative record, and the Department may
rescind, supplement, modify, or reaffirm its decision. Failure by
The City to exercise the right provided in this section shall
constitute a waiver of The City's right to appeal.
Appeal. Any person aggrieved by the issuance of this permit,
except as provided for under 310 CMR 19. 037 (4) (b) , may file an
appeal for judicial review of said decision in accordance with the
provisions of M.G.L. c. 111, s. 150A, and M.G.L. c. 30A, not later
than thirty (30) days following the receipt of the final permit.
The standing of a person to file an appeal and the procedures for
filing such appeal shall be governed by the provisions of M.G.L.
c. 30A. Unless the person requesting an appeal requests and is
granted a stay of the terms and conditions of the permit by a court
of competent jurisdiction, the permit decision shall remain
effective or become effective at the conclusion of the thirty (30)
day period.

Notice of Action. Any aggrieved person intending to appeal
a grant or denial of a permit to the Superior Court shall first
provide notice to the Department of intention to commence such
action. Said notice of intention include the Department file
number and shall identify with particularity the issues and reason
why it is believed the permit decision was not proper. Such notice
shall be provided to the Office of General Counsel of the
Department and the Regional Director for the regional office which
processed the permit application. The appropriate addresses to
which to send such notices are:

No allegation shall be made in any judicial appeal of a permit
decision unless the matter complained of was raised at the
appropriate point in the administrative review procedures
established in those regulations, provided that a matter may be
raised upon a showing that it is material and that it was not
reasonably possible with due diligence to have been raised during
such procedures or that matter sought to be raised is of critical
importance to the environmental impact of the permitted activity.
Should any person be aggrieved by this action of the Department in
issuing this approval/permit, such person may appeal this action
pursuant to the provisions of M. G. L. C 30A, s. 14 .

buildings equipped with an automatic fire suppression system.
This code revision took place on 1 March 1990 and allows the
Architect to use zero rating partitions along the corridor
walls.
We will await your decision as to whether you request the
corridor walls to be re-classified as one-hour rated, or leave
the document as drawn to be zero rated. Upon this decision, we
shall make a determination of the enclosure above the doors in
the kindergarten entrance, whether it has to be one-hour fire
