To assist in the response to your letter, I offer the following history of the tenancy of the building.
Over the many years,this property has been owned by members of my family.The property was
purchased by my father,Aaron Weinstein and my uncles, Elliott Adelman and Theodore R.
Porosky in 1971,,and held in Mason Realty Trust, as it still is today.Aaron, Elliott and Theodore
were all Trustees of Mason Realty Trust and %3 beneficiaries.
The property at that time housed two businesses.The two businesses were A.S. Burg Co. and
Pacesetter Products Inc.,which were owned and operated by my father and my uncles. The two
businesses operated at the location until approximately 1985. Following the sale of my father's
business in 1985,the property no longer housed A.S.,Burg Co. and Pacesetter Products Inc. The
space vacated by both companies was subsequently rented to other third-party tenants including
but not limited to Sid Green's Dinette, Steve Glovsky, Esq.,ADT Home Security, R& S Ceramics,
Fred's Auto Repair, JC Fence and John Defrancesco&Son.
At no time, since before the purchase of the property in 1971, has the property been a single
tenant use-building. I hope my account of the history of our family's ownership of the property is
helpful.
Further, as you requested,we have engaged a Massachusetts's Licensed Design Professional to
assist us in a code review of the building. The information provided by Alok Dhanda will be
furnished under separate cover.

I am a registered Architect in MA and have been engaged by Mason Realty Associates, LLC
to respond to your letter dated 03 August, 2017 and to provide an `Initial Code Review' for the Existing
Multi-Tenant Building located on the above referenced property. Included with my report, please find
(a)letter describing the history of building tenancy from Owner Representative, Jane Verbanic; and
(b)letter regarding ongoing life safety system upgrades being performed by Norel Service Co., Inc.
Building Summary:
As it currently stands, the building located at 53-59 Mason Street and 38 Commercial Street in
Salem, Massachusetts, contains multiple tenants and non-separated mixed uses. The main improvement
was originally constructed around 1930 as a bus terminal and maintenance garage while the addition
Unit 101 was built around 1970. The structural system is comprised of load bearing masonry exterior
walls and interior steel columns that support steel trusses & steel joists carrying steel roof decks. The
original building has a shallow pitch tar&gravel roof while the addition and front offices have a fully
adhered rubber membrane roofing system. A common loading dock (currently leased to Suite
103 SAAD Upholstery) was built at an unknown time and is enclosed with a pre-engineered system of
insulated metal panels on metal framing. The building has multiple entry points. The exterior doors are
either metal framed glass or metal security doors. Many of the tenant suites have loading docks and
large overhead doors. The windows are mostly metal framed units with thermal pane glass. There are
two sets of stairs (positioned on the left and right) that access the mezzanine level offices numbered 201
through 206. The mezzanine storage space numbered 207 is part of tenant suite 107 and is accessible
via a single stair from within the unit.

Explanation/Calculation for Non-separated Mixed Use:
1. IBC 2009—Section 505—Mezzanines. The existing upper level of offices and storage rooms
comply with the referenced section and hence shall be considered a portion of the 1st floor in
which it is contained.
a) 505.1_General. A mezzanine or mezzanines in compliance with Section 505 shall be
considered a portion of the story in which it is contained. Such mezzanines shall not
contribute to either the building area or number of stories as regulated by Section 503 1
The area of the mezzanine shall be included in determining the fire area defined in
Section 902. The clear height above and below the mezzanine floor construction shall
not be less than 7 feet.
b) 505.2—Area Limitation. The aggregate area of the mezzanines does not exceed 1/3 rd of
the V floor.
c) 505.3—Egress. Two independent means of egress are provided from the mezzanine level
offices numbered 201 through 206.
d) 505.4—Openness—Exception 2. The mezzanine level offices numbered 201 through 206
has two means of egress and thus is not required to be open to the room in which the
mezzanine is located since at least one of the means of egress provides direct access to an
exit from the mezzanine level.
2. Table 503—Allowable Building Heights &Areas. To be considered non-separated mixed use, the
overall building must comply with the height and area limits for new construction based on the
most restrictive occupancy in the building and the building construction type. For Use Group F-
1 and Construction Type IIIB, the#of stories = 2, Height= 55 Feet and Area= 12,000 SF.
a) 506.2—Frontage Increase. 50% of the building adjoins or has access to a public way or
open space having a minimum width of 20 feet.
b) 506.3—Automatic Sprinkler System Increase. The building is equipped throughout with
an approved automatic sprinkler system in accordance with section 903.3.1.1, and thus
the building area limitations in Table 503 is permitted to be increased by an additional
300% for buildings with no more than one story above the grade plane.

Means of Egress:
1. Exits from tenant suites and common areas are identified on plan.
a) Egress is compliant from all spaces except from Tenant suites 104 and 106.
b) Tenant Suite 104 is vacant and hence an additional exit door can be added from rear
during future tenant fit-out.
c) Tenant Suites (107+108) and 109 avail of the following code exception to explain using
sliding doors and overhead doors for egress. 780 CMR 1008.1.2 Door Swing. Egress
doors shall be of the pivoted or side-hinged swinging type. Exception: 1. Private garages,
office areas, factory and storage areas with an occupant load of 10 or less.
Life Safety Systems:
1. The building has a fire sprinkler system but no fire alarm system. See attached letter regarding
ongoing life safety system upgrades being performed by Norel Service Co., Inc.
2. Notations of missing fire sprinkler heads and exhaust on floor plans are Architects observations
and should not be construed as a comprehensive study of the fire protection &mechanical
systems.
3. Tenant Suites identified below should be reviewed by a fire protection engineer or contractor:
a) Suite 103—SAAD Upholstery: Storage of foam, fabrics +thread, and glues etc. used to
upholster. Machines to process foam into appropriate size &thickness. Review NFPA
13 to identify hazard categories and minimum sprinkler density requirements (gpm/sqft).
b) Suite 107 & 108—Peter Lynch: Storage of large quantities of assorted stuff. Suite 107
has a wood-framed mezzanine which is allowed in Type IIIB construction but is missing
sprinklers under the mezzanine which is a code violation. Review NFPA 13 to identify

options for protecting rack storage. These options range from having in-rack sprinklers
to having very high-flow sprinklers at the ceiling.
4. Exit signs and emergency lights are located in tenant suites and common areas. A detailed
analysis of the locations, spacing, and testing of these devices has not been performed as a part
of this exercise.

In the last few"months, NORELService Company, Inc. has performed various upgrades to the life safety systems at this
property.The upgrades include, but may not be limited to:
1. Replacement of the fire alarm control panel and the addition of a remote fire alarm annunciator in the main
building lobby
2. Installed a new electric sprinkler bell,at the request of Lt. Peter Schaeublin,.the Salem Fire Marshall.
3. Tested the sprinkler system.
4. Tested the master box at the main building entry.
5. Performed a review of the existing sprinkler system at this location and in July completed the installation of
approximately 350 new sprinkler heads in the original building which was constructed in the 1930's.
6. Installed'.a monitoring service,to allow for notification to key personnel and the fire department in the event of
activation on the sprinkler panel.
Per your request,we have reviewed the A101 existing floor plan, prepared by Alok Dhanda and dated Sept 01, 2017. l
Having done so,.Wewill provide a proposal to address the items noted in said plan which will be furnished under
Separate cover.

It has been brought to my attention that material, such as soil, gravel,concrete blocks,etc, are
being stockpiled on your property at 53 Mason Street. An inspection was conducted on
Monday November 6 and it has been determined that you need come before the Conservation
Commission to explain the current use of the site and your plan to remove the maferial from
its current location. Per our conversation on Tuesday November 7, 2006 tit is my
understanding that Mass1lighway is leasing space from you to store material on site.;
Your property is located within a Riverfront Area and the Commission is looking'to protect
the resource area. At this point in time, the Salem Conservation Commission is notifying you
that all m2ft ia4 -.toad within the Riverfront Area shall be removed away from the resource
area and erosion control measures including hay bales and silt fence shall be installed along
the top of the bank of the North River.
Please contact me (978) 619-5685 at your earliest convenience to discuss theactivities
occurring on site, so that we can discuss the situation determine what type of filing you will
require. If you do not respond to the request to address the Commissions concerns and attend
the Conservation Commission hearing on November 16, 2006 at 6 pm local fines;shall be

AND AARON WEINSTEIN FOR A VARIANCE AT 53 MASON STREET (BPD)
A hearing on this petition was held September 11 , 1991 with the following Board
Members present: Richard Bencal, Chairman; Joseph Correnti, Richard Febonio,
Edward Luzinski, Mary Jane Stirgwolt. Notice of the hearing was sent to abutters
and others and notices of the hearing were properly-;published in the Salem Evening
News in accordance with Massachusetts General Laws Chapter 40A.
Petitioners are requesting a Variance from use in order to allow instructional
exercise classes in this BPD zone.
The Variance which has been requested may be granted upon a finding of this
Board that:
1 . Special conditions and circumstances exist which especially affect the land,
building or structure involved and which are not generally affecting other
lands, building or structures in the same district.
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner.
3. Desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of the
district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented, and
after viewing the plans, makes the following findings of fact:
1 . The Business Park Development District (BPD) was set up to allow mixed
uses such as this proposed use.
2. The proposed use will not be a burden to the-area.
3. No opposition was presented to the plan.
On the basis of the above findings of fact, and on the evidence presented at the
hearing, the Board of Appeal concludes as follows:

the district in general.
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship on the petitioners.

AND AARON WEINSTEIN FOR A VARIANCE AT 53 MASON STREET (BPD) J
A hearing on this petition was held September 11 , 1991 with the following Board
Members present: Richard Bencal, Chairman; Joseph Correnti, Richard Febonio,
Edward Luzinski, Mary Jane Stirgwolt. Notice of the hearing was sent to abutters
and others and notices of the hearing were properly.,published in the Salem Evening
News in accordance with Massachusetts General Laws Chapter 40A.
Petitioners are requesting a Variance from use in order to allow instructional
exercise classes in this BPD zone.
The Variance which has been requested may be granted upon a finding of this
Board that:
1 . Special conditions and circumstances exist which especially affect the land,
building or structure involved and which are not generally affecting other
lands, building or structures in the same district.
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner.
3. Desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of the
district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented, and
after viewing the plans, makes the following findings of fact:
1 . The Business Park Development District (BPD) was set up to allow mixed
uses such as this proposed use.
2. The proposed use will not be a burden to the .area.
3. No opposition was presented to the plan.
On the basis of the above findings of fact, and on the evidence presented at the
hearing, the Board of Appeal concludes as follows:
1 . Special conditions exist which especially affect the subject property but not
the district in general.
2. Literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship on the petitioners.
3. The relief requested can ba granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of the
district and the purpose of the Ordinance.

Therefore, the Zoning Board of Appeal voted unanimously, 5-0, to grant the
Variance requested, subject to the following conditions:
1 . Petitioner shall comply with all City and State statutes, ordinances, codes
and regulations.
2. All renovations shall be done per the plans and dimensions submitted.
3. Petitioner shall obtain a legal building permit.
4. Petitioner shall obtain a Certificate of Occupancy.
5. All requirements of the Salem Fire Department relative to smoke and fire
safety shall be strictly adhered to.
