Notice of the hearing was sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. The petitioner is requesting a Variance from side yard setback to allow an existing addition for the property located at 11 1/2 Mason Street located in an Industrial zone. The Variances, which have been requested, may be granted upon a finding by this Board that: a. Special conditions and circumstances exist which especially affect the land, building or structure involved and which are not generally affecting other lands, buildings and structure involve. b. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship, financial or otherwise, to the petitioners. c. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district of the purpose of the Ordinance. The Board of Appeal, after careful consideration of the evidence presented at the hearing, and after viewing the plans, makes the following findings of fact: 1. The Petitioner Mr. Reddy appeared and represented himself at the hearing. 2. The plans were submitted showing the existing addition. 3. The addition has a setback of 7 1/2 feet instead of the required 10-foot setback. 4. There was no opposition to this petition. S. 11/12 Mason is a legal 3 family dwelling. DECISION OF THE PETITION OF SUCHAND REDDY PINGLI REQUESTING A VARIANCE FOR THE PROPERTY LOCATED AT 11 1/2 MASON STREET I page two On the basis of the above findings of fact, and on, the evidence presented at the hearing, the Zoning Board of Appeal concludes as follows 1. Special conditions exist which especially affect the subject property but not the District. 2. Literal enforcement of the provisions of the Zoning Ordinance would involve substantial hardship to the petitioner. 3. Desirable relief can be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent of the district or the purpose of the Ordinance. Therefore, the Zoning Board of Appeal voted 5-0 to grant the Variances requested, subject to the following conditions; 1. Petitioner shall comply with all city and state statutes, ordinances, codes and regulations. 2. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 3. All construction shall be done as per plans submitted and approved by the Building Commissioner. 4. Petitioner shall obtain a building permit prior to beginning any construction. He wrote me a letter dated 9/5/2006, saying he has begun the process to install a foundation, In a subsequent letter dated 9/18/06,he said he dug holes and found a stone and mortar cement foundation below the topsoil. Subsequently,I had the rear addition reviewed again by the contractor,who had examined this in July-August 2003 and told me the rear addition was an enclosed porch resting on a frost wall. He sent me a sketch of the relevant portions of the rear addition as it exists,a copy of which is enclosed for your reference. To support his conclusion,the contractor said L The 8"to 10"wide frost wall("rubble stone foundation"),does not comply with Massachusetts State Building Code(780 CMR),Table 3604.4.1,IA as well as section IS 12-3.4"Rubble stone: Foundation walls of rough or random rubble stone shall not be less than 16 inches(406 mm)thick". 2. The subject property is a duplex attached to 11 1/2 Mason Street, which structure petitioner indicates is used as a multi-family. (This decision makes no findings regarding the use of 11 1/2 Mason Street). 4. A 1982 special permit allowed the subject property to be used as a two-family with the condition to the effect that the Special Permit for I I Mason Street shall terminate if the property is no longer owner-occupied, or is transferred. The petitioner wants to resolve confusion created by this condition and now seeks a variance to convert the property into a legal two-family. 5. The current owners believed that they had purchased a legal two-family and have been using the property as such. 6. One member of the public spoke opposed to the petition. 7. One member of the public spoke in favor of the petition. 8. Granting the requested relief will not change the current actual use of the property. On the basis of the above findings of fact, including all evidence presented at the public hearing, including, but not limited to, the Petition the Zoning Board of Appeals concludes as follows: 1. The petitioner's request to for a Variance does not constitute substantial detriment to the public good as the use of the dwelling is currently residential and an additional unit will not cause a substantial impact on the neighboring community. 2. The requested relief does not nullify or substantially derogate from the intent or purpose of the zoning ordinance as the nature of the Business Neighborhood District allows for a residential component in the Special Permit section and by its nature allows incorporation of residential uses with business uses. 3. A literal enforcement of the zoning ordinance would create a substantial hardship to the petitioner by unfairly restricting the usage of their property when multi-family uses are permitted in the district with a Special Permit. 4. In permitting such change, the Board of Appeals requires certain appropriate conditions and safeguards as noted below. I have two items of concern. They are the following: 1. The property owner in 1982, John Suldenski Jr. petitioned the Salem Zoning Board of appeals for a Special Permit to create 2 units at#11 Mason and 3 units at 11 '/2 Mason St. The Board granted the petition but placed several conditions on the petitioner. Specifically conditions 3,4, 5 and 6 were never completed. It is my opinion the Special Permit is not valid. 2. In 1992, 11 '/2 Mason Street was purchased by Al and Maria Barcamonte and 11 Mason Street was purchased by them in 1993. Salem Zoning Ordinance 8-2 would automatically cause the two non-conforming lots to merge. I do not see how the property could have separated and sold as two separate properties. The home inspector recommended a further evaluation by a contractor to determine the soundness of the 2nd bedroom structure. The buyers had a licensed contractor inspect the 2nd bedroom structure. The contractor said the structure was an addition and it was possibly a porch that was converted into a 2nd bedroom illegally for all the three floors of the building. He recommended that the 2nd bedroom needs a foundation and suggested I investigate any available public records. Subsequently, I referred to a copy of the property card of 11 1/2 Mason Street from the tax assessor's office. It lists the 3 family property as having only 3 bedrooms in total. I feel that I have given this fair enough time, as the weather is extremely cold at night & very chilly in the morning, to where the use of the furnance is non-stop. - - I have snaked-lined the duck work to the following: The front bedrm, middle bedrm, & the bathrm are fed off of one line & the back bedrm has it's own line - that distance from the cellar straight to the top (2nd fl) rear bedrm is too much of a distance so, therefore, air@ blows in w/o the heat. The middle bedrm as well as the bathrm aren't rec'ing that much heat - this is all happening on the second floor. The front bedrm & the kitchen are not rec'ing adequate heating - the duck work from the kitchen is being taken from the line to the rear (top fl) bedrm. I have to keep the heat up to 720 during the evening hours & 68° at bedtime. I have to keep the back bedrm shut all day long as it is too cold in there to which the cold air goes right into my handicap sons room. [The LL was just here & I explained to him about how many vents are feeding off of the same line & he said "That there was new duck work put in, that people lived (prior) w/the same heating system & never complained." I told him (again) "About the same line is being fed off of three vents, that there is air that comes out of it but NO forced hot air." Personally, I do not think that he want's to hear it. The colder weather is coming & I need for my family to be kept warm] . I have also changed the smoke detector's quite a few times & they still beep. Salem, MA 01970. Dear Sir, Following the suggestions in your letters dated September 8, 2003, and September 16, 2003 and subsequent to the Zoning Board of Appeals hearing on September 17, 2003, I researched the electrical, plumbing, fire etc. public records over the past year. The purpose of my research was to discover all the problems that exist with the property and seek appropriate resolution. After the granting of my petition for a variance on an illegal addition by the Zoning Board of Appeals, I have discovered several documents and facts, which I am going to present in this letter. Based on the facts presented in this letter, I seek determination and clarification of Salem Zoning Ordinance as provided in Sec. 9-1 and 9- 2 on Map 26, Lots 67 & 68 identified as 11-11 V2 Mason Street, Salem, MA 01970. Your determination and enforcement will let me know where I stand with respect to the property as well as the status of the property itself. Fact 1: 11 %z Mason Street, Salem, MA 01970 was purchased by Alfonso Barcamonte and Maria Barcamonte, on June 12, 1992 (Essex South Registry of Deeds, Book 11338, page 510). 11 % Mason Street, Salem, MA 01970 is identified as Map 26, Lot 0068 and has a Lot size of 2,500 sq. ft. as per a copy of an Assessor's Map I obtained from the planning department office. Fact 2: 11 Mason Street, Salem, MA 01970 was purchased by Alfonso Barcamonte and Maria Barcamonte, on June 9, 1993 (Essex South Registry of Deeds, Book 11940, Page 395) while they continued to own 11 % Mason Street, Salem, MA 01970. 11 Mason Street, Salem, MA 01970 is identified as Map 26, Lot 0067 and has a Lot size of 2,700 sq. ft. as per a copy of an Assessor's Map I obtained from the planning department office. 11 Mason Street, Salem, MA 01970 is either a single or two-family residential use lot. I will present more facts later on in this letter, based on which you can make a enforcement and/or determination as to whether 11 Mason Street, Salem, MA 01970 is a single or two-family residential property. Whether 11 Mason Street, Salem, MA 01970 is a single or two-family lot, according to Salem Zoning Ordinance Sec. 8-2 on Nonconforming lots, �S� since June 9, 1993, I 1-11 %2 Mason Street, Salem, MA 01970 are considered to be an undivided parcel for the purpose of Salem Zoning Ordinance and no portion of said parcel shall be used or sold which does not meet lot width and area requirements established by this ordinance, nor shall any division of the parcel be made which leaves remaining any lot with width or area below the requirements stated in this ordinance. Fact 3: On August 15, 2002, Alfonso A. Barcamonte and Maria B. Barcamonte sold Map 26, Lots 67 & 68 identified as I I-I 1 %2 Mason Street, Salem, MA 01970 as one (undivided parcel) entity on a single deed to ORSETT/RES 6 LLC of 372 Washington Street, Wellesley, MA (Essex South Registry of Deeds, Book 19077, Page 277). Fact 4: However, on December 6, 2002, ORSETT/RES 6, LLC conveyed only the deed to Map26, Lot 0068 identified as 1 I %2 Mason Street, Salem, MA 01970, to me (Essex South Registry of Deeds, Book 19765, Page 588). Please determine the application of Salem Zoning Ordinance, Section 8-2 and MGL, Chapter 40A, Section 6 as ordained by Sec. 9-1, and make a determination on where I stand. I need a prompt response from you as I am in a desperate financial situation as a result of this purchase, situation. Fact 5: Moreover, on August 4, 2003, ORSETT/RES 6, LLC conveyed the deed to Map 26, Lot 0067 identified as 11 Mason Street, Salem, MA 01970 to Luis Rosero and Maria Lora-Rosero (Book 21436, Page 4,5). Please determine the application of Salem Zoning Ordinance, Section 8-2 and MGL, Chapter 40A, Section 6 as ordained by Sec. 9-1, and make a determination on where I stand. Fact 6: The City of Salem Board of Appeals held a hearing on September 2, 1982. In their decision on the petition of John J. Suldenski, (Essex South Registry of Deeds, Book 6995, Page 239-240) the Board unanimously approved the granting of Special Permits to the Petitioner in accordance with the following terns and conditions: (1) Petitioner may convert I I Mason Street to a 2-family dwelling. (2) Petitioner may convert 11 '/2 Mason Street to a 3-family dwelling. (3) Petitioner shall maintain no more than two off-street parking spaces at the sites; provided, however, that up to a total of five parking spaces may be maintained at the site with the written agreement of the Petitioner's abutter Mrs. Broult and provided that such written agreement is submitted to this I Board. (4) A Certificate of Occupancy and use shall be obtained prior to renting any of the units to be converted. (5) Petitioner shall arrange for an easement or other property arrangement to allow both 11 and 11 %2 Mason Street to have access to and to use the two (or more)parking spaces at the rear of these sites. (6) The Special Permit for I 1 Mason Street shall terminate if the property is no longer owner-occupied. The Special Permit for 11 %2 Mason Street shall terminate if the Petitioner transfers ownership of the property to any party other than an owner-occupant. P S�2 'Pa,r- 2�� Fact 7: The conditions in the Special Permit (Essex South Registry of Deeds, Book 6995, Page 239-240) have not been fulfilled as described below: 1. Condition 3 has not been fulfilled to date. There are no parking spaces in the back of either I 1 or 11 '/z Mason Street. 2. To meet, Condition 4, a Certificate of Occupancy seems to have been issued by the city on 12/13/83 for 2nd & 3rd floors for 11 % Mason Street. This Certificate should not have been issued without the fulfillment of the other conditions 3, 5 in the Special Permit. The City of Salem Building Department has not been able to provide a copy of the Certificate of Occupancy so far. However, the Fire Marshal's office has provided a copy of the occupancy certificate on floors 2 & 3 with instructions to complete 151 floor occupancy. You, the Acting Building Commissioner, Zoning Officer, Thomas St. Pierre suggested it does not have a permit number and may not be legal. 3. Condition 5 has not been met. The petitioner, John Suldenski, Jr. did not arrange for an easement or other property arrangement to allow both 11 and 11 %z Mason Street to have access to and to use the two (or more)parking spaces at the rear of these sites. To get to the rear of 11 % Macon Street by car, one has to go through the driveway adjacent to the building on 11 Mason Street. 4. Condition 6 has not been met either. As per the City of Salem street listings, 1984 — 1986, John Suldenski, Jr. lived at 11 Mason Street. As per the 1987— 1991 street listings, John Suldenski,Jr. lived at 34 Walter Street in Salem and not 11 or 11 % Mason Street. According to the City of Peabody street listings and an affidavit of Residence, Alphonso A. Barcamonte and Maria B. Barcamonte were residents of the City of Peabody as of January 1, 1990 residing at 7 Stone Drive. Therefore, it would appear, based upon the plain language of the zoning ordinance, that whether the properties came into common ownerships subsequent to August 27, 1960, is irrelevant. Additionally, and perhaps more important, is a second reason for the inapplicability of Section 8-2(3) of the zoning ordinance to 11-11'/z Mason Street. Section 8-2(3) of the zoning ordinance provides, again, in pertinent part, that the section restricts the use of lots ". . . which could not be built upon for residential purposes . . . ."(emphasis added). In the case of 11-11%z Mason Street, these properties had already been built upon for residential purposes and existed as two independent improved residential properties prior to the adoption of the zoning ordinance in August 1960. Thus, the application of Section 8-2(3) would not be appropriate, as it was not that these lots could not be built upon for residential purposes and were commonly owned prior to August 27, 1960, but in fact they had already been built upon and each of them constituted a single and separate lot as of August 27, 1960. Additionally, even if Section 8-2 of the Salem Zoning Ordinance intended to merge these two separately built on, independently owned lots if they came into common ownership had been built thereon, M.G.L. c. 40A, Section 6 specifically provides that a zoning ordinance shall not apply to structures or uses lawfully in existence or lawfully begun. However, and in any event, as stated above, I do not believe that the Salem Zoning Ordinance is inconsistent with c. 40A, Section 6, as Section 8-2 would only apply to merger of two "unimproved" lots after the date of the adoption of the Salem Zoning Ordinance. We are hopeful that this will clarify and resolve any issue with respect to the "separateness" and"severability" of 11-11'/z Mason Street.
