A member of Northeast Health System' t Health and Education Services HES, a private non-profit corporation,is a large agency providing mental health, crisis, and residential services to youth and adults in communities across the North Shore and Merrimack Valley. We run outpatient clinics and residential programs across this catchment area. Primary funding sources for the agency are the Department of Mental Health, Department of Children and Families(formerly DSS) as well as public schools and private insurance. All of HES's residential programs for youth are community based serving between 10— 14 youth per site. Most are located in community housing in residential neighborhoods. ACCESSSTARR ACCESS STARR is one of HES's programs. It is a coeducational program primarily for Cape Ann teenagers referred by the Department of Youth and Families. The program provides short-term stabilization and case management to youth removed by the department from their homes due to either CHINS petitions or care and protection orders. The program provides the department with a place for youth in crisis to go where they can be safe and stabilize while a longer term plan for their care is worked out. Youth often stay between 3 —6 weeks. Youth attend their local schools while at the program and are bussed to and from school by their home school system. The program provides 24/7 awake staff supervision of youth. There is one direct care staff on duty during waking hours for every 3 residents with two awake staff on duty at night. The entire building shall be occupied under the Special Use Group Home use, 780 CMR Section 423 by Health & Education Services, Inc (see attached mission statement). The bottom level entrance by ramp is directly from the outdoors. There is no interior lobby to the building. There is no room to place or to locate an elevator in the existing building or on the sides of the building. The owner asks for a variance of that requirement and a waiver of the vertical accessibility to the upper floors be granted by allowing equivalent facilities to those on the upper floors to be provided on the first floor level that would be accessed by a proposed handicapped ramp (see attached C 1.1 and Al.1). There are conditions especially affecting the particular building or compliance involved. The enforcement of regulations relating to the above referenced 521 CMR 28.1 would do manifest injustice or cause substantial hardship, financial or otherwise to the appellant and would be unreasonable under the circumstances on condition of the property. The desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of such provision to the regulation. The need for relief results from the topography of the site and the location and design of the building on the site. In support of his petition, the applicant recites the following facts: 1. The building is located in a congested and high traffic neighborhood. The front of the building faces Mason Street and is built less than sixty inches (60") off the front lot line and the first floor elevation is 42" above grade at this location. The right side elevation of the building has a zero lot line and is bounded by a ten foot (10'-0")wide asphalt Right of Way that provides the only public access to the road known as Mason Street. The left building elevation is also less than seventy two inches (72") off the property line at the bay window and also constricted by a low retaining wall, limiting access by any means to this area of the structure. The rear elevation of the building offers the best solution to the access problem. Though a majority of the building sits less than seventy two inches (72") off the lot line,the rear elevation opens to an existing parking lot allowing for access to our proposed new main entrance and required handicapped ramp. The grade slopes up at this location also allowing for our handicapped to be at a minimum length. 1 of 2 Petition for Variance From 521 CMR 28.1 39%Mason Street,Salem,Massachusetts 2. The buildings estimated cost for renovation is listed as sixty three thousand five hundred dollars ($63,500), see attached AAB application. Cost estimates of installing a fully compliant four stop elevator, shaft way, elevator machine room and modifications to both the interior floor plan layout and structural assemblies of the structure would add a total estimated cost of approximately one hundred twenty thousand dollars ($120,000)bringing the new cost estimate of construction to one hundred eighty three thousand five hundred dollars ($183,500). This would increase the construction cost by 189%, making the renovation project impracticable financially. 3. The building existing height limitations would also require the applicant to request relief from the City of Salem by way of a variance from the Maximum Building Height Requirements set forth by the city. The new elevator shaft if required would need to penetrate the existing roof assembly and exceed the city's Maximum Building Height zoning by-law. 4. Because of the existing design and layout of the building, including doorways and windows, there is no room either in the building or on the site to accommodate separate mechanical areas for a full elevator. There is no room available for an interior foyer. There is no room to create a foyer area to shelter an elevator sliding door from the elements. 5. Equivalent facilities to those on the upper floors shall be provided on the first floor level that would be accessed by a proposed handicapped ramp directly from the outside, and allow the owner to create one(1) new van accessible handicapped parking space and walkway at the ramp entry (see attached C1.1). 6. The altering and/or reduction of square footage and spatial layout would limit the use for the purpose intended thus making the project impracticable for the tenant. (Refer to drawings Al.1) 2of2 Item #9 APPLICATION FOR VARIANCE ATTACHMENT 391/2 MASON STREET, SALEM, MASSACHUSETTS 9. For each variance requested, state in detail the reasons why compliance with the Board's regulations is impracticable. State the necessary cost of the work required to achieve compliance with the regulations. Stephen Haley, the property owner, is requesting relief from 521 CMR 28.1 as well as other 521 CMR sections on an existing three story wood building at 39 1/2 Mason Street, Salem,Massachusetts. The entire building shall be occupied under the Special Use Group Home use, 780 CMR Section 423 by Health&Education Services, Inc(see attached mission statement). The bottom level entrance by ramp is directly from the outdoors. There is no interior lobby to the building. There is no room to place or to locate an elevator in the existing building or on the sides of the building. The owner asks for a variance of that requirement and a waiver of the vertical accessibility to the upper floors be granted by allowing equivalent facilities to those on the upper floors to be provided on the first floor level that would be accessed by a proposed handicapped ramp (see attached Cl.l and Al.1). There are conditions especially affecting the particular building or compliance involved. The enforcement of regulations relating to the above referenced 521 CMR 28.1 would do manifest injustice or cause substantial hardship, financial or otherwise to the appellant and would be unreasonable under the circumstances on condition of the property. The desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of such provision to the regulation. The need for relief results from the topography of the site and the location and design of the building on the site. In support of his petition,the applicant recites the following facts: L SECTIONNUMBER: 521 CMR 28.1-Elevators-General A. The building is located in a congested and high traffic neighborhood. The front of the building faces Mason Street and is built less than sixty inches (60") off the front lot line and the first floor elevation is 42" above grade at this location. The right side elevation of the building has a zero lot line and is bounded by a ten foot (10'-0")wide asphalt Right of Way that provides the only public access to the road known as Mason Street. The left building elevation is also less than seventy two inches (72") off the property line at the bay window and also constricted by a low retaining wall, limiting access by any means to this area of the structure. The rear elevation of the building offers the best solution to the access problem. Though a majority of the building sits less than seventy two inches (72") off the lot line,the rear elevation opens to an existing parking lot allowing for access to 1 of 5 Attachment-Item#9 Application For Variance, 39 '/2 Mason Street,Salem,Massachusetts our proposed new main entrance and required handicapped ramp. The grade slopes up at this location also allowing for our handicapped to be at a minimum length. B. The buildings estimated cost for renovation is listed as sixty three thousand five hundred dollars ($63,500), see attached AAB application. Cost estimates of installing a fully compliant four stop elevator, shaft way, elevator machine room and modifications to both the interior floor plan layout and structural assemblies of the structure would add a total estimated cost of approximately one hundred twenty thousand dollars ($120,000)bringing the new cost estimate of construction to one hundred eighty three thousand five hundred dollars ($183,500). This would increase the construction cost by 189%, making the renovation project impracticable financially. C. The building existing height limitations would also require the applicant to request relief from the City of Salem by way of a variance from the Maximum Building Height Requirements set forth by the city. The new elevator shaft if required would need to penetrate the existing roof assembly and exceed the city's Maximum Building Height zoning by-law. D. Because of the existing design and layout of the building, including doorways and windows, there is no room either in the building or on the site to accommodate separate mechanical areas for a full elevator. There is no room available for an interior foyer. There is no room to create a foyer area to shelter an elevator sliding door from the elements. E. Equivalent facilities (kitchen (Group 2B),bathroom (Group 2B), sleeping area and counseling room) to those on the upper floors shall be provided on the first floor level that would be accessed by a proposed handicapped ramp directly from the outside, and allow the owner to create one(1) new van accessible handicapped parking space and walkway at the ramp entry(see attached C1.1). Refer to item G below to reference basement. F. The altering and/or reduction of square footage and spatial layout would limit the use for the purpose intended thus making the project impracticable for the tenant. G. The basement level shall be limited to employees only. Refer to attached affidavit. 2. SECTIONNUMBER: 521 CMR 27.2-Treads and Risers A. To achieve compliance with CMR 27.1 in Stairway#1, the stairwell size would need to be increased and the stair rebuilt. The construction cost to achieve to remove and rebuild the stairs to full compliance would also make the renovation project impracticable financially. 3.SECTIONNUMBER:521 CMR 27.2-Treads and Risers A. To achieve compliance with CMR 27.2 in Stairway 42, the stairwell size would need to be increased and the stair rebuilt. Due to the existing design and layout of the building, including doorways and windows,there is no room in the building to extend the stairs. 4.SECTIONNUMBER: 521 CMR 27.4.1-Handrail Location A. To achieve compliance with CMR 27.4.1 in Stairway#1 and Stairway#2 removal and replacement of the inside interior baluster handrail would be detrimental to the house's originality and increase construction cost. It is put forth that a new code compliant handrail as shown on drawing AIA shall be installed on the outside wall of each stairway with proper blocking, handrail size, mounting height and knuckle clearance. B. Handrails would not allow for compliant extensions at all landing levels due to door locations and existing stairway and landing width. S.SECTIONNUMBER:521 CMR 25.1-Entrances-General A. I spoke to Thomas Hopkins at the MAAB today and he agreed with my interpretation that the Section 423 Special Use Group Home must meet MAAB regulations. This has been MAAB policy for some time now for similar projects permitted under 780 CMR Section 423. Because the value of construction work on the current permit application and previous work in the,last 3 years exceeds 30%of the building's value, MAAB rules require full accessibility at the entire structure. Since equivalent facilities to those on the upper floors could be provided on the first floor,Mr. Hopkins and I both agree that a good case could be made for a waiver of vertical accessibility to the upper floors.
