Dear Mr. Kavanagh;
This letter is to inform you that it is the policy of this department to allow the
construction of an unroofed single level deck, at the first floor level, to be placed no
closer than 5 feet from a property line. Please be advised that though this allowance is
made regarding the encroachment to the proper setback, this does not by right allow such
construction to exceed the allowable lot coverage percentage. Any encroachment to the
allowable percentage of lot coverage, would still require the approval of the Zoning
Board of Appeal.
I trust this letter will help to clarify this issue for you, and in specific speak to the
issue currently before you regarding the Felt Street project. If I can be of any further

RE: Laine Chase Property on Highland Avenue
Dear Matt:
I appeared before Judge Kerman today and explained our conversation of
yesterday. As Laine Chase was not present, his case was not dismissed. I explained that
he had other matters in Lynn District Court with you this morning. I also explained to
Judge Kerman that we have started process with Mrs. Chase. Hopefully, the Pep Boys'
offer to pave and clean the above captioned property will come to fruition prior to the
need to have a hearing with Mrs. Chase. Please keep me posted on the status of that
agreement. Additionally, Health Inspector Scott is concerned that the"garbage loam" not
be used as the grade material between the Chase and Pep Boys parcels.
Laine Chase's case has been rescheduled for Tuesday, November 18t" for.
dismissal. Thank you for your attention to this matter.

Dear Mr . LeClerc:
I managed to speak to Lou Visco at the Board of State
Examiners of Plumbers and Gas Fitters early this
afternoon. Mr. Visco informed me that so long as the
proposed establishment on the first floor of the building
at 14 May Street was not industrial and contained less than
one thousand square feet , then a handicapped accessible
unisex toilet room with one water closet and one lavatory
would lawfully accommodate the needs of between one and
fifteen persons employed within the establishment.
I asked Mr. Visco to send me a letter to that effect
so that I could present it to you and Dave Harris as an
authoritative interpretation of 248 CMR 2.10 (19) (e) , but
Mr. Visco suggested instead that if you were to call him
then he would reiterate his interpretation for you.
My suggestion would be for you and Dave Harris to
contact Mr . Visco via a telephone conference call and ask
him whatever questions you need answered in order to
satisfy yourselves that the proposed establishment on the
first floor of 14 May Street meets the exception 248 CMR
2.10 (19) (e) . If Mr. Visco still does not want to provide a
written interpretation of 248 CMR 2.10 (19) (e) , at least you
will have personal knowledge of his interpretation which
you can then memorialize by way of a memorandum to the file.
